I have opted back into subs, but I must admit, it is with a bit of a sick feeling. I hate to endorse 30 cents per download, but I will give this a whirl because I am grateful to StockXpert for not saying "our way or the highway" and I will see what happens. Hopefully we can distinguish between the two plans in our sales reporting.
The rest of this post might be moot if the (c) has changed, if it did I missed it.
One thing that troubles me though is that images say "property of Photos.com" or "Jupiter Images". Did I miss where this point changed at all, or are we still anonymous contributors to this program? What about the name brands that everyone has worked so hard to build.
Are we anonymous so buyers cannot easily search our names on another site to find their ppd's for different prices?
But, when it comes to "search fairness" we will not all be equal? The buyers won't be able to find a style they love - and click through to, say, Yuri's portfolio and shop there for more images. Maybe the sales will be more evenly spread out?
I'm still uncomfortable if my Intellectual Property will be flogged without my name beside the copyright.
The following is from http://www.stockxpert.com/lpages/contributor/Copyright of Images As it relates to the ownership of your images, the EULA does state:
"The Image(s) are copyrighted and protected under the various laws of the United States, International treaties and other applicable laws. The Image(s) shall remain the sole and exclusive property of JUPITERIMAGES, or its licensors. Use of the Images is licensed, not sold, pursuant to the terms of this Agreement. Use of the Images without agreeing to this Agreement, or a breach of these Agreement terms, is copyright infringement."
We just want to clarify that YOU are the "or its licensors" it mentions. This part of the agreement simply means that no one can claim ownership or copyright on the images that are downloaded from any of the Jupiterimages family of websites.
Please note that we will be addressing the artist name on the image details page for copyright acknowledgment post-launch.

StockXpert have repeatedly shown good faith and willingness to work out equitable solutions. Personally I feel they have met us more than halfway on this and deserve the benefit of the doubt. I am happy to reward their efforts by opting in.

I'm really in no way qualified to pipe in on this, but I will anyway. It looks to me that there are a LOT of "artistic amateur" photographers on this site. They take lovely pictures, but many or incorrectly processes and many don't have a lot of commercial value. I'm thinking MP is hoping to tap into these for the blog thing, which if I'm reading between the lines correctly, is primarily aimed at getting as many links to their site as possible to increase their search engine placement. I can actually see this working.
Then again, I'm really new to all this and definitely fall into the amateur category, at least when compaired to most on this board, so I may be way off base.

Arian here from Mostphotos.com. We have been in the planing stage for trough the summer and we are now ready to start implementing some new features and marketing campaigns. We will be working hard to improve the number of sales from now to December. And we need to hit some key points in order to that. * Increase the over all traffic * Create better market awareness of our brand * Get more links to the site to improve our search engine rankings. We have been trying to come up with ideas on how to market our brand without spending large amounts of cash and we came up with a method. We can offer a API solution that will allow users of big blog services like wordpress.com and blogspot to search our database directly from their blogtools. They can then pick an image and use it on their blog. NOT for commercial purposes. We will deliver a lowres image with a reduced watermark containing the photographers name and the address to his or her profile at mostphotos. The image will also be linked to the view page of the photo. This will be free of charge for the blogger that gets some nice images to use in the blog post and we get publicity and a new way for the photographers to show off their work. We can also provide a list of links to all the blogs that are using your images so you can check it out. So we need your input on this feature, would anyone be interested in letting us use their photos for this service? There will be an opt-in so we wont force anyone to do this. I am only a small player with a small port. However, I almost always sell something on Shutterstock each day. I am now on my 4th day without one single download. Really strange. The other strange thing is my last 3 downloads were all of the same picture -- one that had never sold before (been online for about 4 months).

Yep -- multiple resizings, and multiple re-JPGing is the fastest way to ruin a good image. I don't understand it either.

All my submissions have been reviewed almost instantly -- often while I'm still setting their catagories -- with few if any rejections. However, I uploaded 45 on Friday Morning and they are all still pending.

Steve, yours and StockXpert's responsiveness to contributor concerns is very much appreciated.
Of course it is unreasonable to expect a major reworking of the EULA in a short time. This is a major decision that requires a legal team to be involved. We all know how slow lawyers work
The fact is you and the rest of the StockXpert admins involved have gone above and beyond IMHO, and by leaving the opt-out we are free to participate or not in the current EULA and future offerings. Really can't ask much more than that.
Hope folks will appreciate your efforts and cut you guys a break....

I had two nice 2.50 credit sales this morning. I opted out months ago and have an increase in sales. I'm convinced that subs were taking away dollars from my portfolio there. I'm still getting the sales but at the higher rate. I'll stay opted out very happily.
Lou, I think you are right that subscriptions were taking away higher sales. I have been opted in to subscriptions from the beginning and only opted out over the weekend.
Monday and Tuesday I am seeing a marked increase in L and XL sales. I hardly got any of those after subs kicked in and now I am getting quite a few. Volume is down a bit, but I am actually making better money than when I was opted in to subscriptions. Hope the trend continues
How could this be possible? Do the search ranks change? Do you think buyers are actually searching for images NOT available through subscription? I'm not doubting your observations, just trying to figure out the reason.

Steve, Thank for your fast reply Your answers make me feel a lot better. My port is small, but once our Florida weather straightens out and I can stand to be outside for more than 15 minutes at a time, it will be expanding rapidly. And with the ability to opt back out if Photo.com doesn't work out, I'm looking forward to doing business with StockXpert On the copyright issue, I guess I had it wrong -- I thought I had read somewhere that images downloaded from Photos.com were to be credited to Jupiter Images only. Not that I'm all that vain, but I do like to see my name in print now and then. Thanks again, Astrocady (another Steve, BTW)

I still have two questions....
#1 is on the opt out deadline of August 15. Does this mean that after this date the opt out option will be completely gone? We only have 2 weeks to see how Photos.com works? If we opt out now, can we opt back in at a date later than August 15th?
#2 -- What about the copyright issue on photo.com? Is Jupiter still going to strip our ownership of our pictures sold on photo.com?
