That seems to imply that 55% of all users would switch but more likely it was 55% of the polled group of Creative Cloud users that would switch.

I got a brief response from my email to DPC support simply stating that none of my images are available on DPC as per my settings on Fotolia.  No explaination or apology, just stating that they are not there as if that was always the case.

My full portfolio is there too and I also opted out from the beginning when the first gave us the option.  I stopped uploading at that time as well.  Sales for my small portfolio were minimal but they dropped by half after the DPC opt out which I attributed to the DPC effect and my lack of uploading.  Now I wonder how long they have been selling at DPC and if they've just been pocketing the money instead of crediting my account.

It is not unusual to see a trademark granted where the registrant is granted the trademark with specific total usage in a logo but does not claim any exclusive rights to a more general term included in that name.

Look up "Books" in a trademark search and you will see the word incorporated into several phrases and will often see a disclaimer that there is no claim on the word "Books" outside of its use in the total mark.

Best case scenario for all would be for Robin to be granted the mark as shown, with the hummingbird image, with the disclaimer that no claim on the word Symbiostock is made apart from it's use with the hummingbird image.  That allows him to protect and offer users some assurance that the official versions are those with the hummingbird (not that it would stop thieves but at least it offers a point of distinction).  It would still allow legacy users to use the word Symbiostock as a stand-alone word without the hummingbird.

The legacy version of Symbiostock is no longer being developed but is being supported to the extent of keeping it functional with Wordpress updates.

A new version of Symbiostock, being developed by someone new, not the original developer, is in Beta testing.  Not many details yet on what will be in the base (free) plugin and what options will be paid add ons. 

There were pros and cons to the Legacy version SEO. It did not bring cross-site sales was expected but it did help increase Google indexing and visibility, especially when you were actively uploading and blogging. I also notice a relationship between searches and sales on the established sites.  Could be coincidence that it's an active topic or that someone finds me via Google then tracks me to an account they have with one of the majors.  Exclusive images on my site would help that.

I am taking a wait and see stance before converting to the new Symbiostock. I want to see what it offers and what the cost is before I undo what I have now.

Why does he have to introduce himself as long as the sw works? If Leo transferred the intellectual properities to Robin, any future SW is his property, any other sw that was written and put into use still is open public source.  And yes you can trademark a name that is unique, you cannot trademark a common word.

Don't like him or his software, don't use it, plain and simple. No one is forcing you to change.

If we didn't like the terms of his EULA which he seemed to say were retroactively applied to all earlier version of Symbiostock, then you had to stop using it so I would say that yes, he was forcing us to change, away from our legacy versions if you didn't agree with his new direction.

Of course this could all be a moot point. His site has been down for at least 36 hours now and he hasn't been active here or on any of his social media sites since late last week. Hard to guess if he's given it up already or just went underground until he actually had a product to show. 

And as far as trademark goes, you can trademark a name if it's unique but I believe you need to apply in multiple jurisdictions if you're seeking international protection for your mark.  Additionally, your application can be challenged if someone can show prior use. You can also be challenged after registration has been granted.  I handle trademark registrations at my day job and last year we had one of our marks challenged by someone using it for a product that was different but within the same class number (trademarks are granted for use in the specific class(es) applied for as applicable to the product it is used for).  Our attorneys advised that we accept the proposed solution of a contract that allowed joint use within the class for separate categories of sub-class as they said the other company's prior use would give them a strong case if they were to challenge us.

Robin may or may not have filed an application for a trademark on the name but in the U.S. it takes about four to six months to go through the process before you are granted a registration number and there are opportunities to challenge it as well. I'm not familiar with international filing but presumably he would want to file in multiple countries since Symbiostock is in use internationally.

You arent really serious in hearing my opinion, but there have been other threads, fairly recently, about alternatives. You could just go get answers from people you have respect for.  ;)

I was serious with my question since I knew you had experience with Symbiostock and another option.  I haven't read recent threads on other options lately as I too had been waiting for the new and improved option.  I'll see what I can find there.

I have been waiting for the ultimate symbiostock version only to find out THIS weekend that it's not coming and that the current developer of symbiostock has no clue about developing nor photography. So I will look for alternatives as of now.

So did you sell on your new site yes or no?

Ron, in a thread on Symbiostock.org Robin said he has been a microstock photographer for 3 years, and is also a programmer and videographer.  We haven't seen links  or  functional plugins to back it up yet but to be fair, how much do we know about who is behind just about any of the themes or plugins offered over at Envato.

A fifth choice would be to take all of the drama out of your lives and use a different theme and selling media. There are other choices where you only need to be involved with the developer if you have a question and need help.  :)

Cathy, how is that option working out for you?  I tried going to the link in your profile pic and it's not active.  Couldn't find it in a web search either.  Did you change your website or just decide against self-hosting altogether?  I was curious to see how your site looked compared to Symbio options.

Mine has the math question on the log-in page too.  I'm wondering if that is something new with recent WP upgrades rather than a Symbiostock "feature."

I haven't updated my Symbio sites for a few versions now.

ETA, I checked my test site and it's not showing up there.  I recently updated some plugins.  Now I'm wondering if it's related to one of those, perhaps Jetpack or Askimet or one of the others that track activity.

I am so tired of the hints and the guesses and the games.  It's like a bad divorce. You get the house, I get the car and nobody wins. 

The unspoken implication seems to be that nothing would stop anyone from uploading photos to Leo's version but photographers would not be part of the universal search and there is no built in function for model releases.

Robin has said that his version will support a variety of file types including jpg, tiff, ping and a few more but no word on any kind of universal search.

And pity the poor artist who works in multiple media.  I guess they are forced to split their portfolio or look elsewhere for a solution.

I don't really understand how it came about but obviously the two of them could not agree on the future of symbiostock. The way I understand it is this. Leo gets the software he had been developing to upgrade the original theme for the last year or so and Robin gets the name. Both entities can build off of legacy programming but Leo is contractually obligated not to offer future services to photographers. So this is what I would recommend. If you are legacy site owner and it breaks or you are having problems I think Leo is more than happy to help. If you are an illustrator looking to move forward GRFX is your branch. If you are a photographer looking to move forward then Robin will probably be who you need to deal with.

Unfortunately, while Leo said he was here to answer questions he went to trash Robin's knowledge and skills then told us if we had problems with our legacy sites we should go to Robin for troubleshooting.

Leo i appreciate what you did. i really do but you are missing the point. I'm sitting here with a site that currently can go nowhere even if i wanted to convert because there is no converter for me that is ready. Even worse its being built by someone who as far as i know has no history with symbiostock at all. I might feel better when i actually see something real from the new symbiostock but right now i'm pretty #%$#@& about being left in the lurch.

Exactly how I feel.  Sorry Leo, but for months you were dropping hints about the new, improved, fantastic, VAT enabled Symbiostock coming soon.  Then out of the blue the photographers are kicked to the curb when you announce that this new version is for illustrators only and legacy users are once again wondering what our future holds.

Robin, I'm looking forward to seeing more info on the changes.  I did notice your offer to give credit on past purchases of the pro plugin towards future hosting or premium themes beyond the free option. I appreciate that and hope the new version is as easy a transition as it sounds like it will be.

He mentioned in earlier posts that Robin had taken over the task of creating the coding and modules for photographers and that given some of the complexities it was going to take some additional time to have that ready.  Hopefully we will hear more on what we can expect for photographers soon.

The difference, Steve, as I see it, is that under the original SYS-network system, any site owner can tick a button to ensure that images rated "red" do not show up in a search initiated from his or her site.

And yes, that does seem to work, probably because Symbio site owners with X-rated images have an incentive to be good team players and mark those images "red."

But if you take away the Symbio context and let anybody willing to pay $25 insert their images into our search results, you do change the dynamic.

I understand that if something awkward happens, you'll "deal with it," but that might well be after an embarrassing episode hits one of us.

Martha, I don't think Steves project will insert any search results into your individual page unless you have listed his search engine as one of your network partners (as many have done with AJT's .info search site. 

The way I understand it is his search engine, on its own page, searches Symbiostock sites.  He is expanding that to include outside independent sites that are not based on the Symbiostock context.  It should not have any impact on what visitors see on your page.

Ruth, I found your post over on the forum Cascoly established when the Symbiostock.org forum was diabled.  Leo has the .org forum up and running again.  Try posting over there to see if anyone has an answer.  Leo keeps an eye on that forum too.

The front inside cover and first page are a two page spread advertising DPC in the latest issue of Photoshop User magazine.  The e-mails are probably part of the advertising agreement and that size and placement were likely to be very expensive for prime placement.  I would not expect him to have detailed knowledge of the individual advertisers products in the magazine but would hope that he will challenge the advertising department to investigate and that he would take a moral stance against future promotion and refuse the ads going forward.
