Author Topic: Suspicious website offering Fotolia images??  (Read 5188 times)

I noticed this site offering derivative products from Fotolia images -- looks like they scraped the whole site, because all of the images have Fotolia watermarks.   Fotolia says they're not a partner site, and that in order to sell these, they would need to buy an extended license, which they haven't on any of mine (nor for two other Fotolia people I checked with whose images are here also).   Fotolia has been notified (the only guy that deals with this was out of the office for the week), and the website company hasn't responded to two emails. 

Does anyone here know anything about this site?

Which of the two? Fotolia has said they are no partner or Fotolia has not responded yet?

To me that looks like one of their many API partners. They do allow print on demand through their API, and we (allegedly) get a regular license for each sold print instead of an EL upfront (and nothing for subsequent prints).

Fotolia responded and wrote "they are nor resellers of Fotolia, it seems they are selling derivative products such as canvas and wall stickers with those images.  Note that in order to do so, they need to purchase the files with an Extended RF license."   Then they asked me to send a DMCA complaint notice to them (Fotolia).

Some of my images on there too, with identical keywords as on Fotolia and with the Fotolia watermark. Interesting!

Im fairly new to this with only 150 files at Fotolia, and I too have found several of my files on this site with no extended licenses purchased from Fotolia.

One of my files that I found on Vimago has not even sold on Fotolia. How is that possible?

MY files and my partners are there too. Seems a bit blatant to display images from any agency with the full watermark still there if they aren't a "partner" of some kind.

They had one of mine on their site literally the day after it was accepted by Fotolia.   :(      If you find one of your images, then down on the lower right side of the page there is a tab marked "Author Portfolio" where they show other images.  However, I've found a whole lot more than what is in that tab, and it does seem like they have the entire portfolio.

How do you know sales aren't showing up?  If it's an API then you get paid when they sell one of the products not before.

How do you know sales aren't showing up?  If it's an API then you get paid when they sell one of the products not before.

I quoted Anthony who found images with no sales on FT.  But now I see what you mean.   If it didn't sell on API it would not show sold on FT.  Must get coffee to clear cobwebs from my brain.

I appreciate the response Mat, and your checking into it.  I have to say though that I'm really disappointed with the other people at Fotolia for not knowing this (or not thinking it important enough to look into) when it was first reported a week ago.  Thanks for the info!   

One other question though, the original person at Fotolia that was asked about this said that an extended license was required to be purchased to sell such derivative works.  Does the fact that they have an api key change anything about this requirement?

They don't need EL beacuse they're not re-selling photos. They are selling it on behalf of fotolia.
