In the US copyright infringement is a "pure tort" which basically means that ignorance is not a valid defense.  The situation in other countries is probably very similar.  So the direct answer (under US law) is both the designer and the commissioner.

I'll dig up some references if there's any interest....

This would be Canadian Law, though of course he could have hired a web designer anywhere.
Don't go to any trouble, I just wondered if anyone knew off the top of their head.

Maybe the photographers could hire their own antipiracy enforcement firm to collect from Canipre?  ;D

Maybe they/their designer read that Virgin thing where they used a Flickr CC pic without attribution but the case was thrown out of court on a stupid technicality, and thought they could get off with it the same way. Though some of the pics weren't said to be CC, and of course it's still morally wrong.

Karma, man, Karma.  It reminds me of the Righthaven case which was even more ironic because RightHaven was operated by a bunch of lawyers who ultimately ended up facing a judge who had no patience for them or their incompetence.

Hand the matter to ImageRights, especially if the image was registered with the US Copyright office....
