Yep, Tattoos are artwork, in general you need a property release unless its a fake tattoo you made yourself.  There is a lot of back and forth on the whole subject as far as I've seen.  Does the model own the work because it is commissioned?  Or is it the tattoo artist?  But most tattoos are done based on predrawn art called flash.  Is the artist who created the flash the owner, and everything else is a derivative work that has been licensed out? Its all up in the air, so I think for the RF stock thing, IS plays cautious.

December is typically slower than the Autumn months due to the holidays, etc, so last months earnings are typically lower across the board.

Got an email from Shutterstock saying they had settled a claim against one of their subscribers, and the subscriber that had breached the normal license agreed to pay for extended licenses for all the images they had downloaded and used in higher circulation than allowed without the extended license

You guys are making the assumption that there is individual contributor level control in the search results, which is highly unlikely as it would probably require a pretty big load on the servers to do that kind of adjustment specific to each contributor.  The biggest issue I see might be Fotolia, who might drop you right away.

In Lisa's case, I'd like to point out that the document states that iStock is under no obligation to grandfather the canister if you can't get free until after August 1st.  That doesn't mean they still won't do it.  Might be worthwhile to see if they can be flexible for that date for your specific circumstances Lisa.

I think everyone else is worrying too much over what the other companies might do.  I just can't convince myself they have the will or ability for retribution via search placement.  Contractual agreements might also prevent them from cutting off the relationship earlier than the date you specified, let alone the bad word of mouth they might get among potential new contributors.

I would email iStock and verify rather than relying on third party info.  I sent an email earlier today to verify my situation, but from what I can tell I will be able to go exclusive on Feb 5th and still lock in the canister.  If iStock is requiring everyone to remove everything now, then wait six months, then that is unfortunate.

The email I posted came from IS, it is not third party info. Check the other thread again, I have added the copy from the pdf that comes attached with the email and it explains it all in more detail.

One may not have to remove all photos right now to comply, but one must give all other sites notice now (before Jan. 11) and give IS proof that one has done so (before Jan. 11).

I can see many advantages to being exclusive and for me, it is not off the table. Just don't want to be forced to make the commitment before Jan. 11. Too many changes have been made in the last month and I would like to see the outcome of those changes.

Ah ok, I had missed that thread.  Going to take a look now.

This is not what I got from the letter Cathy posted in her thread.  Looks like the only way of independents getting their next canister levels is to withdraw from all agencies now and lose all that income while  waiting out the Dreamstime commitment.  Fine maybe if this is your hobby, but I certainly can't afford to lose 60% of my income for the better part of the year.


You are right of course, and I was in the unique position of being able to remove all of my Dreamstime images by Feb 4th, since a busy summer put 70% of my images uploaded before August 4th (I used the 30% I was allowed to remove to take down all my most recent photos first).  I would email iStock and verify rather than relying on third party info.  I sent an email earlier today to verify my situation, but from what I can tell I will be able to go exclusive on Feb 5th and still lock in the canister.  If iStock is requiring everyone to remove everything now, then wait six months, then that is unfortunate.

iStock is coming in at just a hair under 45% of my microstock volume at the moment.  Because of the changes in credit prices and best match favoring exclusives, it makes sense to become exclusive with iStock.  Yes, it is all eggs in one basket, but a very lucrative basket.  If iStock were to fail or severely drop off, then I can always go back to spreading things around among the sites.  iStock is letting independents lock in their next canister levels as well, which means I will be able to obtain a diamond canister in the near future rather than the far.  That extra 5% will be nice, and I can only lock that in if I go exclusive as soon as possible.  I have more to gain monetarily (possibly significantly) by going exclusive, and stand to potentially lose much of my income from iStock if their best match pushes the independents further down the rankings.   So I'm putting my eggs in the basket that is most important to me financially in the microstock world.

Instead of RPI, I'm just going to drop my microstock totals in.  I had about 1800 images in my various portfolios.  To me, the returns of the overall portfolios are more telling than RPI or other averaged statistics, as most of my images are accepted across all the sites.

I think in his case the big deal is the higher upload limit.  25/week can be stifling if you are producing twice that.

It was a long time ago and before BM2.0, so I don't know if anything I can say would apply.  Shutterstock will get a huge bump when all your files are first uploaded.  Other than that, it really depends on how long it takes you to get images on the other sites.  It should be fairly easy to get your images on Shutterstock, Dreamstime has an upload limit that is tied to your overall historic approved images percentage.  I don't think Fotolia has any kinds of upload limits.  You should probably also be aware that DT won't accept some of the iStock releases.  So if you have a ton of people photos, that may be a bit limiting for you.

Sorry, I'm not understanding, you said you will be within 500 by February, and iStock has said that if you email them before Jan. 11th about going exclusive, they will likely be able to negotiate a later date to lock in your Diamond pay increase if you are unable to get free of the other sites before the February date.

So, did you ask them to work with you on exclusivity to lock in your diamond?  Was that what you received a canned response for?

I haven't re-exclusified yet, but I am planning to do so as soon as I can.  I primarily used the big 6, but Shuterstock and iStock have always been my best moneymakers.  I've been independent for several years now, but the changes for next year at iStock look like it will be financially advisable to go exclusive again since a large chunk of my income comes from iStock and Stockxpert is basically going away.  123rf and Fotolia have never done well for me, plus Fotolia is cutting commissions and I seem to mostly get subscription downloads there.  It just all points to exclusivity being my best option for increasing my income this next year.

Shouldn't a software program like these be able to scan my portfolio with just my user name? I don't like putting my password in things I don't know much about.

Yes it should, all tineye needs is the URL of the image, and that is easy to get from the open portfolio.

I went ahead and removed my StockXpert portfolio. 

I've never understood why contributors remove portfolios from micro sites, unless going exclusive on another, or as a sign of protest against new policies.


It doesn't really hurt me financially to do so, about the only thing that has sold there for a good long while is subscriptions through the partner programs, which essentially no longer exist.  So no loss really.  I know I can remove them now, who knows what the case may be in January.

This would matter to me if I ever sold anything on Fotolia other than xs and sub.  I will probably be removing my port now, I was borderline before, and I am not impressed.

I went ahead and removed my StockXpert portfolio.  It was doing decently well before the whole subscription thing, then it tanked until I added subscriptions, now its lost both subscription services, and I'm suspecting they lost their audience with it.  I don't think the buyers have much incentive to come back to StockXpert when they've obviously been doing a lot of buying through the other sites, especially since many of the images are going to be on those same sites through iStock.

I'm not sure I will be upgrading for a few years even if something good does come out.  The 5DII pretty much covers all my needs.  I don't really need more than 20+ MP, and once they release the firmware update that allows 24P video, it will do everything I've ever wanted my cameras to do.   I think I'll probably focus on getting some of the higher end lenses the next couple of years.

A few reasons I can think of to stay independent.

- Only being able to sell RF via Getty owned sites.  There are lots of buyers out there, some willing to pay higher than microstock prices, I don't want to cut myself off from them.

How often do you actually get sales through them though?  The Vetta collection is essentially midstock, they are adding higher tiered sections for exclusives if you feel you must have more money for that photo.  They are raising the prices for exclusive photos, so you get higher sales prices that way too.  There is always the Rights Manage route, too.

Did you mean working with, rather than working for?
The FTP uploads and model release libraries at other sites make it a lot easier to get your ports back up if you decide you can't handle exclusivity.  I've been through the exclusive / re-independent cycle before, it wasn't as bad as you seem to think.

The upload limits are much higher for exclusives, aren't they?  So independents can't get their images on iStock as fast as exclusives.  That doesn't mean the exclusives aren't churning out their own content that never goes to any of the other sites.  Its arguable who has the advantage in that, but considering iStock is still dominating the market even with all the competitors, I'd say there has to be some kind of inherent value to their exclusive collection.

So, I've decided to start prepping for a potential switchover to exclusivity as well, just in case.   I realized that my very productive June and July meant that I was able to disable almost everything I've uploaded since the start of August on Dreamstime.  I have now done so, and I went ahead and removed all options from Shutterstock with the exception of the Shutterstock site itself.  I already closed my miniscule Crestock account a few days ago.

So the earliest I could switch over is Feb 10th since it takes 60 days to clear Shutterstock's partner sites, right?

123RoyaltyFree, StockXpert, and Fotolia should all be instant removal, right?  I saw someone mentioning some kind of partner site of Fotolia, was that something that you had to opt into?  I don't recall ever doing anything like that.

I'm kind of in agreement with Lisa, I don't like the eggs in one basket approach, but clearing the same revenue without the hassle of dealing with multiple sites does have its appeal.

I'm getting mostly Jupiter sales, but starting to see a handful more StockXpert direct sales since photos.com went away.  I'm also getting files reviewed fairly quickly and not seeing a lot of outright rejections.  I think I've actually been requesting payout more often than in the past, but I never let it go much over the minimum before I request now.  Its doing far better than 123rf for me, thats for sure.
