That is just for disputes between businesses and consumers, however. If they really don't pay (and the amount isn't completely ridiculous), you could just have a German attorney send a letter. It wouldn't cost much and (if you can actually get them to pay up) may even legally have to be paid by them.

Let me know if anyone ever has issues with someone in Germany (infringer, agency etc.). I can probably point you in the right direction.

Thank you for your help. Is there something like the Better Business Bureau in Germany? In the US it is easy to file a complaint with them.

There is something called the "Verbaucherzentralen" (Consumer rights associations), but that's difficult, too, as such institutions are also geared towards consumers and not towards people who are trying to make money (like us).

If somebody owes you money here, you usually send a demand letter (can be an email) that clearly states that you are due payment. Then, if the other side doesn't pay up, you have to go to an attorney. Since we are all friends here, I would gladly do it for you -- but I also have an account with them, so I fear I'm not eligible. Other lawyers wont be free, but depending on how much you are owed it shouldn't be expensive either. Read: it's not worth it for 100 Euros, it may be worth it for 1000 Euros.

The 24-70 f/4L IS USM is a much better lens optically. I can tell, I've owned both. However, for your APS-C body, the 24-105 will do just fine. I only started noting shortcomings when I switched to FF. (It's still a decent lens on FF, mind you!)

Two additional pieces of advice:

  • If you catch a good deal the 24-70 isn't much more expensive than the 24-105.
  • For the 24-105 I would watch for "as new" used sales, as many people get it in a kit with an FF body and immediately flip it.

No matter where they say they're from, whoever made their listings is German. "Handy" is a German word, "Kanada" is German, and there is a full German sentence at the end of the listings.

@ MarcvsTvllivs We are indeed limited geographically and due to the particularities of IP law in a number of countries can currently pursue infringement cases in the US, UK, Canada, Australia, the Netherlands, Germany, France, Belgium, Luxembourg, and Denmark. We are constantly expanding, though.

As for the Fortune 500 company point, we do pursue smaller cases. The decisive factor here is the intention of the use -- as a rule, we go after the commercial uses of the photos.

Not trying to criticize you, specifically. The issue I described is certainly true for your competitors, as well. I agree that it is inherent in the business model, but I hope you will find a way to expand your reach a bit. I see no harm in at least making an attempt to recover a little (read, $50) even from minor infringements (even bloggers) in less-than-perfect jurisdictions, for example by sending a demand letter or the like.

I've played around with it a bit. It works very well and finds a lot of stuff that I didn't know about before. It indeed does not do much for RF, of course, but that's just in the nature of such things.

Greatest issue right now is that they seem to only go after abuses that are in one of very few countries, that are crystal clear abuses that will net lots of money, and that are by a Fortune 500 company. In other words, they will only act upon things that I could just as well act upon myself and get 100%.

Still useful for finding image uses though.

@Pixsy: skyfish is asking whether you require the upload of full-sized images or whether you can work with thumbnails. He/she does not want to risk giving you full sized images.

@skyfish: I can answer that: they do work with thumbnails. In fact, they limit the upload size a lot.

We get 30% of the sales price for cart sales.

The "list" (i.e., regular) cart price of a Low-res clip is $19 (or at least it was, the last time I looked). 30% of $19 is $5.70, so that's the most we ever get for a Low-res cart sale. Some buyers pay less, so sometimes we get less. I think $3 is the lowest I've had.

Right, so a "cart sale" is basically a one-off purhcase? Like an ODD for photos? Sorry for not knowing this stuff, I have very few videos and mostly photos.

That is weird. I guess that means they are not interested in attracting dedicated photographers as their contributors. Otherwise I do not see how one can add sizeable portfolio without necessity of manually keywording every single image.

Oh, and I don't know your images, so I don't know if that's the case here but when I read posts like this on MSG it just comes to my mind: I would assert that none of the new platforms is all that interested in photographers who have tens of thousands of pre-keyworded images that are already available on Shutterstock & Co. So for them it isn't really all that interesting to invest time in making that process easier.

I absolutely agree. This is actually something that heralded the decline of 500px: They were about a certain, polished style of artsy photography, and they got traction, and then they invited... us. Not a good idea, if you ask me. If you've found your niche, don't immediately try to break out of it.

I still find the EyeEm implementation of IPTC unfortunate though. The keywords it suggests are actually highly "stocky", with stuff like "built structure" etc. In my opinion, those keywords work for neither stock buyers nor a cool photo community.

Weirdly enough they do appear to read IPTC, as it seems to heavily influence the keyword suggestions they are giving. They don't outright import IPTC though, making the result pretty much the same as if they had no IPTC implementation at all.

30% royalties is a pain in the ass, but after all a good income.

Macrostock is awesome, you can get big sales, but i'm a bit afraid of a refund.
Crossing fingers for getting no refund...

With the other sales, video and stills, February gets me about $2000 with Getty.
I know Getty has not the best reputation, i agree, but Getty is sometimes able to put a smile in your face! ;)

i used to upload to eyeem and i had 5 sales.but unfo many photos that  they choose for the market they go through gettys market and that means they want exclusivity.so if you upload a sellable picture to eyemm it will be licenced through getty and you ll have to remove it from the other sites.
its a nice platform but with gettys exclusivity its a problem

This is wrong on two counts:

1. You can sell through EyeEm without accepting Getty distribution (on a per-image basis).

2. The EyeEm Getty distribution deal is no longer exclusive, which is not reflected on their website yet.

we'd all better start looking into that: and fight the EU for these tyrannical attempts on our freedoms! It's true that these incompetents "forgot" to apply that usual threshold for the "destroying e-commerce" ruling (it actually appears to be accidental). Effective Jan 2016, this has now been extended to ALL intra-community sales -- hence a "destroying small business altogether" directive, thank you very much.

The EEC (now EU) has been sold to us on promises of "free trade", facilitating Europe-wide movements of goods etc, and making cross-border transactions easier -- quite the reverse is the reality. From Jan 2016 (2015 for "e-commerce"), only sales within Ean U member country are free from these overly onerous extra reporting requirements photographers and other small businesses simply cannot handle. Some Free Trade this is...

Not only is subjecting small businesses to VAT without the usual threshold unfair, but making them slaves to 28 FOREIGN tax departments is forced labour -- and close to torture. (Both are gross violations of Human Rights.)

This is, once again, one of these Eurocrat wet-dreams thought up behind closed doors and not fit for real-life business -- very much like last years shocker with abolishing "freedom of panorama" (which they had to take back, once they realised what a bunch of ignorant w*nkers they are up in Brussels)! What a great job the are doing there (for EUR 12,500 monthly and up each, all funded by our tax -- including VAT -- money).

As for "getting out of there": this doesn't only apply to getting out of *Envato* but getting out of that EUSSR thing on top, also as fast as possible.

Truth is, Envato's cobbled-together "market" scheme does not currently work for European contributors who are liable to charge VAT. There was plenty of discussion on that here when they first implemented it. Like every other responsible EU contributor, I got out of there as fast as possible.

i travelled all over the world, only carrying as little as i can, with as little money i can in a neck strap envelope containing very little money. i dress very simply, probably less than a mugger.
wherever i go, i hear doors slamming as i approach in the early mornings past midnight.
nothing ever happened to me.

one day last year, back home, i was out taking shots for a client. in what i consider my home turf.
very safe. i ended up being confronted by a guy and i was civil to him. i turned around to walk away and he turned me around and smashed me in the head against the concrete before someone
up in a building called the cops.
the cops came and instead of arresting the guy, laughed because he was a friend of the crooked cops. i ended up with 7 stitches and concussion and bruises all over that kept  me in hospital for a week. the ambulance people told me they had known of this guy and never was he ever arrested.

really, there isn't anything to keep you safe. unless you carry a gun. if they want to hurt you,
they will. it has nothing to do with robbing you.
and yes, i know capoeira and it still didn't help.  if i had won , it would only be in time before that brute come finding me again.
needless to say, i moved out of that city. also, i no longer consider any place safe.

in another incident, a friend of mine was attacked by a bunch of guys. he grabbed the knife off one of his attacker. because he was black, he was threatened by the cops for carrying a knife; never mind being the single person being attacked by a group welding knives.

in other words, don't play hero. usually, the innocent guy ends up being charged with A&B, especially if you're the pigeon.

Yikes! Where do you live? Chicago? Seriously though, that sounds like some terribly broken police.
