Alamy has a 'personal use' licence which specifically covers 'reference for artists'. That is 9.99 in the UK, but AIUI the prices can vary a lot between countries.
However, it then says 'personal use only' not for resale (which also applies to the other 'Personal uses').
IMO, it would take a very public-spirited person to say, e.g. I want to just practice drawing a horse today in my sketchbook and for no other purpose, so I'll license a photo from Alamy.
Peer comments on their forum (but you'd probably be better to email them to check your use):

Thanks!

Thanks Joann. I was thinking an extended license would cover it. A person in the fine art group said she checked with 123rf, who said NO license covered it, which I dont think is right, but I wanted to check with Adobe, too, since I still sell there.

May be 123rf was talking about re-selling as stock ?  I don't think any EL covers derivative art being sold as stock (because you would need copyright for that), while it does cover selling it in print ?

No, it wouldnt be resold as stock. For instance, if I find a cool photo of a horse. I buy an EL. I would use it as reference to do a pastel painting. I mat and frame it and take that painting to an art show and sell it so someone can hang it on their wall.

78
I mean, there's no requirement I've ever seen that a products for resale EL -has- to be used unaltered, so if "altering" it means painting a version of it or whatever, I can't see how that's an issue.

As long as you aren't -licensing- the end result...

Thats what I think too. Thanks Sean.

Licenses vary from agency to agency, so it might matter where you license, but I believe you are covered by an extended license - in that almost every extended license allows you to sell physical items with the image on it (whether mugs or canvas prints). Every agency allows you to alter images when you use them (as long as you don't get into the sensitive use areas for images with people) so how you alter it isn't really an issue.

Remember years ago there was an artist (might have been Leroy Neiman) who sold his art of NFL games and the NFL went after him for not licensing the rights to use their games - he hadn't used anyone's photos, but this was just about what he was depicting. I wouldn't imagine you'd run into this, but perhaps stay away from editorial images.

The only other issue is whether you can copyright your work - I think the court rulings have to do with how much has been altered as to whether your work deserves its own. May not matter to your planned use, but just to think about.

Thanks Joann. I was thinking an extended license would cover it. A person in the fine art group said she checked with 123rf, who said NO license covered it, which I dont think is right, but I wanted to check with Adobe, too, since I still sell there.

Were just trying to establish if that fine art piece can be sold with no copyright repercussions if a stock photo is used as a reference. I looked at a couple agencys licenses, and its not spelled out specifically, so its confusing.

Good point about re-copyrighting.

Mat (or anyone else who knows (not guessing) the correct answer):

I want to purchase an extended license of a stock photo. I want to use that photo as a reference photo for a fine art piece. I will be selling that fine art piece. Is this considered a derivative piece, and does that ext license cover this application?

There is some confusion as to whether ANY license covers this.

Thanks!

Software / Re: Software to use instead of Photoshop
« on: March 09, 2021, 18:23 »
Maybe Affinity Photo?  I haven't used it but it sounds good and it's $50 or something like that with no subscription.

Yes! This the one I was thinking of. Thanks!

Minor additions. $24.99 and the free trial, no watermarks, no BS, full version, is a very generous 90 days.

Photo, Designer and Publisher are each a different software package. I only have Photo installed.

Very intuitive. Everything is treated similar to a RAW file or digital negative. You make adjustments and then save as a working file. When you are done, you export an image in the format you want. Your original images are not destroyed in the process.

Good to know, thanks!

I know there was just a discussion of software to use instead of PS recently, but I have no clue what thread it was in, or remember the name of the software.

Some fine art groups I belong to are scanning their art and want to clean up the image. I suggested The Gimp but I think another freebie or less expensive program than PS was mentioned.

Can you help?

Thanks in advance.

Hi, try these

Excellent! Thanks.

What everyone else said. Do the best you can removing images where you can. You did nothing wrong and she signed a release. The rest is out of your hands.

Thanks.  The problem is, she didn't do anything wrong either, it's just her family that is nagging her about it.  So if I can help her by deleting 4 images, no problem.

Exactly. But you have no control over the problems between her and her family. No, she didnt do anything wrong, but apparently her family thinks she did. :-(

Most here are so over Shutterstock. You seem to be obsessed.

I bought a Canon EOS D50, Alien Bees studio lights, and all the other misc stuff you need, to shoot stock. But I also did product photography/senior portraits with that equipment, which is what paid for it. What I made from stock was just mad money. If someone goes into microstock today with a similar plan, to use the equipment for better paying jobs too, it can be profitable. To spend all that money to solely shoot stock at $.10 a DL, not so much.

Today, Id buy a good phone and use that. I saw a woman on TV with a ring flash fitted to her phone the other day. Why buy the big bulky DSLRs and flashes.

one glitch & conspiracies come out of the woodwork!  they missed a payment --  likely due to a software problem. such systems usually aren't setup to run a unique payment & it would take longer to fix the software than to just combine payments.

no need to ascribe sinister intent - would there be the same response if this happened with adobe?

Seriously? I was with them from 2004 until last year when I deleted and closed. NOT ONCE did they miss or be late in paying. They gave until the 15th, but I cant remember a time when they didnt pay the first week of the month, soon after the pmt calc email came.

Im going with greed. All those huge salaries at the top are bleeding them dry. But really, werent the pay cuts and the Jan. reset warning enough that shite was coming? SMH

I wasnt banned because I deleted all my images and closed my account.  ;D

But people who spoke out and tweeted about the thievery were banned. And some people changed their avatar to be something negative about SS (like calling them Shitterstock :-) ) and I think they were banned too.

For example, Nowadays you don't need real people you can use some GAN Ai services and create a face that doesn't exist. Photo shoots are much more easier and cheap than rent studio, hire people and real models.  We can do it almost everything in a Pc with a 3d environment.

I think photo-realistic CG models in lifestyle shots is still a bit of a long way off. I don't think I've ever seen one, let alone enough for it to be commonplace.

There's already plenty of models 3D scanned with fotorealistic details selling for less than 10$. you can find that in tbsquid, cgtrader and others. Also you can buy cloths or create them in marvelous designer.  In terms of body positions you can use Mixamo or rokoko to make the mocaps. And if you use Ai Gan to make a new face  like this https://generated.photos/faces . Just apply to new body with zbrush to retouch model and match/tune color with substance sw.

For animations i think improve needs to be made but for photos? - I bet you won't tell the difference between real and Ai.

Wow, those look real. Id never know they were CG.

At 10 cents an image? It only looks bold, bright, and breathtaking to the corporate fatcats at the top, scraping every penny they can from the people doing the actual work. What an a$$.

he cant even speak properly.

Biden's vocabulary is many times richer than Trump's, whose vocabulary never evolved beyond the level of a 10 year's old. Actually, Trump's uneducated, limited vocabulary is very likely one of the reasons many voted for him. It's rather ironic to see Trump's voters mocking Biden's speech  ;)

Besides, Biden has overcome the challenges of the stutter he was born with:

"In school, they called him Stutterhead and taunted him with H-H-H-H-Hey, J-J-J-J-J-Joe B-B-B-B-Biden. He felt shame and embarrassment and was afraid people would think something was wrong with him. Early on, he learned who the bullies were and plotted his revenge"
....
There will be a moment, maybe two, on Tuesday night when Bidens eyes will flutter, his lips will purse, and millions of people will hold their breath waiting for a sentence! Fear not, for candidate Biden learned long ago, from little boy Biden reciting Yeats in front of a mirror, how to slow down, adjust his cadence, and roll with the words.
..."

This exactly. So much better of a human being than cheetolini. Even on his worst day.

I have heard him talk, and I don't have any problem with his speech.

Trump impeached for the second time.
There's a record he can boast about!

Yes! And the House and Senate both voted to impeach. Get that idiot outta here, hes destroyed the country.
As I understand it it now goes for Trial at the Senate. It seems the impeachment has had the effect of shutting the clown up for a while....not sure if it will achieve much more than that.

Blocking all his social media accounts also helped shut him up.

I thought I saw a news report that said the Senate voted to impeach, but I could be wrong. I was watching House debates yesterday afternoon, and the NBC logo said Live, but the House had already voted to impeach. I'm watching NBC News on Roku, so...

A helpful tool I borrowed from a friend:

"Huge numbers of our population believe in a complete alternate reality. Alternate facts as it were. But just as intensely as I believe they are deluded, they think I am the one who is deluded. Maybe I am. So how can I be confident in my perception? It can be quite difficult.

I have found when in times of political confusion, particularly when emotions are running high and creating tunnel vision, the presence of a n-a-z-i can be an extremely helpful indicator.

If I am attending a local demonstration or event and I see n-a-z-i, neo-n-a-z-i, casual n-a-z-i, master race n-a-z-i, or the latest-whatever-uber-mythology-n-a-z-i, I figure out which side they are on. And if they are on my side of the demonstration? I am on the wrong side.

It is tough to argue moral equivalence when I am standing next to a N-a-z-i.

Look to my right. Is there a guy wearing a "6MWE" (6 million wasnt enough) t-shirt? I am on the wrong side.

Look to my left. If that guy is wearing a "Camp Auschwitz" t-shirt? Wrong side.

Are speakers being applauded for referring to things that Hitler got right? Wrong side.

Team-spirit face paint and hat with animal horns? This is actually an unclear indicator that could mean anything, but safest to keep my distance from that guy anyway, even at a football game.

However, I can always, always, always rely on the presence of a n-a-z-i as a guiding light through a fog of disinformation.

Some things are relative, and politics can absolutely have its opposing sides and grey areas. But evil and good are absolute.

So, just look for the n-a-z-i, and make your own decisions."
