Title: Yaymicro - Legal solution ideas
Post by: pracownik on November 08, 2016, 05:51
I also have a problem with yaymicro  - not correspond to the message, does not remove portfolio and do not pay. But they sell my pictures - I see them on the network with a link from them.

This Norwegian company. The company in the Norwegian register of companies - https://w2.brreg.no/enhet/sok/detalj.jsp?orgnr=992197137 (https://w2.brreg.no/enhet/sok/detalj.jsp?orgnr=992197137)

In Norway, it is very important honesty and truthful in business.
That is why I think that we can solve our problem on several legal ways, methods. These methods can help us.

Legal solution ideas - Let us write.

Important! Write in English. English is the unofficial second language in Norway

1. Write to Norwegian companies, blogs, who buys pictures from yaymicro.

We are looking for https://www.google.no/search?q= (https://www.google.no/search?q=)"Foto:+++yayimages.com "
We find our pictures and we send information - yaymicro not pays, does not respond. It is not fair, etc. Please remove our pictures, please stop purchases photographs from yaymicro.

2. Write to The Consumer Counsil of Norway
http://www.nyinorge.no/en/Familiegjenforening/New-in-Norway/Transport-and-services/Consumer-rights/About-consumer-rights-in-general/ (http://www.nyinorge.no/en/Familiegjenforening/New-in-Norway/Transport-and-services/Consumer-rights/About-consumer-rights-in-general/)

It can help us consumer rights and assistance in the complaint procedure.

The forms to send to The Consumer Counsil of Norway
http://www.forbrukerradet.no/contact-us (http://www.forbrukerradet.no/contact-us)

3. Report a problem on the Norwegian police.
Send e-mail to the department for Online problems
https://www.politi.no/kontakt_oss/kontakt_politiets_ikt-tjenester/ (https://www.politi.no/kontakt_oss/kontakt_politiets_ikt-tjenester/)

4. We send information via social media

What do you think about this methods?

I also have a problem with Yaymicro. How to Deal with Agencies which Refuse to Pay. (http://www.microstockposts.com/how-to-deal-with-agencies-which-refuse-to-pay/)

They do not respond to any email.
They behave like a company about to go out of business, yet they stay in business.

Have you tried contacting https://www.yayimages.com/ (https://www.yayimages.com/) which is the site they move clients/your portfolio to?

I just wrote to live chat support (http://messenger.providesupport.com/messenger/yaymicro.html (http://messenger.providesupport.com/messenger/yaymicro.html)) on yayimages, and they responded in 2 seconds, and they promised to delete my port / close my account today.
I will get back to you when it happens.

My account is closed, my images are not on yayimages anymore, and they promised to remove it from partner sites within a few days.
To be honest, this was one of the fastest response / action I ever got from a website, so I don't know how they don't respond to your request..

That's good to know, tried the same thing.  No idea why all sales, even on the 3rd party sites stopped.  They used to be a good site but I can't believe that huge list of 3rd party sites all stopped selling.  I'm uploading directly to one of those sites and get sales, so something is wrong.

My account was closed quite quickly.  I left them a few more euros but there was no chance of hitting another payout if they aren't selling anything.  Such a shame because they were doing better than some of the other sites I use at one point and paid 50%.  Another one bites the dust.

They closed my account in november of 2017. Unfortunately, I've seen my yay-port on agefotostock. Search yours by this link:

https://www.agefotostock.com/age/en/Search.aspx?providerfilter=YAY&author= (https://www.agefotostock.com/age/en/Search.aspx?providerfilter=YAY&author=)<your name>%20<your surname>
(you may avoid author)

Is there any chance to punish them?

13 days ago was the last time from many times I asked yay to remove all my images from there website/my portfolio.
I deleted them already one by one BEFORE that, but until now they are still online.

A little bit surprising was their last email:

# Hi

Yayimages had previous owners (2 years ago) that had sub licensed some content. We have not forged any new sublicensing partnerships because acquiring our own customers is more of a priority.

We can close your account if you like. It’s not a problem.

Can I ask which agency has the best model for you and the best sales volume?

Thanks.  #

1. I just uploaded my images a few month ago, so should not have any commection to the old subs he is talking about.
2. Could it really be a good agency, if they ask ME, a newbie in stockphotos with only a round 500 images there, which agency has the best model for you (me) and the best sales volume? That is a beginner question, isn´t it?
If I would have an own agency, I would look around and find out about my competitors BEFORE I open a new agency. Seem like Yay has indeed no strategy at all.

I just wrote Yay again and tell them to pressure them by regular report, if they started to remove my photos or not.
So I keep this thread on the top.
I hope, this works and Yay starting to remove my photos.

The other contributors, who have the same problem and even see there photos still online after closing their accounts years ago, keep on update here, too.

If Yay wants to get trust by contributors again, they should react and remove the photos.
It is little bit aggressive, I know, but I am not a shame to do it.

4 years!

Now hopefully people will believe that they won't reply to my emails after years and years. And no I never had any argument with them or wrote anything rude etc. They simply just don't reply. In the 14 years I've been in microstock, I've never come across an agency quite this bad.

Fast reply from YAY:

# Hi

This should have already been processed, as the index was recently moved to a new server and now has started to update every week. I'll investigate with IT today as to why the photos you deleted had not been removed.

Kind regards #

I keep you update

Why would anyone want to deal with Yay or trust them again?
Title: Re: Yaymicro - Legal solution ideas

As promised, here my last update about removing all images from Yay:

I just proved it today and YES, Yay DID remove all my photos as asked for and I can still log in in my account.

So it works at least if we push them many times to do it.

I would suggest other contributors should do the same, if they want Yay to remove their photos.

Maybe I will still use my account on Yay for my worst photos, which surprisingly getting accepted on several agencies. If they did not get a sale after one year - (who will wonder), then I upload them to Yay and Canva, where I do not care if i only get pennies or nearly nothing for it.
Another year later I might upload that bad photos on a free pic site, just to prove if indeed there are buyers out there, using them.
But I will use another profile name, because I do not want people know about my bad photos LOL

Hi,

I just wanted to give an update, regarding my images on agefotostock. They finally deleted them (after 4+ years selling my work against my will), and it was one of the most humiliating experiences of my life.

After YayImages just ignored me for weeks, and later misunderstood my request (fx. they wrote "Are you able to login to your dashboard and view sales?" when I clearly started with "I deleted my acccount in 2016..."), I contacted agefotostock directly. They also ignored me for some weeks, but then I was told, they have the right to sell my images, because they have a contract with Yay. They just did not believe me  :(

In the end about a week ago Yay finally contacted agefotostock and they deleted my images, but they also told me, according to Yay, I just contacted them recently about this problem (implying I am a liar) and they knew nothing about my account being deleted in 2016 even though I send them the e-mail confirmation from Yay (from 2016) in which they assured me to delete my images and that they also contacted their partners, agefotostock and alamy to notify them about deletion.

So now my images are not on sale anymore, but Yay ignores me again, regarding my earnings for the last 4 years. Very frustrating.

So my advice for anyone thinking about uploading to this agency: STAY AWAY!

agefotostock and alamy?
How can I find out if my images are online there?
You know, they removed all my images from my portfolio on yay finally, but we never know, if they also did it on their partner sites. So, I want to prove it.

How can I find out if my images are online there?
You know, they removed all my images from my portfolio on yay finally, but we never know, if they also did it on their partner sites. So, I want to prove it.

I accidentally found my images on these 2 sites and back in 2016 when I asked for deletion of my images from Yay, I also asked about partners, and they told me: "Most of our partners are connected via the API, so when we deleted your account they can't download the images anymore. The only exception are Alamy and Agefotostock, of which both have received notification of deletion."

I don't know how you find images on Alamy (maybe try and search for your Yay username on Alamy if possible) and on agefotostock you can try this:
https://www.agefotostock.com/age/en/Search.aspx?author= (https://www.agefotostock.com/age/en/Search.aspx?author=)insert your yay username here

Agefotostock also works with other agencies (fotosearch, that owns canstockphoto fx.) so after you find your portfolio you can hover mouse over the images and it will show you via which agency they sell your images (might be yay, or fotosearch or other).

I hope it helps.

BTW I just partly solved the problem, because my earnings for the last 4 years are lost, Which especially makes me angry, I deleted my portfolio because I did not agree with their conditions anymore, yet they kept selling my images for a very low price, keeping the whole profit for themselves. Like they were one of my really unfair competitions with my own images.

Thank you for your more information.

Alamy on agefotostock:
I found my own from Alamy and the ones I upload via Wirestock (smartphone photos) on the Alamy link from agefotostock. But I think, they were not upload from yay to agefotostock, but from Alamy to agefotostock. And that is okay.
Interesting: Little bit different prices, but okay! AND: My model released photos are only for sale in editorial. I checked again on Alamy and wirestock: Still model released = commercial.

My profile name from Yay on agefotostock doesn´t show any photos. So it might worked well and they do not (any longer ) excist there. Could be also that they did not get YET there, because I just upload photos on yay a few month ago. (Background: I wanted to support one more of the smaller agencies, which are fairer with the commissions, but less sales. Well, it is frustrating that even some of these agencies get worse for any contributor.

Today I got this reply form Yay:

"Ultimately it is your responsibility, not ours, to ensure the takedowns have happened. I am still investigating."

So, just so you know, if you delete your images from yay, it is YOUR responsibility to ensure that partner sites delete your images. Even though when you contact partners to ask for a deletion, they will tell you, they have a contract with Yay, not with you, so you should contact yay.

How convenient, right?

*UPDATE*
They told me, they have this in the contract, but their page of "Contributor Terms" is not working. Anyone has this contract so I can read it?

I've been following your writing to them, the closing of your account and they still don't remove your photos. But this is over the top stupid on their part. Your responsibility for partner site take down. That's what they are trying to claim?

Please ask them for a list of all the partner sites so you can write and have your images removed. I'd like to see what they say. No agency tells us where our images are, and now they claim it's your responsibility?

From the start I thought the name was stupid also the branding and the posts seemed unprofessional from the start. Now new owners or managers or maybe not, since others find the same people up top. Was that all just some lie?

Oslo, Norway good luck. Their website is down right now, no it's back, pages are 404 Not Found and others just don't exist or load. Flaky as all heck.

Yes, they are just telling me it is in the contract (that it is the contributors' responsibility to remove images from partners).
Unfortunately I can not check that because contributor terms page is not working.
I asked for list of partner sites and also this contract so I can read it. Maybe they are writing it now, I don't know.
This is a bad joke. :(

I have never seen or agreed to terms for the new site either.  I have never seen the contributor terms show anything but a broken link actually (and that's for many weeks since I found out they had my inages). This is a totally different level than usual agency "unfairness" or whatever. It is absolutely criminal IMHO.

They genuinely have a new (much worse) owner based in the US. He is Grant Baker, the company now has a shell based in Hong Kong, not Norway. I guess to either avoid tax, avoid being sued for all the copyright infringement, or both. You can find reps from new management on appsumo telling buyers they are fine reselling content they license on the site  as long as they get an EL for $1.71

I have closed my account with Yay years ago.
Courage, guys.

Thanks!
Me too.
Did you make sure they deleted your work from all partners? According to their non-existing contributor contract it is YOUR responsibility.
Partially. Didn't find my images.

Does anyone know all their partner sites?

This is part of the eümail I got back in 2016:

"Most of our partners are connected via the API, so when we deleted your account they can't download the images anymore. The only exception are Alamy and Agefotostock, of which both have received notification of deletion."

Unfortunately I believe that there are more now, but they refuse to give me the list, or the contributor contract so at least we can read that.

The Contributor Terms are finally available on their website:
https://contributors.yayimages.com/documentation/terms
It says nothing about the payment (if they pay or not after closing the account), and it also says it was last modified in 2012.  ::)

"YAY does not take responsibility if an image has been marked for deletion, and is still available for sales either on yaymicro.com or any partner site. It is the contributors responsibility to make sure the image has in fact been removed."

So it does say in the contract it is OUR responsibility to ask partners to delete the images (too bad their partners have no idea about this and they tell you they have a contract with Yay not with you as a contributor). Very convenient for everyone except the contributor.

There is also an other interesting part:
"Any dispute should first be attempted solved between the parties involved, if unsuccessful, the legal venue will be Oslo City Court."

But if they honestly do delete all your files, instead of leaving them up for sale on partner sites, that might be worth the gift of the lost earnings?

WOW, YAY!

In the first part Yay shows that to many contributor closed their accounts.

In the second part they show that they are looking for MORE photos which will be sold anywhere without paying contrigutor, because it is their own fault not uploading new images. And we know what Yay is doing with closed accounts: Still selling and not paying.

Here is the email i got and for sure many of you, too. Just to warn all sleeping contributor, who until now did not realise whats going on on Yay now.

Hello

You can find the full image/vector intake documentation here:

Please note that after the promotion has ended, as part of our effort to modernize the content of our marketplace, we will be deleting or cancelling accounts with no recent upload activity for the previous 2 years. This will be done at our own descretion. If you have not uploaded, submitted, and had a file approved during the last 2 years your account will be at risk of deletion, cancellation & any pending balance owed will be reset or forfeit.

Phew I don't come here much often now, and wow didn't really notice all this crap, I just noticed increased earnings from Yay. I still have the Skype contact of the ''new owner'' at Yay as I initially uploaded my portfolio on their ''new opening'' but I knew nothing about all this Depositphotos crap and fake partner sites. The way we see our earnings we have no way of knowing if the sales are accurate or where they come from. I sure never agreed to have my portfolio up on Depositphotos when my images are already there in the first place, so they are competing my own images!.

I'll contact them and dig into it but if nothing moves on my side I will take legal actions. If I go that way I'll let you know here in case we can voice our claim together

For now I contacted Depositphotos legal department and ask that all my images that are under their names be removed, and also contacted Yayimages about it. I am yet to receive and answer from Yay. I will give them a few weeks to respond then if no answer I'll send them a letter via a international lawyer from their own country to see if they take this seriously. That's the first steps I'll take for now in the following weeks. Will keep posted here on any development.

GDPR is a bluff mostly. The data sold and resold and real privacy is a fiction. But - who has a juridical education - please comment - can we employ these laws to ensure deletion of our content? The content, names and copyright are related.

They need to just delete the whole portfolio. It is clear that it is being run by someone without any permission or connection to the copyright holders of the images. YAY say they have no connection to the acount anymore!!

Hmm. I am not sure. 2.5 million is a huge number, they most likely won't want to since they accept whatever you submit because the company wants to increase the quantity of products on website and this will continue for a long time I believe. Only a legal trouble makes them think I guess, how and when, no idea.

I agree with this. Wow Yay said this? It means it might be from the old management of Yay and they kept those old account active without any payment... wow.

I contacted Depositphotos support as I have over 100k illustrations there and they say they are looking into it seriously and will update me. I sugged that anyone who see their images on the Yayimages account on Depositphotos contact their support with subject IMAGE STOLEN! and show a few example of your image and the duplicate image in the Yay account. The more support request they receive, the more pressure they will have.

In any case if nothing moves on Deposit then we can have legal action there also, but I think just having a lot of pressure on Deposit to remove this account should work well.

Thanks for doing this. Deposit answered me... and removed the 2 images I used as reference, but I have THOUSANDS of images there.

Also someone pointed out that Yayimages says they do not have any links to this portfolio anymore. That's a lie, as new management was there when my images we're uploaded. You can notice the UPLOAD DATE on the Depositphotos page, some of mine are there since Feb 11, 2020.

I am now writing a last email to Depositphotos to request not only that they remove my image, but that they CLOSE the account altogether. How can they think it's satisfying to have image per image removed when that portfolio been making money on our back since a while. I will give them 7 days to close the portfolio.

I prefer not engaging legal fees but it would be really stupid on their side to keep that portfolio live to the public when it's clearly stolen work. What is funny is that I point my images on my portfolio, then the stolen image on Yayimages, and they act as they protect the thief and only remove the image. Other agencies would outright close the portfolio and have no tolerance on copyright infringement. :-/.

No they are not… I sent you 2 reference images. There are THOUSANDS of my images there. There are also many other contributors who reports the same thing in a forum. You should close this portfolio altogether. The Yayimages agency also reports that this portfolio is no theirs, so this is clearly stolen work that no contributors are getting paid for.

You do not seem to take this seriously. I do. It seems you are looking to protect the thieves AND let them have our money, for years! I give 7 days to REMOVE the Yayimages thief portfolio before I engage legal actions. I also request that you return the earnings that have been stolen to the right contributors. I have reports of other contributors also contacting you about their stolen work, and you seem to be hand in hand with the thief by protecting them. If so then you will face the same legal actions.

Shutterstock would have done legal action AGAISNT the thief, Adobe Stock, iStock… all other agencies also.

Do you really want me to send a list of at least 20 000 of my stolen images in this email… It’s pretty easy. Click my images in their portfolio, then my image is in the Similar Royalty-free vectors section… Here we go…:

And thousand more there also!

If you want me to send the exact list of all my stolen images I can ask a programmer to scrape your site and send you the list of all the COPY/DUPLICATE files with the same title/filename but since you have millions the scrape will work long. I will charge you 500$USD for this work to be done, plus my time to work on protecting my images when that is supposed to be the agencies work.

Waiting for a serious response this time.

And the list goes on and on. Same with my color vectors:

And thousand more there also!

If you want me to send the exact list of all my stolen images I can ask a programmer to scrape your site and send you the list of all the COPY/DUPLICATE files with the same title/filename but since you have millions the scrape will work long. I will charge you 500$USD for this work to be done, plus my time to work on protecting my images when that is supposed to be the agencies work.

Waiting for a serious response this time.

Your e-mail is spectacular Morphart. I mean you explained everything with all following-actions as if you explain to a kid :) I hope they take this seriously after this pressure. And really funny that they only delete the individual images after being asked. What kind of logic is this doh!

They will pull the cat's tail as long as possible because they earn money from these files.

Yes but they'll earn money in any case as most of those files are duplicates for those who also have an account on Depositphotos. Won't change much for them. In any case, it's copyright infringement and not legal, not as if they have any choice.

The ticket is replied by Depositphotos, and it is very very interesting.

Here it is:

"Hello,

Following up our chat, please be informed that YAYImages is a photo-stock (similar to ours) and our API partner. All the files that are uploaded to YAYI image are uploaded to our photo-stock too. As an author, you receive royalties for each of your files that we sell. These royalties are paid on behalf of YAYImages. We may take down your files per your request, however, it will affect your overall sales & royalties.

Here's my answer:

"Hi,

I am not sure if you are serious or making jokes about this. We are saying that they are thieves you suggest to delete 1-2 photos. Do you really continue to do this? And do you really have such ethics? If so I am really ashamed to be your contributor so far and will give up.

As to Yayimages, I think the only solution is legal actions against them and you, otherwise apparently you won't care.

Best wishes"

I've only a small portfolio on Deposit. This Yaymicro issue is news to me. I'll go searching it now.

Here is the last answer I got from Depositphotos:
Quote
YAYimages is our API reseller and we are reselling their images on our website. To get information on how you get paid for your files which are sold on our website, please get in touch with YAYimages.
Currently, we are working on removing duplicates that are provided by our API partners; however, it takes more time than expected.

On our side, we can only have your files to be removed from the YAYimages portfolio. However, we do not control your payouts or your uploads on YAYimages

From what I understand is that is the image I found in that portfolio is OLD Yayimages portfolio (before 2020), I do not find new images I uploaded to the new management after march 2021. So for me if they remove the duplicates it will remove my files from that portfolio. It's bad for all other contributors that are getting their earning stolen, but I can't ask the same for other contributor, seems everyone needs to ask Deposit to remove their (photo (link per link...)) or if they have an account on deposit, ask that they remove the duplicate files found in the Yayimages portfolio.

As for Yayimages, I have no contact with them at all. I see the earnings are not getting reported anymore which is concerning... Will try to get an answer from them and know what is the list of all those API partners and get my image removed from their site (Yay)

Guys, have you seen this? It seems Deposit prevents Yay transactions currently.

I randomly checked many images. Each shows this warning.
