whether something is "editorial" according to copyright law is based on usage (the buyer) and not the sale or seller. marking something as 'editorial' for sale, without knowing how it will be used, is nonsense, and shows how clueless the stock agencies are.

the sale to a professional (web developer, designer, etc) is not considered 'use'. 'use' means how it is used to present to the general public.

selling on alamy is *not* selling to the general public.

the whole agency is full of it when it comes to editorial use.

what they instead should do is have all content as royalty free, and list if it includes release forms, and let the buyer decide if he needs the release form, since he knows how he is going to use it. for example, news media outlets that write news stories don't need model release forms or property release forms (even though they often request them) because it falls under 'fair use'. therefor, anything they buy is editorial use regardless of how the agency classifies it.

agencies got it wrong. wish they would fix it.

Again, I did a pixel by pixel comparison of frames from a video rendered to PRORES and a video rendered to H264. The difference was negligible, the file size of H264 was significantly smaller.

It is a complete myth that PRORES is a good codec.

Out of 8,000,000 or so pixels, only 500 to 2000 differed between the H264 and PRORES rendered frames, and the H264 file size was a fraction of the PRORES file size.

People using PRORES are deluded into thinking it is superior to H264, and they are completely wrong.

the above statement is simply not true.

I did a pixel by pixel comparison of video frames rendered with various codecs such as PRORES, H264, PJPEG, etc, and H264 performed extremely well compared to prores, and the difference in file size for PRORES makes it a far less efficient codec. The variance in pixels with H264 was hardly noticable (perhaps not even 1%) and the file size savings were absolutely massive.

in addition, H264 is a far more advanced codec as compared to PRORES. there are far more options and features. Any drawbacks with H264 (vs PRORES) have been resolved with H265 in terms of bit depth. PRORES is a very basic, featureless codec.

there are 2 spaces for witness and witness signature, on both the adult and minor release

if anyone ever asks to see your camera or recordings, tell them no, unless they are a police officer. no one has the right to look at your material no matter if you are on their property or not. if anything, take a photo of anyone that bothers you, they are scared of having their photo taken more so than anything.

courts only grant rights to law enforcement (police). private security guards do not have rights granted by courts.

do not film any place that the US government or local government has posted that you cannot film. there are special photography laws for certain locations.

if a private security official harasses you, tell them to call the police, or call the police yourself.

you can buy the software for around $150, and pay $30 per month for hosting.

selling videos requires far more disk space and is more expensive. the best deal I found is 4TB server for $55 (dedispec).

cms account is the software I bought. it works but at the time I would say was minimal.

I uploaded an 80mp photo as a test.

The issue I see is that many companies are upresezing photos (which are being purchased), and that there are few uses for high res imagery. Most photos are probably being purchased for blogs, which do not need to be high res.

the above is a myth. it is a policy of some sites such as shutterstock, but has nothing to do with copyright law. you are free to film and resell your photos, even if you pay an admission fee, even if you do not have permission from the venue. venues are not courts of laws and you do not need to abide their photography rules.

I contacted the US copyright office regarding this issue, and they confirmed this.

there is nothing in the US (or other country's copyright laws) which have any special photography or copyright requirements for venues with paid admission.

if we followed the stock agency web site's rules, you would only be able to film nature and naked people. they think everything man made is copyrighted.

I used to have to issue 1099 forms to people I hired.

I seem to recall they have to be sent by Jan 31 of every year if the person made more than $600 for the year. There are exceptions whereby you do not have to send the 1099 but I do not remember what they are.

In the US, copyright ownership is transferred using a Copyright Transfer Agreement.

It would be more accurate to say Fair Use (in accordance with US copyright law) and not Editorial. US copyright law has no provisions solely for Editorial (in US copyright law it is known as Commentary).

The seal restriction (and any government seal) is only restricted for use if the intent is wrongful or fraudulent. That means that selling stock photos of the seal is most likely legal (as shown by the SONY BETAMAX Supreme Court case). The restriction is primarily in regards to conterfeiting or falsifying documents.

you can submit 3d footage as separate streams, or try putting the left stream on the left and the right stream on the right (making the video double wide).

they might reject them.

I submitted my 3d footage as 2d (left stream only).

pond5, fotolia, and a few other sites do accept 3d video (although they don't know it).

I am seeing a possible new bug, where by videos I submitted a few days ago are back in the unedited queue. the thumbnails are not showing.

either this is a bug, or they moved pending videos back into the unedited queue.

if you did not receive your form, you can go to your local federal building and get a printout of your 1099's for any year.

if you are on a slow connection, on many web sites including SS, when you add a MR form or make another change, a slow or bad connection can cause you to think the change was made when in fact it was not.

check to make sure it says "saved" and in the case of SS I think it makes the save button unclickable when the save is done properly.

also, I have had previously accepted release forms from years ago accepted, and then rejected recently because of problems with the form.

I know for a fact that they have multiple servers, so you can see one thing on one server and something different on another server. I noticed this because I was reloading pages and seeing 2 different versions flipping back and forth, until a while later when they became both the same.

for many months, my photos have been approved at shutterstock within 24 hours.

then recently, SS rejected a batch of about 100 photos claiming they were out of focus (they were not). these photos were part of 400, sent to them in random order, and the other 300 were accepted already and are selling.

after that day, SS is no longer approving my photos within 24 hours.

any ideas or comments?

I was wondering if others have had a slowdown in their approval times recently or if it is just me.
