Welcome to the club (pensioners). Sounds all right.
Bruges is my favorite city in Belgium. I mainly know the other cities because I drive on to France, Spain.
We want to go to Ghent or Antwerp for a few more days. Just wait and see.

If you go to Ghent, spend the night there, because Ghent is FABULOUS at night - they even won a Unesco prize with their evening lighting of the historical buildings ...  (but don't forget to bring your tripod!)

I officially retired on 1st Sept. 2021, which means the Belgian government will be paying me a pension every month.  So I will do fewer client photo sessions and the spare time will be used to :
1) do stock shoots again, but only the fun ones
2) do super fun projects, like rent a castle for a day and shoot historical costumes (if I can afford it)
3) sell the props and stuff that's piling up in my studio, but only after "milking the cow" (= photographing it for stock)
4) go back to my portfolio and create templates and overlays to sell to other photographers
5) if travelling is still not safe :  do more day-trips in Flanders to get the vacation-feeling
6) spend more time in the garden on sunny days!

Looks like I'm going to be busier than before my retirement!

Take a look if you have a moment and check out the winter call for content, creative briefs, curator collections and more.
Mat Hayward

At his moment I'm not very inclined to create more winter content, as there is a big lag between the uploading/submitting moment and the moment that the files can actually be found in the search.  My latest Christmas upload was approved on 15th November and only appeared in the search yesterday = 9 days ?!    What's the cause of such a lag ?

Here is another example I dealt with today, after the seller received a takedown notice from Etsy, following my DMCA report:
15 minutes after I sent him the link, I was able to see his Extended license purchase from AS.

Did you send the DMCA report to Etsy or directly to the Seller ?

In principle, I have a problem with those who expect others (read government) to take care of their business, instead of taking similar actions. Maybe if all of us should flood Etsy with DMCAs, before we ask for the government intervention.
In my opinion, governments should hunt down these thieves directly, instead of delegating their responsibilities to commercial companies.

You make a point, but I think the new law FORCES those companies to do something.  At this moment, if Etsy does NOT react when we report a theft, there's little we can do.  If Etsy did the right thing with your DMCA's, it's because they WANTED to, not because the are legally OBLIGED to.
I won't go so far as to expect Etsy to pay for the damages, but I would welcome a law that enforces them to react.

General Stock Discussion / Etsy petition - NOT signing this!
« on: November 15, 2021, 11:50 »
I am a small seller on Etsy (selling my own digital backgrounds for baby photographers) ...  I just got the e-mail message below from Etsy, urging me to sign their petition against the new EU rules ...
I am sooooo NOT signing this petition!

Defend the rights of European small business owners

You may be aware that the European Commission has proposed legislation called the Digital Services Act (DSA).
The DSA includes new rules for how digital platforms like Etsy operate. As part of our ongoing commitment to running a safe and fair marketplace, weve been working with EU policymakers as the DSA is being drafted and negotiated.

Unfortunately, some members of the European Parliament have recently proposed additional rules for the DSA that threaten to harm our marketplace and sellers businesses. Some of these new rules would result in:

A slower, more bureaucratic process for creating a new shop or updating your account information. Marketplaces would have to verify that all information provided by the seller is correct before allowing them to sell, and also verify any future changes.
Your listings are more likely to be blocked or removed. Because the new rules would hold marketplaces strictly liable for items sold on their platforms, theres a greater chance that legitimate listings might be removed. This would also divert marketplace resources away from where theyre actually neededfighting bad actors trying to harm consumers.
Less choice for sellers and consumers would also result from the proposed rules, as many sellers are likely to be discouraged from the increased complexity of selling online. For example, marketplaces like Etsy would have to check every listing for full compliance with labelling and certification requirements before the listing could even be posted.

Etsy's CEO, Josh Silverman, has been speaking up against these unnecessary and misguided rules with EU policymakers because he knows they would harm the creative business of every seller who wishes to sell online in Europe. But the reality is lawmakers wont protect small business owners unless they hear from youtheir constituentsdirectly.

Will you join us in urging EU policymakers to stop adding these harmful burdens on small businesses like yours?
Sign the petition

As I "officially" retired on 1st September, I plan to start selling my studio props.  But before selling, I will photograph each item, isolated and not isolated, for stock.  Which means I'll be "milking the cows" before I sell them haha

Canva / Re: Canva, what's the plan now?
« on: April 13, 2021, 03:17 »
Is it just me, or does Canva pay out the PREVIOUS month ?
In February I thought they had made a mistake by paying out January (too much), then in March I thought they were compensating for their mistake (not enough), but now in April, I'm getting the impression that they are paying me February ...  And when I recalculate all payments, it looks like the have been paying the previous month in Jan/Feb/March ...
Any one else is seeing the same trend?

Thanks Joann. I was thinking an extended license would cover it. A person in the fine art group said she checked with 123rf, who said NO license covered it, which I dont think is right, but I wanted to check with Adobe, too, since I still sell there.

May be 123rf was talking about re-selling as stock ?  I don't think any EL covers derivative art being sold as stock (because you would need copyright for that), while it does cover selling it in print ?

General Stock Discussion / Re: Sensitive use complaint
« on: March 09, 2021, 13:04 »
if the photo is used in context of abuse or other 'negative' uses it's likely a violation of license conditions, so you might forward the letters to the agency that sold it -  or the publication
The images have been used with negative context, but there have not been any letters yet, she just talked to me about it and asked to remove them "everywhere" (which is not possible obviously).  She had forgotten all about the MR she signed, so I did a lot of explaining.  If she comes back to me, I'll tell her I deleted the photos, and hopefully that will be enough.

What everyone else said. Do the best you can removing images where you can. You did nothing wrong and she signed a release. The rest is out of your hands.

Thanks.  The problem is, she didn't do anything wrong either, it's just her family that is nagging her about it.  So if I can help her by deleting 4 images, no problem.

Let me try to keep this short :
This is one of the images :
https://www.dreamstime.com/stock-photo-tears-woman-image22279140

The image has been removed.
Oops, yes, the link is not working anymore now that I removed the images, sorry.  It is just a closeup photo of an African woman crying. The photo itself has no reference to the reason why she would be crying (daily life clothing, no bruises or anything), so the only way to make the use "sensitive" is by adding text.

Do not offer her money! You may not use lawyers but they could and they could use that as an admission of having done something wrong or of liability in some way.

I am not a lawyer but personally I think I would delete the photo just to avoid the hassle. There's nothing you can do about the licenses already sold but buyers wont usually reuse photos for new campaigns so they should rapidly see less of it. Most news organisation or magazines etc. will have a subscription to a stock site and its easier to search up something appropriate than digging through old photos on file.

That makes sense, I can tell her that.  And the more I think of it, deleting the images is the least I can do as a gesture of goodwill.
And no, I will absolutely NOT offer her money.

Let me try to keep this short :
10 years ago, a 19y old woman posed in my studio, signed a MR and got all prints and digitals.
2 images were (not nude) closeups of her with tears on her cheeks.
Today, her family is mad at her because those crying photos are found in articles about abuse or other sad situations.
She wants the photos removed, but obviously, this is out of my hands.  I can remove them from Shutterstock, but not the photos in use.
Now before you all start telling me to get a lawyer :  THIS IS BELGIUM.  We do NOT go to court, we do not sue eachother, so I don't expect letters from her lawyers.
My question is :  what could I do to make her (or her family) happy?   I don't want to give her money, because I'm sure she'll keep knocking on my door for the next 10 years.  I COULD delete the images on SS etc., but that would not stop the publications that are already out there.
What else?
This is one of the images :

@Anyka:
Are you aware of that you ensure at ss this image can be used for sensitive use ?

Yes, I am aware, thanks.

Well, I ended the story by blocking him, but only after he continued his "attack" and even talked about "going public" with a news article.  That did not impress me very much ... a newsarticle about a small Belgian photographer in a North Carolina newspaper on page 13 ?  Don't think my local clients will read that haha.
Anyway, I blocked him, but out of curiosity, I checked the images in Catalog Manager.  I never knew it was SO easy to change keywords or descriptions!!??  Changing "afro hair" into "braided hair" in the descriptions took me less than 3 minutes!

95
This brouhaha makes me glad I mostly shoot critters.

Not a single wild burro I've ever photographed has come back to complain that I didn't call him/her a wild donkey.   :D

Haha, this one made my day!

96
I think more problematic here is really that you tagged the picture with wrong keywords as there is no afro hair to be seen there. However, if you used the keywords "afro american woman" and "braided hair", at least on Shutterstock, the search for "afro hair" would have lead to the same results, so it doesn't really seem to matter?

Great, that's what I should have replied to him!

97
Glad to hear I did not use officially offending words!  The model is from the UK, not American, so I wasn't sure if there were cultural differences on this topic.  If he writes again, I'll tell him there's a difference between an incorrect and a racist word, and if he's searching for incorrect keywords at Shutterstock, he'll find billions of them ...

98
Why are you even worried about this?

Well, I prefer discussing this with him through FB messaging and keep the discussion away from my studio clients.  If he keeps on being angry after my friendly reply, I will block him, but my first try is a nice and peaceful one.

Thanks for your suggestion about the corn rows - I looked them up, but that's not quite what my model's hair looks like.
Here's one of the shots of this series :

Would you call that afro hairstyle ?

Shutterstock.com / Attacked because of a keyword - what can he do?
« on: February 17, 2021, 04:46 »
I woke up this morning with a facebook message about a Shutterstock batch of mine.  The series is of a black woman with african braided hair, which I call "afro hair" in the description of the images (because the model called it that way).  She is doing her hair looking into a mirror, so I cannot just ignore her hair in the description.
These images had reasonably good sales for 3 years already, and now I get this message on facebook :

  • Please change your labeling of your photography on shutter stock as it is it is not even kinda racist.  You referring to a woman of color as having a afro hairstyle is completely disgusting. I spend hours looking for photos. and can't find them because of your complete race base labeling. I am attempting to convey the problem without anger.but there is not excuse. your whole photo shoot has not one afro. and to refer any women of color as default having an afro is completely racist. there is no way its a mislabel because afros are a thing specifically. thats the equivalent of me calling you from Belgium an asian.  for your benefit please update this soon it will support your pocket and creative directors looking through hours of shittly named photos.  I will check in on your progress in a few days before reaching out to shutterstock direct.

The message is from a person in North Carolina, and he obviously knows I'm not American.
I'm not asking how to reply - I already replied that I don't understand his point, because to me, to the model and to my Ghanese friends, this hairdo is called an afro hairstyle.
My reply was very friendly and polite, as I don't want somebody to get nasty on my FB business page or anywhere else.

But I do have 2 questions :

To the American Microstockers :  is calling this an "afro hairstyle" offending??  Here in Belgium, even between black people, it is not, but maybe in American culture it is ???
To all :  if he contacts Shutterstock about it, what do you expect their reaction would be?  Do nothing?  Delete the images?  Tell me to change the wording?  ??
