People like to be screwed by Shitterstock, i think! ::)

A friend of mine, also a photographer, contacted Getty/iStock and asked them about promo.com. He got an answer, me not yet.

Here a part of the answer from Getty/iStock:

#Your content is not being used for free.

Your Connect statement will provide the royalty information.#

Followed from two links. I read them carefully and understand now much more about it, but there was no example of promo.com. So I only can get an IDEA what we might get. But at least not for free, but might be for 0,0000000001 penny for each use.

And Getty/iStock wrote:

# Our contract with Promo.com is confidential.

We have not been receiving any other tickets from other Contributors regarding this same matter. #

no comment.
Oh my god! this the reason because our sales ar downhill! Getty/iStock hijos de puta! Me perdonan la grosera, pero es demasiado el abuso de esta gente!

I like them.

Uploading is easy, pay is decent, image security is good.

I also like how the galleries look.

You will have to do promotion of your own to get good sales, though.  Their SEO is a little weak.

Here's what one of my ArtPal shops looks like.

Thank you! Very nice gallery!

General Stock Discussion / Someone Knows www.artpal.com ?

Someone knows www.artpal.com ? I find this website where we can sell our work. But i don't know much about www.artpal.com. :(

155
Can those of Istock / Getty Images give our content for free without paying us anything for it? This is not called theft?

@Uncle Pete Why didn't you continue the count down?

Happy new year 2021 to everyone! Hope it will be better than 2020.

Well, so the british, the german and the dutch call us "non white" or "spaniard white"   ;D It's like a joke. I really like to be black, I love the Blues.

I think that the same thing is happening here and in the rest of western countries, not just in the USA and, in the USA, not just in one side. There is hate speech everywhere and polarized societies in all countries. Politicians and media are crap everywhere, not just in one side. Have to think that most of Trump voters read several newspapers and watch several tv channels too. At least in the same proportion that Biden voters.

In Europe It's really hard to read a newspaper. Some media like The Guardian just invent the news, I have read fake news about Spain. And in Spain all newspapers and tv channels are garbage. All of them, pure s.

So, we have the same problems. We are lucky because we have a bigger structure over the countries with strong rules in some issues, but without the EU Europe would become a jungle. But we have some kind of stability that is our biggest richness. We are going to see soon our strongness together with the british chaos.

Maybe in America people have to find a way to fight for a better life beyond the two parties. Poverty is a domination mechanism in both capitalist and communist countries.

Completely agree with you! I live in a socialist country and a lot of people are eating crap, despite the false promises of socialism about equality and better quality of life. :(

Hello,
I am a vector illustrator. I have 1610 vector illustrations on SS. But I decided to upload my vectors to other stock web sites.

However, it takes considerable amount of time to upload all those vectors to other sites, so I want to know which sites are worthwhile of uploading.

Which sites are efficient with vector images sales? Please feel free to mention not worthy sites as well, if you know any.
Thanks.
Vectorstock.com, do you know it?

We're you joking? Site with 23M vectors and they promote their 703,986 Free Vectors. Not like a free video or a free image, but 703,986 free vectors?

Ranked below Panther which, hey is Panther still in business? What's a .3 rank? Oh about $2 a month.

Worthy site would be Adobe Stock.
Sorry i only knew that website it's dedicated to sell vectors, but didn't know it was too bad. :(

In my country Venezuela, we have a saying, it says "Sarna con gusto no pica, y si pica no mortifica!"

# If i close my account on Getty/Istock the images on Promo.com will be remove? #

Thats the point!
Before I close my account on iStock, I have to know it!
If not - what to do? Luckily I didnt submit my best work to iStock.
But 32 images as Partner (Getty) photos via eyeEm are for free on Promo.com, too. I asked eyeEm already to take them from Getty & eyeEm market.
But also in that case, I do not know, if these 32 photos will get delete on Promo.com too.

First I did not think it has something to do with this, but now:
I just found out that i had 10 sales on iStock - ALL for 0,02. (With filename and dates and thumbs. They were sold in October.
And ONE SALE for 0,000000000 and 0% Even no filename.

But I did not get any information from iStock about that. Not on the app not in ESP, but I found them on Deepmeta.

Strange!
Might be these images got sold on Promo.com and at least paid??? Could be also just sub-sales as described on Deepmeta.

Shutterstock footage: I just two weeks ago deleted my only one footage on Shitterstock. I cannot find it on Promo.com. Seems like they deleted it on Promo.com too or it was never selected for Promo.com.
But in Getty/Istock you can't delete photos. They have all control on material.

162
ALL either >:(

But I couldnt find any of my Shitterstock portfolio.
Can I do it the same way: portfolio name+keyword like Bali?
This work for images only (not for footages). For me, all images from PROMO.com are coming frim iStock and all footages from Shutterstock.

We contacted Promo.com already, but does anybody already contact Getty/iStock/Shitterstock about this? And what were their answers - also in case of a law suit? Any terms again that allows them to do it and we didnt read or didnt understand about the consequences for us?

I sent a request to iStock to remove my images from PROMO.com. I guess it will take some time to get an answer; and I am not sure to get a positive response. We would have more strength if every contributor send such a request to iStock.
I also posted a message on iStock forum.

About SS, I only saw my footages on PROMO.com (all images come from iStock). And I understand we get some (very) small commissions from SS, for sales on PROMO.com. This is probably an explanation to the $1 commissions I receive from time to time on SS. So I guess all this is legal for footages. This is why I stopped publishing footages on SS (I am now Pond5 exclusive for my new footages). I will probably remove my footage from SS in the future to avoid this.

If i close my account on Getty/Istock the images on Promo.com will be remove?

163
I also found this site selling artist artworks (mine images as example) without permission
https://www.thezoombackgrounds.com/collections/background-videos-for-zoom

Please take a look and maybe your videos/images are there

#I also saw some of my images there#

How were you able to see / search for them?
Any link?
I sing up using my Google account, so i go to the search and select image, all my image from Getty are there! >:( :( >:(

Hello fellow stockers,

I found a website called Promo.com that is selling footage from ShutterStock and iStock at extremely low prices and is so badly watermarking the content that you can practically download the videos in full quality without paying anything. I searched it and found most of my content there, I believe this concerns all of you and probably your footage is there as well.

Recently I was able to find a lot of my content in various online ads, even TV commercials, that were missing from the sales reports. Luckily I was able to get in contact with one marketing agency and gather more info about where they got my content from and that;s how I found out about this website. All of the clips they purchased from this site were never reported in any sales reports on SS or iStock.

Another big issue is how they are watermarking the content, as you can see in the attachment below you only have 1 stripe in the upper left corner of the video which makes our videos usable in full resolution for most of Instagram ads and similar content in 4:5 aspect ratio for free.

Reading the About section of the website I found info that they are partners with ShutterStock and Getty Images.

Can someone please tell me is there something we can do about this?

Thanks in advance

Well, another robbery from scam companies. I also saw some of my images there and I see why they are no longer sold almost in other places. All this is very frustrating. >:( :(

Believe it or not but people like Oringer, Zuckerburg etc etc are lefties and now with a new leftie President???  lefties have always become rich on other peoples work or money! so Jim how do you propose to get somebody like Oringer to do this?

There's so much wrong with this paragraph that I don't know where to start. But for now... I was always under the impression that 'righties' weren't a big fan of 'handouts', so I'm guessing you wouldn't be interested in this anyway?
live in Venezuela, which is a socialist country, almost communist, and I can assure you that the people who came to the government and have already been in power for 21 years came as almost .beggars and now have great fortunes.

Saludos Alexanerssr

Authoritarianisms do not matter whether they are from any side of the arc of political ideas. Any authoritarianism is a dictatorship. The nomenclature with which dictators call themselves is independent of the pain, tragedy and blood they inflict on the people.

I think we can all find common ground in acknowledging the disappointment we all feel in our governments, left or right.  I personally wouldn't proudly wave a flag for either side.
I agree with you, I am neither right nor left, neither feminist nor sexist, nor lgbt or any of those things that are in fashion now. I am just an ordinary person.

In my country these people have been governing for 21 years, they have won the odd election fairly but most have been cheated. At first they used the voting system of the Smartmatic company, whose founder is a Venezuelan engineer. With that company many elections were held which were fraudulent.

Venezuela is on the way to having a dictatorship like Cuba, since I don't know of right-wing dictatorships that have lasted as long as those of the left.

I think Shutterstock will continue selling the video without authorization.
Shutterstock son unos grandisimos hijos de puta! Y me perdonan la grosera pero es para desahogarme un poco!

171
Ive been going back and forth with their support from someone overseas with no real power to et anything done. Getting the usual BS. This time I responded back with their infringement department ccd, saying that theyve essentially admitted that theyve broken the terms of service by still having it for sale. They can either take it down or the next correspondence will be from my lawyer. I think Ive got a case. The only question is whether its worth going through with a lawsuit.

As I've written before, the first consultation is free, most places. If you don't go with one of the online infringement specialist places, find a copyright attorney.

Make sure you save screen snapshots of the image, actually active, available to be purchased, on their site and proof that you closed your account. Evidence and documentation is most important.

You have 90 days from discovery to make sure you have a registered copyright, (In the USA) in which case you can get more than lost income, you could get damages. If registered there are other claims as well.
With your legal experience. Do you think that the person that Shutterstock is selling videos without his consent , could win the lawsuit?
How much money could he win in the lawsuit against Shutterstock?

Ask a lawyer? I only know what everyone else can find by doing research on the Internet. And I still don't know the country of the OP with the video, but SS is in the US.

https://www.copyright.gov/help/faq/faq-general.html

Some important points:

"When is my work protected?

Your work is under copyright protection the moment it is created and fixed in a tangible form that it is perceptible either directly or with the aid of a machine or device.

Do I have to register with your office to be protected?

No. In general, registration is voluntary. Copyright exists from the moment the work is created. You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work. See Circular 1, Copyright Basics, section Copyright Registration.

Why should I register my work if copyright protection is automatic?

Registration is recommended for a number of reasons. Many choose to register their works because they wish to have the facts of their copyright on the public record and have a certificate of registration. Registered works may be eligible for statutory damages and attorney's fees in successful litigation. Finally, if registration occurs within five years of publication, it is considered prima facie evidence in a court of law. See Circular 1, Copyright Basics, section Copyright Registration and Circular 38b, Highlights of Copyright Amendments Contained in the Uruguay Round Agreements Act (URAA), on non-U.S. works."

If wollwerth wants an attorney to handle the case, they will want to get paid by the defendant, if they win. Also wollwerth probably doesn't have the personal finances to hire someone. So, the work must be registered. That's the difference between the automatic protection and why if someone is suing, they should register their work.

So is it likely that Shutterstock continues to sell the Wollwerth video unauthorized? >:(

Wollwerth who is the video owner that Shutterstock is selling without his concent , seems live in the USA, i read this in his profile Beaufort, SC, USA

You have a case no doubt. This happened to me in the past with a few top red flames bestseller images uploaded by some pirate to them. I made them aware of that I also contacted the legal department at Istock/Getty and the images were gone in 10 days after many mails by me to them. Nowadays I would not go this route. I would send only 1 mail and maybe a registered fax and afterwards sue seeking damages. It is their responsibility the content they sell on their site. Does not matter what's in their TOS. A Judge will see what kind of responsibility they carry whatever they say.

If you are not in the US go to court in your country. If they violate intellectual property their site might be banned access in your country. And if this happen I am sure they will contact you quickly and negotiate a settlement before court. Don't be afraid if they are big. If you are telling the truth they stole your content and are selling it. No way they are going to win such a case.

Before you initiate judicial actions go to a public notary so he can certify that they are still selling the content on their web. After that for everyday it was online you ask for damages and to be taken down obviously.

It would be interesting if he can gain that case and get some $ millions, but i think Shutterstock will use all its power and influence! Maybe that possible if the guy live in the USA. But, i don't know much about the USA laws, maybe i'm dreaming! :)

Thief makes screenshots from stock videos, blurs them and sells on Shutterstock

Check if yours are also there.

And the account is still there!

Yeah, worth repeating:  Im nippon freelancer journalist who loved to travelling around the world. in blurryness i found peace and the truth perspective.thanks for supports.

Time to write again.

I wonder how the people who check the images accept them, because some people here have said that they have had some rejections in out of focus images.

175
We wouldn't still be having this conversation if everyone had boycotted shuttercocks ...
But it's important to know what happened if he sues Shutterstock for selling his videos without his consent.
