Anybody can explain me what is email about and if anybody else receive it, no idea if I should contact SS for more informations....

We are a Design Studio based in Barcelona and we have engaged the company Shutterstock to use its database of photographs for one or several advertising campaigns for our clients.

We would like to inform that your photography has been selected for an advertising campaign and we wish to confirm that you have assigned the rights to the aforesaid photograph to the above-mentioned company, and therefore there is no possibility of future claims with regard to the identity of the creator, copyright, or any other rights.

The photo we're using is the one below:

We enclose this letter as you have been notified about the matter.

You can contact Shutterstock, but getting some decent reply from them will be difficult. I'd rather reply to this company and inquire there.

I don't think it's of major importance, they are just making sure that, being a commercial photo, you have all the model or property rights because they are going to launch an advertising campaign with it and they don't want any problems with anyone afterwards. They must have had some previous bad experience with a photo that had false model or property releases.

This statement is legally wrong!

It is your image and you are and remain the author. The design studio has only acquired a right of use. Namely, the right to use the image to the extent that can be read in the license conditions of shutterstock for the purchased license.

Has the design studio purchased an extended license at least?

It is your image and you are and remain the author. The design studio has only acquired a right of use. Namely, the right to use the image to the extent that can be read in the license conditions of shutterstock for the purchased license.

Has the design studio purchased an extended license at least?

Hi Wilm, long time no see.

Since the photo is very popular, no idea which version they got but i don't remember any expensive license on this picture in particular, mostly subs and on demand.

I also got a reply from SS on this:

​Dear xxxxxx,

Thank you for being a contributor since 2015.

I understand how important it is for you to get clarification, let me help you.

There are two concerns here we need to address:
Customers should not be able to have access to your email in any way unless you provide that to them somehow, in which case we will advise you against that, at least when it comes to your content on our site.
They should already know how the licensing of content through our site works or if not, they can contact us directly for assistance, they should never have to get in contact with the contributors to avoid worrying you.
This situation seems a little strange, however, you do not need to worry, please refer them to the following email: [email protected], they will be able to make their consults there, and please do not engage any further with them as there is always the possibility that they might be trying to deceive you somehow.

Hello DaLiu,

I hope you are doing well and that your microstock business is still going strong!

I interpret the answer from shutterstock as I have already written. The design studio seems to think they have acquired big opportunities for tiny money. If I were you, I would check what happens to the image in the future and intervene if necessary, if they might even resell it. Because the letter to you contains from my point of view that they are of the opinion to have a right to it.

I didn't read it that way. Sounds to me like English isn't their first language and they are just making sure that, having licensed the image for the ads, they wont have any pushback from him as the copyright holder. Could be wrong though.

Simply a company that bought a package with Shutterstock and that double-check that you are the owner and own the copyrights of the image they licensed and that you agreed to sell license through Shutterstock... just looks like an overcautious company, but in the end, it's a good thing that they consider copyrights to be important.
