I am pretty sure that the lack of notice (in my case only a few days) of the changes is a legal breach of contract, specially when it was announced just before everything closed down for the Christmas/New year break. I doubt very much if that was a coincidence.
It would be great if any of our fellow members could advise on the legal situation in Yay's home country or what authorities we could contact over there. Surely if someone closes an existing business as Yay said they were, then any monies owed should be paid, assuming that the company remained solvent. The fact that they are moving their operations to another company with another business model should make no difference. I am absolutely certain that Yay's behavior would not be legal in the UK and trading standards or similar would be able to either act or advise on the issue. I would also be very surprised if they are not in breach of some EU laws as well. 131

Almost all of my sales come from their partners anyway, certainly all of the decent priced ones. Once I get enough sales to reach payout I will be saying goodbye to Yay, unless of course they do the decent thing and agree to pay us what they owe us if we leave before then. 132

If they keep that going I will just stop uploading and leave the existing images there, with yay subs disabled of course. I can cash out once a year or whatever. 133

I would love to do the same right now but I am still hoping that someone from Yay will either answer my email or post the answer to my questions here.
It might seem like small change to individual contributors who close their accounts with money owing but I really hate the thought of any agency raking in thousands just by moving to a new site. Seems like, we as contributors have the choice of being screwed out of what they already owe us if we leave or being screwed with crap commissions if we stay. I will happily close my account there WHEN and IF I get the assurances that I have requested from YAY about the deletion of all my images from their site and their partners.
When Photokore closed down recently they did the decent thing and paid the commissions owed even if it was less than the minimum threshold AND respected the wishes of those who did not want to have their images transferred to Getty. I sincerely hope that YAY will do the same. I do not see how Yay can continue to sell our images if we do not give them permission to transfer them to the new site. I would have thought that it would be a legal requirement to stop using other peoples copyrighted material when you close down the site under whose terms the contributor contract was made. 137
