Could you please give me the link of your original images and then the link of the same in the thief's flickr account?
I  want to write a report to the yahoo copyright police as well, just to lend a hand.

Maybe it's just a matter of time but they will get back to you, I'm pretty sure.

I know Flickr very well, been registered with them since 4 years, and I can testify that they really do not check what people upload because the community is too huge to execute a quality or copyright control on every member... as deviantart or other photosharing network, included stock agencies I'd say.

Anyway I dealt with them regarding some copyright (CR) infringement and I have to say that they are very open and understanding in blocking people and closing accounts of those who are committing a CR crime.

At the bottom of the Flickr site, in every page, you can find a link "Copyright/IP Policy" where you can report your problem. Be sure they will act the soonest they can, since they're very sensitive in that field.

Ok, the guy can start another account and do it all over again but if his/her IP is blacklisted he won't be able to do that again on Flickr at least.

if I do that with Dreamstime they will reject the same image because I've included a model release.  Kind of weird...

I had a rejection on dreamstime because I uploaded a MR ifor an image that showed just a part of a body: that made me freak out a bit.

That still really doesn't make alot of sense. A person could attach any model release they have and attach it since the person is not recognizable.

Ditto: categories are a waste of time.
If I were a buyer I would only type the keywords of the images I'm looking for, without wasting my time searching in silly categories.

Quite a shame - sales migrating from a site where we make .50 - $3 to subscriptions where we get .25 - .38 per sale.  

Seems to be the direction the industry is going in....

Not sure whether it all is going to do any good. I don't see that he is reselling the image. He is only offering it for download to other people. I'm going to do some more investigating.

to be honest the image is within the limits for being posted after purchasing the license, no more than 600x800 pixels... hmmm but I still think that the download option makes him infringing the license terms.

The problem is that, when you contact the infractor or the site, he simply removes the image.  It's like if I steal you car, use it, then one day you catch me with it and I return the keys and leave.

which is why i think every contributor who discovers theft of your image, makes a big deal of it...
by writing to each site that carries your work of that image,
stipulate the offender, the offending site, and all relevant information to form a paper trail.
send it to each site's Support.

this would build an existing record (similar to a credit report or a criminal record , if you will)
which will or could be recalled in the future, should this thief be implicated on being a repeat offender.

build a paper trail. if you don't do it, no one else will.


Excellent point dear Perseus, you just nailed the "moral" of the tale.
I got several images bought from dreamstime, usually all my digital paintings and matte paintings, and saw them used on deviantart offered in large size (1st infringement), or sold as prints (2nd infringement).

1st I decided not to sell my paintings as stock anymore and then I started to warn all the clients who were infringing the TOS... actually the most common reply from the was "I didn't know, I have never read the License's terms"... omg.  :o

Now I think I'd had better contacted the support of each agency and build real case against each one of them... maybe I could have gotten more than a "sorry, I'll take it down"  :-\

Anyway the DA user is redistributing the work, is not allowed to do so.

 My Family takes over the company and that way they are not taxed to hell for my passing. Inheritance tax in the States is out of control.

Perseus your idea to let the models inherit the stock income is  very nice.

My best selling pictures are my self-portraits so I should bring my stock portfolio in the coffin with me... AHHAHAH

Hear this guys:
A friend of mine who owns a 5D MarkII told me not to spend all those money and go for a FC card like his that he's been using for a year and never failed.

He suggested me a Maxflash 16GB 233X which costs around 40 euros... has anyone ever tried it out?
There's a lot of difference between 70 and 40 so I'd like to know your opinion.

In a few hours I'll be out buying the camera YAY

More likely it's due to the fact that there have been many reports of freezing problems with IIIs and 5DIIs, especially 8GB IIIs (i.e., the camera would suddenly freeze and only removing the battery fixed the problem).

Yep I heard of that and probably makes me go for 2 the Extreme IV, wow it will be a nice punch in the stomach  :P

Whatever you decide do not buy Lexar they didn't work in my 5D Mk2 (and a lot of other Canon models apparently), I use Sandisk and have never had a problem.

I found out that the 5dII writes at 10MB/s so whatever CF is over that threshold is just fine.
I think that the big CF card can be risky just because if you lose it you lost a fortune, not to mention the fact that is safer having more little storage unities just in case someone might fail you won't lose all your work. Although I've never faced a CF failure in the last 6 years of shooting.

I use the Extreme 3s and 4s, and they work just fine.

Hi guys!

Tomorrow I will finally go take my 5D mark II at the shop but I'm having some doubts about what CF card to purchase.

Considering that I will take advantage of the video feature and shooting in full RAW (what else? :P ) I was thinking of a 32 GB Flash card but they have a lot of different types. I will chose a couple of Sandisk Extreme 16GB

But which one?

If you count on doing a lot of video, try the Xtreme IV. My III gave some glitches. Perhaps that's due to the fact I work in the tropics in an ambient temperature of 35C+.

lol, yes, why don't we all group together and start our very own stock site, and call it what Racephoto calls, "CRAP STOCK"..
and after a couple of years, we can close it and all celebrate in Honolulu with the money that did not reach payout.

it might be a great idea, instead of us spending hours making great photos and uploading to micro sites who seem to prefer paying us SUB-level  (ha!ha bad pun) commissions ,  don't you think?

moreover, we don't even need to ask for contributors as our joint portfolio would make us the fastest growing micro sites on day 1.

Count me in Perseus!!!

As I said on the previous page, Shutterstock settled with one of their customers who agreed to pay for an EL for every image they had used over the circulation limits in the regular license.

kudos to Shutterstock for going after the claim. 

only 1 EL for me on the 4th :(  sniff sniff
3 EL's on other days so far in Jan though

Perseus it's simple!

I always upload via FTP and I just leave the images in there, waiting to be imported from the FTP folder.
They get reviewed only when you transfer them in your portfolio folder
