Can a Zazzle seller purchase my stock image with a regular RF license, slap a second image onto mine and sell it as theirs?

Example: The seller "purchases" a photo of a sunset at the beach and adds a couple seagulls from another source.

Is this use covered in the standard RF license? It's not just my image straight out of the box - just some other elements have been added.

I think we've been discussing this already a bunch of times but I'm just ticked off now because I keep finding my best seller in other seller's shops...

Happy Friday night everyone!

I used to order large prints (not the max but the second largest size) and was quite happy with the quality. 72ppi was fine by me.

In the meantime I ordered mousepads, business cards, shirts and mugs and I'm not happy with the quality.

It's not so much the overall quality but the variation of quality.

For example I ordered a mug for last christmas which looked really nice. I used the guide files (Zazzle's product templates) to ensure I provide the best source file possible. The image uploaded was tack sharp (they don't require very high res files for most products).

However, I recently ordered a mug and the print was pretty bad compared to the last mug I ordered. Really muddy print and the sharpness varied across the print area.

It wasn't for a specific event or anything so no big deal but I have complained on previous products so many times that I feel awkward to keep on asking for refunds/credits...

They always gave my a credit and it was always very smooth but I'm afraid to get flagged for constant complaining. I understand that these are not super high quality products but if the quality varies so much, something's off.

Did anyone experience similar issues?

Off Topic / TAXES 2011 - Is anyone writing off agency fees?
« on: March 23, 2012, 09:50 »
Out of curiosity, does anyone of you write off the agencies' commissions as your business expense?

Don't we technically pay them to market and license our images?

Cameras / Lenses / Thinking about buying the 5D MarkII
« on: March 18, 2012, 15:32 »
This would be my transition from Nikon to Canon.

I'm doing more footage/time lapse than stills so Canon I would think, offers the better package.

I know that the 5D MarkIII will have major improvements in terms of video but the body is just too pricey for me.

I was wondering if I could get some more feedback on the video capabilities of the MarkII here on a stock related forum.

What are the significant shortcomings of the MarkII which could make me want to reconsider buying it? Did firmware upgrades significantly boost the performance?

Have any manufacturer issues been rectified over time like focusing screen is coming loose?

I've read in the comments on Amazon that Canon support (supposedly) is terrible. I can't believe that but did anyone here have problem with Canon support (regarding warranty claims)?

Thanks in advance for your comments.

If I also want to participate at Graphicriver (having a Photodune account already...), do I still have to create a new account there?

I tried my Photodune ID and it obviously doesn't work but in the help section at Graphicriver it states in the help section that

Signing up to an account on GraphicRiver will let you access the whole network.

Is there a setting somewhere that I need to activate?

Thanks in advance.

http://thelonggoodbye.wordpress.com/

Check it out. It may be hard to find any of yours, I just came across it by accident through Google's image search and I saw other microstock images uploaded at 1600+ dimensions.

I informed other copyright holders.

Maybe someone finds this worth looking at.

http://www.zazzle.com/vetta_images

I had no idea that Vetta content is being sold via Zazzle. Is that the "infamous" PRINT option at IS?

I stunned.

Kindly provide a list of agencies whose ELs allow resale of the photos/designs at Zazzle etc under different copyright?

I know that ELs grant the right to resell but what about the copyright note?

If products with my pictures are sold at Zazzle under a different copyright note is that allowed?

... if you are logged in (to Google's services such as Gmail, Analytics etc.), search results will favor your images?

I just randomly looked for images that coincidentally contained keywords that I used for photos that I sell on microstock. I was wondering, WOW my images show up on the first page of millions and millions of images in the Google search. That's pretty neat.

Not so cool when I logged myself out of Google and did the same search again...

My images were gone. Totally different results.

Maybe this is old news to some but I just wanted to let you know. Please disregard if this is "common" Google knowledge...  8)

This is very annoying.

Download numbers are indicating a positive trend but if review times won't improve to an acceptable level (4 to 5 days max) they have to face the music eventually when buyers get their fresh stuff somewhere else.

By now I'm sure, buyers understand that the same non-exclusive content is available at many agencies and that some agencies grow a lot faster than 123RF. This is not very promising for the future unless there are plans let this ship sink?

I don't know if anyone agrees but since iStock set the bar really high in terms of screwing contributors it appears that other agencies are following in their footsteps to push funky business practices assuming we'll just put up with it.

While many of us will put up with it - that's not a secret - doesn't mean though that your business is invulnerable. If buyers leave, that's not the contributors' fault.

Communication has also always been key and only if people start getting very upset and voice their opinions, then most agencies re-act by trying to calm the folks down but it could be all a lot easier if certain agencies would practice a more proactive communication from their end in order to keep everyone in the loop.

Alamy.com / Funky license reporting... Did it happen to you?
« on: February 22, 2012, 14:39 »
This happened to me a few times now that I get a sale of an RM image (exclusive to Alamy) with the usage type for print.

However I happen to find the image on 5 websites posted online around the date the image was licensed for print.

I contacted Member Services and they assured me that everything is in order and that the buyer often allows syndicated networks to pull their "original" images.

Supposedly the partner agencies don't precisely report the exact use to Alamy. Apparently the pricing is correct but the usage type might not be applicable.

Has anyone else noticed thing like this?

Stupid stuff:
I'm Emerald and every now and then I stumble over files that got moved down to 1 credit pricing due to low sales (one image having over 70 sales...).

I can't keep track of which files got "demoted" and how many sales they each have achieved ever since then before I can move them back up again.

Has anyone figured out a way or are there statistics for that?

Shutterstock.com / SS review time over 4 days?
« on: February 10, 2012, 13:03 »
What's going on there? I've been waiting for a review of my latest batch for 4 days now.

I cannot even remember the times when SS took that long for reviews.

Anyone experience the same?

Print on Demand Forum / RedBubble and copyright...
« on: January 18, 2012, 12:40 »
I see lots of huge brands and logos all over the designs at RedBubble.

The creators appear to be individual designers and not the respective brand owners.

I searched their forums about copyright infringement and the like but it appears that no one is addressing this issue beside having their "own" design be infringed upon.

I'm confused. Can someone shed some light into their copyright policy?

And how is it possible that individual designers there can upload parts of logos and designs of major brands?

This year the 1099s for SS and BS are available for download now.

Very convenient and quick.

Hopefully we don't get another 3 updated versions in the upcoming weeks... LOL

Off Topic / Subscription Food
« on: January 05, 2012, 19:06 »
I just saw on Amazon that you can buy food (probably other things as well) on a subscription plan and save extra $$$.

I'm amazed to see how this whole subscription thing is taking over the planet.

This whole royalty thing with IS is something I really didn't pay too much attention as it was never a question to me to drop IS.

However, in my stats it shows that I'm 14 credits away from the next level. Is the cut off date 31st of Dec.?

94
I went into a little gallery and saw some photographs/illustrations printed on large sheets of aluminum (80" by 120").

The details of the prints blew my mind (300dpi). I googled and found a few companies that offer that printing service, charging roughly 25 to 75 cents a square inch. Therefore that image cost about $4,800 give or take. Selling price was $6,500.

I wonder though if any member on this forum ever created such a print from their own photographs? I'd love to hear some feedback as I'm already starting to save up on getting one printed (much smaller though - lol).

According to the companies that manufacture these things, they claim that their prints are far superior than anything else available.

iStockPhoto.com / Stockxpert payment pending for 18 days...
« on: October 17, 2011, 09:14 »
I'm not following the IS forums to dig out any news but I was wondering what's happening to the Stockxpert payouts.

I requested payment on Sept. 30th but it is still pending.

Anyone knows something?

Print on Demand Forum / Cafepress vs. Zazzle - any new numbers?
« on: October 15, 2011, 14:03 »
Have a few thousand products on Zazzle and the sales are rolling in without any advertising etc.

I was wondering how Cafepress compares to Zazzle with the same portfolio. Does anyone have up to date numbers how sales at Cafepress compare to Zazzle?

Adobe Stock / Still subscription sales for footage at Fotolia?
« on: August 24, 2011, 09:20 »
I thought this whole subscription business with footage has come to an end after they introduced the new pricing/commission changes?

Got a 3.3 credit footage sale just now and a friend of mine a 1.25 credit HD1080 sale  :o

Another hit in the stomach (I think) from the US Copyright Office today via email.

I tried to register my latest batch 2 months ago and received a response from their office via email regarding an issue with my filing.

I filed all my images as published work. Here comes the kicker:
Quote
... You also mentioned in your reply that some of the material was published before 6/XX/2011. Please be aware that this registration covers only the material that was published on 6/XX/2011. Please note, you may only register a single "unit of publication" per application.

Only works that were initially published together as a unit, and on the same date may be filed under one registration.  Works that were published separately (even on the same date) or on different dates must each be filed on separate applications. ...

All the "professional" blogs and articles online advise photographers to register their images in regular intervals e.g. every 3 months.

But according to this response each filing/registration can only cover "one unit of publication". Since photographers are publishing their images on a daily basis (stock, editorial, event etc. shooters) they all would have to file registration every single day?

Do I get this right? I mentioned before that English isn't my native tongue but this sure sounds off.

Does any of you who register copyright ONLY register unpublished works because of this?

Or do you just register a few times a year to "cover" all images (which supposedly isn't allowed)?

Just received an email about contract changes. I looked into it and see new clauses in the contract regarding video submissions.

RM video, yummy...
