Title: We can not Delete your files from DP.

Hi all,
After working nearly one year with DP. I decide to deactivate my files and delete them from DP.
When i ask them to delete my file they told me they can not delete my files it will stay deactivated . She told me that its writing in their rules. ???
And her message is:

Dear Ayzek,

thank you for the quick response.

Unfortunately,
these are our rules, and they are equal for all photographers. As I've
mentioned earlier, your photos can not be deleted, they have to be in
your account for the statistics, and they are not visible for visitors
and customers.  

We will deactivate your account, but in case you
change your mind we are always open for cooperation.

Now they deactivate my account and i can not reach my account. Also they are not deleting my files.
Do they have right to do that. >:(

Oh dear. Saw this coming but still a kick in the teeth.  Can't find anything of the sort in the illegals. In fact section 7 says all your images will be deleted if they terminate so clearly they can do it and I would think are legally obliged to do it if you ask. Good luck getting them to do it though. The contract is full of "we can do what we like" clauses

Yup.  When you go to your files there is only a deactivate option, not a delete option.  If they want to gain some credibility they will address this and engineer a way to actually delete files.  Having them "float" around somewhere scares me.

I'm sure I've come across this elsewhere. Isn't it standard for agencies to keep at least a thumbnail for their records? I assume there is some legal reason for it, though I don't know what it is. As long as it stays buried in the archive and nobody can access it, I don't see it as a problem. But, of course, that depends on you believing that the agency will behave honestly.

The reason is for statistic of my acount ???
if they close my acount why do they need to keep my images for my acount statistic?
They can keep file id for the statistics.  they dont need my images for closed acount statistic or their statistics  :(

i remember that there were delete option 6-7 month before in deactivated files page. So they change the rules without warning.

they might have some internal cooperate IT-ish reason, but it doesnt hold water.

The system always has to be working with the laws.
Else it begins to smell of abuse and Nigerian scam.

But, of course, that depends on you believing that the agency will behave honestly.
If the agency  was dishonest they could tell you they have deleted the images and not delete them.  That's the risk we all take when uploading images to sites.

Bad news. Another point I will take into account .. I am currently thinking of stopping to support them too. Mainly because they are too cheap.

But it IS funny how flaws in IT systems always work to the benifit of the agency.

Think cell phone and internet suppliers.
They are all so full of S***, and the money always flows in their direction in case of doubt.

I found out the hard way as well...I had my account closed about a year and a half ago, then at the beginning of this year they seem to be doing better as far as sales, so I contacted them and ask to have my account re-instated again, to my surprise all of my photos where still there as well as some money from sales that had accumulated while my account was closed.
My advise is, stop uploading new photos to the site, but keep your account active so that you can keep track of any under the table type sales, otherwise you'll never know if your deactivated photos made some money.

Glad I could be of some help to you guys :D...is like checking in to a hospital and coming out -1 kidney, just cause, they need it to prove you where there, and besides you may need it at some time in your life, so they want to hold it for you. ;D

Hi,
I'm sorry, but we're all different.
I don't think Deposit Photos is 'small' anymore, I don't think they rip me off more than other sites (IStock for example), and I don't mind them deactivating my images instead of deleting them.
It's a feature that in my opinion has the potential to come in handy at some point.
I do not worry about Deposit Photos being somewhat shady, illegal or looking to grab my images and run.
In fact, I like doing business with them.
Solid, good commissions, growing sales and easy to deal with.
There you go.
As I said, we're all different :)

actually other agencies can say they will remove our pictures but in the end how can we be sure of that? will we get into their servers and see for ourself?

honestly I don't see a problem with having files deactivated

What's  your problem? You asked them to reactivate your account, now they have 30 days to remove the files within the rules.

The question is, how will you know whether they have deleted them or just deactivated them? Are you going to try to get a court order to search their database once the files are no longer visible?

You really are building mountains out of molehills over this.

With a little bit of patience, they will do it. Once, on a particular agency, I got my images deleted after 24 hours of being online. On agreement they would be deleted only after 6 months...

Anyway, even without regular sales ( yet ) on DP, it appear to have some potential. Dunno reasons behind Your decision, but probably You haven't nothing to loose have Your account online.

We didn't all change our opinion.   I never did go with DP as I still feel uneasy about this agency in spite of others' success there.  Each to his own though.

I'm speaking about "general opinion".. not anyone particularly.

But I see that as an "positive mind change". If people trust more on DP, maybe they understood how DP it's safer as any other agency.

Personally I don't think folks change of hearts is a matter of trust, but a matter of sales, hey business is business and you have to go where the money is, even if at times you have to work with with people/companies that you trust only as far as you can throw them...  ;)...that pretty much covers all agencies big and small IMO...

I think there is some misunderstood. She just understand wrongly or missed to explain something to me while she were telling they can not delete my files.

I don't mind deactivating instead of deleting. It gives you an option to come back if you change your mind. I'm new at DP, but I think they're fine. If communication is problematic just make sure they understand what you need to do. I don't think there's anything wrong with their legality.

It's not legality per se, it's scumbaggery.  I am guilty.  I am with them and nothing pisses me off more than a broken promise of them saying they would promote my port if I signed up with them.  Now, I never believed them, but I took the chance anyhow.  I am in that zone in which I get a lot of 30 cent downloads but not much of anything else.  Personally, DP and PD are two really loosey goosey sites.  I drank the cool aid.

Yes, most of my sales generate 30c too, but then SS is not very different in that respect. I think that in the long run this price war will hurt the entire community.

The vast majority of my sales are 30 cent downloads, too. I stopped uploading a few weeks ago, the payout is just too low.

60% out of my last 10 downloads at DP were credit sales which may not be typical for many.

I have a good 1100+ images on there and easily get a monthly payout.
