Title: 1099-MISC
Post by: MartianOtters on February 19, 2020, 07:59
I have had some pretty poor experiences dealing with the Adobe help and tax teams. I never received my 1099 this year and attempts to contact the tax team are met with either them ignoring me or telling me that they are working on a system so you can download the form online for next year. When I contact regular Adobe help, they tell me tax forms were sent out in January, immediately close my case, and send me a survey asking how the service was.

I was originally a Fotolia contributor, and as of last year they were still listed as the payer on the 1099. But I have no idea if this is still the case. Does anyone who was originally with Fotolia know it is now Adobe on their forms? And if so could you provide me with their address and TIN? I know exactly how much I was paid, so with that I can file taxes. Thanks!

Hi Martian,

Unfortunately, we don't have access to your tax form in customer service. You will need to go through the tax team directly as advised. As you can imagine, they are pretty busy this time of year so response times may vary. Sorry for the frustrating experience and thank you for your patience!

See that's part of the problem. No one even attempts to answer any part of my inquiries. I don't known how many weeks or possibly months it will take to get a response from the tax team, but there is a legal responsibility to send out these forms on time.

Yeah, thanks. I knew that because in January I contacted regular Adobe help and they said I should've received it and to contact Adobe Tax. I did and they said there would be a portal to download it next year! I've sent them one email a week for the past four weeks, and no one has ever responded. Regular Adobe help is just as useless, though they always respond, even if it just to say I should've received a form by now, contact Adobe Tax, and that they have no way themselves of contacting the tax people.

If I don't receive one by the end of the week, I'll be calling the IRS and they should hit Adobe with a fine for this.

Did you move in 2019? If so, did you update your tax form to reflect your new address? The tax team will get back to you but they are quite busy.

Thanks for your patience,

No, I did not move. And yes, the information on the w9 is correct.

Thank you!!! With that I have all the info I need and can at least have some confidence I file things correctly if they never respond.

Well, as far as I know, the W-2 form applies only to wages earned by those who qualify as employees.

adobe tax team not responding to my emails as well for months.

my problem is in 1042-s form (or signed letter they sent last years) they have to provide based on federal law, but they don't and their terms of use or those FAQ are against the federal law also:

The country where I reside requires Adobe to provide a "1042-S" Foreign Person’s U.S. Source Income Subject to Withholding. Can you provide this form?
Because of a special agreement we have with the IRS, we don't issue forms 1042-S separately to each contributor. However, we can provide a signed document that includes earnings and amount of withholding via email on request. Please email us at [email protected]

now read this:

Every withholding agent must file an information return, Form 1042-S, Foreign Person’s U.S. Source Income Subject to Withholding, to report amounts paid to foreign persons that are described under Amounts Subject to NRA Withholding and Reporting, even if withholding is not required on the payments. Refer to Amounts Not Subject to NRA Withholding and Withholding for payments that do not require withholding.

A separate Form 1042-S is required for:

Each recipient regardless of whether or not you withheld tax.
Each tax rate (if you withheld at more than one tax rate) of a specific type of income that you paid to the same recipient.
Each type of income that you paid to the same recipient.

from IRS: https://www.irs.gov/individuals/international-taxpayers/who-must-file (https://www.irs.gov/individuals/international-taxpayers/who-must-file)

and plot twist here is: payments are made from adobe Canada ;)

if I dont get respond this month I will go to media with all information and evidences I have.

they don't give me any choice.

complete mess
