Off Topic / Re: The Hummer Thread
« on: November 18, 2021, 20:51 »
Martha, that's great to know. There's one particular bird that I would really like to photograph and that's the humming bird. But I confess that Ive never seen one in my life as I live in Australia. I know that they are unique to the Americas. I visited Canada in the late 90s and was hoping to see hummingbirds there but didn't see any. A few years ago, I went to Michigan, US but didn't see any there either. Though I did see fireflies for the first time in Michigan and they were amazing. Really surreal. I regret not being able to photograph them because my camera battery was being charged at the time.

Im late to the party. I just looked at the dates. Id delete this if I could. Oh well.

My brother lives in South Carolina and he gets tons of them at his feeder.

And be advised it takes a week or more for them to transfer the money. Used to be just days.

General Stock Discussion / Re: microstock goes NFT?
« on: November 16, 2021, 07:51 »
Crazy world, and for first time I really think: I'm too old for this crap.

Ha! Thats exactly what I think, too. I have a friend who is all into this stuff, along with cryptocurrency. He keeps bugging me to sell some work as NFTs. Yeah. No.

I think for some fine artists, yes. For some amazing photographers, yes. For most microstockers, no. But I agree, show me an average microstocker making good money doing this and I might change my opinion.

Amazing, isnt it? But then SS hasnt really been picky about what gets through for years now. Stolen work, pages and pages of the almost-same pics of marijuana, the list goes on. Its kind of a cesspool now.

56
And lots of images on the free sites are stolen images so you have to investigate just to find the original copyright owner. Best to pay for a license to use the image you want.

I thought people were deleting accounts rather than creating new ones.  ;D

Exactly. And lots of threads here about SS. Guess everybody reactivated their accounts.  ::)

Illustration - General / Re: regarding older Adobe software.

Im running CS6. I only have one client left, so I will not be getting the CC. I dont update my system either. Im running Mavericks, and everything works just fine. I have no need to open newer files. I suppose one of these days apple/adobe wont be happy with that and will bugger something up so that I can no longer even make the small amount of extra freelance money that I do. And so it goes.

Before PayPal made the change with the mobile phone numbers they sent me like 579946 mails to remind me that I needed to add a mobile phone number so I could continue using my account. They started doing this like half a year before and then sent new mails every few weeks to remind me of this. It was really getting bothersome, as I had added my phone number already. These were automated mails, so everyone should have gotten them, but people need to check the mail accounts they used for their PayPal registration and spam folders regularly.

Thanks for this tip. I didnt get like 579946 emails about it, but I likely did get one or two, but I dont think it made it clear that I HAD to add a phone number in order to access my account. Anyway, fixed now.

Can't even get into my account >:( My password still works but for some reason I can't get passed the "summit mobile number!" crap. I don't have a mobile phone and I cant even use the link they provided for codes.  >:(

I just tried right now and am having the same problem. So I cant get into my account right now. And I do have a cell phone. Theres no balance at the moment, so not an issue, but I cant get over how these companies make billions of dollars but cant even have working websites.  ::)

They market their site as allowing contributors to set their own prices, but the fine print says they can change them at any time.

When I click the link in the first post here, I see the header, then this: Sorry, but we're having trouble processing your request.
Support reference ID: U-7FC-201-1381
That's because there's a . at the end of the url.

Try: https://www.istockphoto.com/portfolio/eyupzengin

That link started to load some images, then it went back to the header, whitespace, footer like the other link. No problem, it doesnt matter. By now, everybody and their brother has stolen my top sellers.

No it's not.

Here it is.

Looks like all the photos are gone.

I see a port of 4598 photos.

I dont. Header. White space, then black bottom footer.

« on: May 11, 2021, 13:12 »
Just an update...deposit did remove the page with my image where you can buy it. However, the preview image still shows in yayimages account.

I will go look on yayimages to see if its off their site. I never even heard back from them. ETA: dont see it on yay either. Ill have to periodically check. These people are scum.

OMG I found one of my best selling images there, and I was on neither deposit or yay. They have stolen my image!

Deposit was shady from day one. Apparently still are.

I am royally pi$$ed. No wonder I dont make any money. Scumbags. Now I have to go see if there are any more. 🤬🤬🤬😡😡😡

I have contacted both yay and deposit.

oh, your case is even worse. Sorry. Let us know please if they get back to you. Yay most likely won't care but at least deposit might hear another problematic case by yay.

Deposit sent a generic email response saying they opened a ticket. Thats all so far. I gave them the image # for sale on Adobe so they can check. I told them they needed to boot yaymicro for copyright violations.

Insider privileges

This was always my theory. Getting a bunch of people to buy photos, then reimbursing them, etc. sounds like a lot of work to get your photos to the top. But schmooze some of the insiders and boom, youre in.

Hi, I had been a contributor at shutterstock over many years.  As my company decided to close stock activity I requested shutterstock to close account in end-December 2020.  At that time there had been over a hundred remaining images many of which I had tried to delete manually but they kept re-appearing.  Anyway I was informed by one of their Expert responders that it can take up to 90 days for the account to be fully closed and I decided to wait out that period.  It is now over 90 days but my remaining images are still showing on sale at shutterstock, but without showing any contributor name.
Have written again to shutterstock (awaiting response) but meanwhile am wondering if someone here has similar experience with shutterstock?

I manually deleted all my images back when they first announced the contributor-shafting they were going to give. I left my account open, because many complained of the same issue you are having...that their images kept showing up for sale.

I just checked my account, and no images are showing. (that doesnt necessarily mean they arent still selling them, sneaky ba$$tards that they are). But many others had the same issue as you. 😟

A 'painting' would be a derivative work, which I don't think is allowed by the license. You should clearly label the product you sell as a 'print', even if the process of transferring the digital image on canvas is manual.

I dont see any mention of derivatives in any of the forbidden uses.

74
I was hoping Mat would weigh in here, but no problem.

Sorry Cathy, I can't give you specific legal advice. My recommendation is to refer to the terms of the license agreement.

https://stock.adobe.com/license-terms#extendedLicenses

-Mat

No problem. I cant even get to a sales person who can clarify it for me. My email went to contributor relations, and she sends me to a page that has nothing that covers my question. And she says no one in sales has an email. 😳

Heres what the license says: Extended licenses
With an Extended license, you may:
Use the asset with all the rights granted in the Standard license.
Reproduce the asset beyond the 500,000 copy/viewer restriction.
Create merchandise or products for resale or distribution where the main value of the product is associated with the asset itself, such as a coffee mug or t-shirt.

The last sentence seems to imply that an extended license covers it. I would be creating a painting (merchandise or product), the main value of the painting IS the image I am using as a reference, and I would be selling it. But since it doesnt specifically say photo reference and since I cant get to anyone who can confirm, I will just use other sources.

Can of worms. But thanks everyone for the input.

75
Analog printing, using a machine vs manual "printing" (by hand).

If the license allows running the source image through an "oil paint" Photoshop plugin before printing, I don't see why you shouldn't be allowed to do it manually. But you have to remember to credit the photographer as the author.

That makes sense. And if an extended license allows someone to use a photo on tee shirts, then sell the t-shirts, seems like using it as a reference photo for a painting to sell would be the same. Would be nice to get a definitive answer from Adobe. I have emailed them. I was hoping Mat would weigh in here, but no problem.

The art group is now saying that crediting the photographer isnt enough, you have to have written permission, too. But thats if you just go find an image thru google and use it. Not if you are purchasing a license through adobe. Its apparently a big can of worms.
