Title: The Buyer sells access to mobile app with my illustration as a primary content
Post by: med_images on March 21, 2021, 09:21
Hello,
The Buyer sells access to mobile app with my illustration as a primary content.
All illustrations organized by categories, each category represented as a gallery with thumbnails and contains 10-80 my own illustrations.
This app contain big part of my porftfolio, 200-500 Illustrations or more...

As I carefully read https://www.shutterstock.com/license (https://www.shutterstock.com/license) this is violation of the rules. (RESTRICTIONS ON USE OF VISUAL CONTENT)
1.2.f
(Resell, redistribute, provide access to, share or transfer any Visual Content except as specifically provided herein. For example and not by way of limitation, the foregoing prohibits displaying Content as, or as part of, a "gallery" of content through which third parties may search and select from such content.)

After contacting team support I got responce - Buyer can use Illustration in apps. And that's all they answered me ...
I'dont got the answer about RESTRICTIONS ON USE OF VISUAL CONTENT 1.2.f.

Felling bad because support team doesn’t want to look through my request and doesn’t want to resolve it.

Please, give me advice about this situation ?

Sorry, you are dealing with this, those canned support responses that don't address the issue are infuriating! If this is definitely in violation of whatever license they are using (providing Shutterstock didn't make some special deal via a loophole in the contract) you may want to look into reporting the app itself to marketplaces distributing it, additionally filing DMCA with the company that makes the app and if no response you can also look into reporting it to whoever is hosting their sales site for the app if they have one.

Are they reselling your content from the gallery or just letting people view it. You aren't clear about how your content is being used. The same license that allows use in a book or a video would allow in an app, if it wasn't doing anything more then displaying your images. If they are relicensing file now everyplace you can get a lawyer and sue.
