So I looked at my Nov. earnings from Getty in the Portal before they turned it off. I had earnings of $1,122.00 and no red returns on that statement! I just got an email from them that said that $1020.00 are returns so now I owe them $1020.00 and they will deduct that from my future earnings. I can not go back and pull that text file to prove it so I am just shafted. These were Premium Access sales. So 98% of all my Getty PA sales are returns for the month of Nov. 2016!
-
Sh*t
-
Make a fuss. Tell them you believe they've made a mistake, and demand an itemized list of the returns with file numbers and dates of sale and refund. Worst case is that you're in the same situation you're in now.
-
Oh I have, they won't budge. From what I saw on the first statement and what they sent me which is pages longer it does not match. I can
not prove it as they asked me too so I am out the money.
-
If you look at my sales history I have never had 98% returns in fact over the last 10 years I have had only 10 returns!
-
Yes the returns are more then earnings nowadays! Crazy!
-
In another year I hope to pull my entire port from them!
-
So sorry to hear. I'm glad so many people are pulling their ports.
-
That is such bollox! Disgusting!
I'm furious and speechless on your behalf!
What a shower >:(
-
To top it off, I went around two months with them to get my Nov. payment, they looked into it and paid me. You would think they would have
caught on then!!!
-
What a p*ss take. They have a history of misreporting royalties. When the mistake is in our favour they can just hold onto our future earnings. When it is in their favour I guess we usually wouldn't know given how reluctant they seem to be to investigate. It's infuriating.
I hope they sort it for you eventually but I wouldn't hold my breath. They probably don't have the staff to look into it.
-
Not holding my breath I know how they operate! worst company to deal with!
-
Not surprised... really. I wonder if all the Exclusive even have a tiny clue what kinda company they are supporting. Almost the same as if you would support slavery and been proud of it.

Please stop the slavery analogies bad as Getty might be its offensive to compare it with slavery in my opinion.

Yes, in my opinion "mafia" would be a better analogy.

That really stinks.
Have you asked around to see if other contributors have had this happen as well for the November period? If a number of contributors have had the same "surprise" and band together to protest an insanely high level of refunds (something that doesn't fit with historical patterns in a major way), possibly it might make a difference.
The other type of pushback that might work is insisting that they provide you with records that they have taken offline (they have to have records internally for accounting and tax purposes. The fact that they've taken away your access to it doesn't mean the data isn't there any more). As long as you're careful not to libel them, suggesting that it's more than coincidence that the large returns number was paired with removal of records, rendering contributors helpless to dispute a hard to believe claim.
When have you ever - or any other contributor to this or another agency - had returns that were about 90% of the month's take? That just beggars belief, doesn't it?

Actually this is a form of slavery or "Debt bondage, also known as debt slavery or bonded labor, is a person's pledge of labor or services as security for the repayment for a debt or other obligation"
JJ is in fact a debt slave until the $1020 is paid off!
P.S. I find it funny you get all forthright about "slavery" comparisons but not so about Getty shafting JJneff
-
Yeah I do sympathise but what I say hardly makes any difference but if you really think that a financial dispute with a predatory and exploitative company is equal to being deprived of your liberty, being the property of another person and being forced to undertake heavy and often life threatening labour then you need to get a sense of perspective.

Offensive ? offensive ? woooooooaaaaaaw, reaaaaaaaly ? Offensive is the way getty treats his contributors like s*it. I for example have not been able to log in to ESP for more than a month and after writing mail after mail and receiving the same dumb answer : we are sorry, try again, we are sorry, try again, It looks like you are stuppid, try again . I have no access to my statistics. JJNEFF just lost 1000 dollars, wake up people !!!!

Far from me to be an iStock/Getty fan, and I feel for jjneff, despite our disagreements on other issues. I agree with him, when he says that iStock is the worst!
But, please remember that slaves had no option to quit.
On the other hand, we all are free to take it leave it! Or to sue, if we are not happy with the way we are treated!
Major difference!

He's not saying what istock did to JJNEFF is okay, and he's not saying the way they treat contributors is okay. Just that it is ridiculous to compare it to slavery, which was an atrocity and major human rights violation. Such comparisons minimize the suffering of generations of people. Get a grip on yourself Vladdy old boy.

Truly sad to hear this bit of news JJ, that is just despicable
Microstock is a rat-race, and the rats are getting bigger!

And yet jjneff is willing to keep his port there for another year. This is nothing like slavery...people have known what kind of bad business this company engages in and yet they keep doing business with them! You are right about one thing...wake up people!!!!

I never said slave of anything! No it is not even close I have great respect for those to fought and died for freedom of all men. I may live in the south but
could not be happier the North won the battle and I will never fly the Dixie flag as to others it offends. I can leave Getty anytime and I am not alone in being
treated like this. I just want to give others a heads up in case they also run into the same issue. They have not responded to my latest e-mail for more documentation and my history of refunds!

No you definitely weren't one of the ones making that comparison.
What Istock did in your case was terrible. I doubt many of us could afford to lose more than a grand overnight. The fact there is no credible proof of why they took it away makes it even worse. I hope you are able to recover it, but knowing istock I doubt it. Might be worth starting to upload to other sites so your ports can go live if or when you drop exclusivity. A lot of former exclusives say they are making more after a year of being independent.
Best of luck whatever you do.

To be clear no way was I referring to your post. I was commenting on other posts where comparison is made Mstock practice with slavery in this and other posts. Sorry to drag the thread OT.
-
I am non-exclusive now for about a year! I had enough abuse as an exclusive!
-
In another year I hope to pull my entire port from them!
I sympathize with you but for years contributors have been complaining about them on this forum. I am really not surprised they are ripping you off...seems to be the trend nowadays, not just with microstock but with a lot of companies.
If you continue to leave your images there, arent you basically just saying you are ok with whatever they do?
I know you didnt make the slavery analogy, my previous comment was directed towards those who keep using that. Slaves never had free will...everyone here does.
I hope you get this straightened out and I hope you get your money...and then run as fast and as far away from them as you can! Good luck.
-
Yes the returns are more then earnings nowadays! Crazy!
Happened to me too. A new way of screwing contributors. I won't upload there again.
-
The more abuse like this that contributors tolerate from those bass turds, the more they will be emboldened to dish it out. So glad I fired them months ago.

Why not sue in small claims? Seriously. Force them to either show up for court in your town or hand over the documentation. There are no attorneys in small claims, AFAIK.
-
I would leave and give them the headache of trying to get the money back. If they request payment, ask for details of why a positive balance turned in to a negative one and see if they come up with anything. I doubt they can force people to pay and not show them how their money vanished. Is there an arbitration service in the US? I think an independent 3rd party needs to look in to this.

The Getty contract has (or used to have) an arbitration clause. I think that precludes going to any court for any claim relating to money owed.

there was never a swarm that tried that. Only a few do that.
The contributor scene has no power that is the problem.
Remember the Fotolia/Dollarphotoclub action. It is possible to punish greedy Agencies.
But if you only post, crying and unmotivated you will change nothing.
Sometimes i think the contributors have lost all her creativity by producing new images.

Wouldn't they still have to show up to make the case that the clause was in the contract? Terms aren't always enforceable anyway.

To do it you would probably have to leave them and if you did whatever is in the contract they are not above the law

Never is a big word for someone who has been at this for just about 3 years. I'm guessing you weren't here for istock D day (deactivation day). It was a big deal. All your suggestions were tried at once by a large organized group of contributors. Many thousands of images were deactivated and a lot of people closed their accounts altogether. Buyers were contacted, tweets went out, bloggers wrote articles about Getty mistreatment of contributors, the works.
Yet here we are a few years later Things are way worse on istock than ever. The only good to come from it is that the people who closed their accounts are free of the abuse.
You're welcome for the history lesson. ;)

I do think istock has lost a lot of buyers because they were competitive with SS in the earnings poll here for non-exclusives at one time. Would be good if they lost more and I think if that will happen over time.

jjnef,
This still works for me. Here are two links that were posted in the main ESP thread: http://www.istockphoto.com/user_stats.php?Offset=0&DownloadsGraphFileType (http://www.istockphoto.com/user_stats.php?Offset=0&DownloadsGraphFileType) and www.istockphoto.com/user_stats.php?id=000000&Offset=-1&DownloadsGraphFileType (http://www.istockphoto.com/user_stats.php?id=000000&Offset=-1&DownloadsGraphFileType).
Both links work for me. They both take me to my "Daily Statistics" page on the original iStock site. I can then click back to previous months in 2016, although I don't know how far it'll allow you to go back. Click back to the month in question (November, if I'm remembering correctly). Once on that page, click on the little square box right next to the "Daily statistics" graphic. This will allow you to download a CSV file with all the sales data for that month intact; it's all still there. I just tested it to make sure, and the CSV file had all my November sales including Partner Program and Subs.
Hope this helps; don't know if it'll show your premium access sales.

Agreed. They have lost a ton of buyers. Some because of contributors efforts and some because they treat buyers almost as bad as contributors. We'll never know how many we persuaded to leave but I hope it was a lot!

Let's do it

So I looked at my Nov. earnings from Getty in the Portal before they turned it off. I had earnings of $1,122.00 and no red returns on that statement! I just got an email from them that said that $1020.00 are returns so now I owe them $1020.00 and they will deduct that from my future earnings. I can not go back and pull that text file to prove it so I am just shafted. These were Premium Access sales. So 98% of all my Getty PA sales are returns for the month of Nov. 2016!
How many pictures are in this refund story?
-
What a crap move by Getty. If I were you, I'd leave immediately, let them worry about the 'debt' you have with them, if there is any.
The way they conduct business, and even make old statistics inaccessible is a joke and highly unprofessional.
Best of luck!

I bet they wouldn't let him leave until the debt is paid off, regardless of the 30-day notice. But my guess is that JJNEFF only takes a week to accumulate a grand so probably a moot point.
