What would you do if Bob Dylan used your photo as source material?

Very interesting.

I've been always intrigued by the fact that the famous Marilyn artwork by Andy Warhol was based on a photo that was not taken by him. Did he get an authorization for that? The original photographer was never credited, as far as I know, nor the studio (it was a photo used to promote a film).

Well, the Cartier-Bresson Foundation is big enough to sue and Dylan is big enough to be worth suing, so I suppose we just sit back and watch. At least he seems to be very well-read and artistically informed.

I just remembered this:

http://www.indianexpress.com/news/bob-dylan-bryan-adams-file-copyright-case/834244/

Dylan is first up in the queue to defend his own copyright he just seems to be less interested in respecting other people's. Perhaps his old album should have been titled The Freestealing Bob Dylan. This isn't the first time he's run into trouble over copyright.

I especially like this part:

Quote
a press representative for the Gagosian Gallery said in a statement: While the composition of some of Bob Dylans paintings is based on a variety of sources, including archival, historic images, the paintings vibrancy and freshness come from the colors and textures found in everyday scenes he observed during his travels.

So anybody can copy anything from anyone, as long as it changes colors.

That's hilarious, I notice they didn't say that before he was caught out.

I guess we could claim our few micro dollars.
It could be more lucrative if he 'borrowed' the image from a personal website.

Looks like everyone can cover his songs (sell them on stock audio) as long as they add their own vibrancy and freshness from everyday scenes they observed during their travels.

Just imagining the tick box

Do you confirm that the audio you are loading is entirely your own work and you hold copywrite or have you added your vibrancy and freshness ?

Were the scenes you observed whilst travelling everyday ?

He must have learned from the words of his master:

This song is Copyrighted in U.S., under Seal of Copyright # 154085, for a period of 28 years, and anybody caught singin it without our permission, will be mighty good friends of ourn, cause we don't give a dern. Publish it. Write it. Sing it. Swing to it. Yodel it. We wrote it, that's all we wanted to do.

They should have been smarter and claimed it was 'parody'.

Dylan has always been aggressive about taking what he wants for his music, so why not art? In Scorsese's film "No Way Home" about bob Dylan, Dave Van Ronk tells a story about how Dylan covered House of the Rising Sun with Van Ronks phrasing and arrangement, which was quite different from the original, on his first album. Dylan asked Van Ronk if he had any problem with him recording it for his album. Van Ronk replied that he would rather Dylan not use it, because he was planning to use it on his own album. Of course, Dylan had already recorded it and it was about to be released, so he just kept it on the album anyway. Later, the Animals also recorded the same version, which became a huge hit. After that, Van Ronk and Dylan both had to stop performing the song, since everyone thought they were ripping off the Animals. Personally, I'd be flattered if Dylan used one of my photos. To my mind he's earned it.

Eh? Being a famous singer earns you the right to copy people's pictures? Some people's "logic" is way beyond what I can follow.

Absolutely lame of Dylan to pull this one off. Pissing on other people's creativity to make himself look good is very low level.

As mentioned in the text he wouldn't even bother to change perspective etc. another indicator he has no painting/drawing talent whatsoever.
It's a flat copy with colors - whoopdidoo.

Just fecking apologize and respect other artists' copyrights.

Any stock agency would have kicked him out for uploading works like these. Enough said.

It's tricky not to be influenced in some small way by your reference material (if you don't shoot your own), but he didn't really even bother to try to deviate from it.

on a side note, why should all musicians eventually turn into painters, writers, et c...?

just because they are great musicians (Dylan undoubtedly is), it doesn't mean they're good at everything

they will of course say that painting was their passion even before being famous, but that doesn't mean we actually need to see their work in art galleries worldwide

Funnily enough, in Scotland at least,  there's a surprising number of muscians and actors who first went to Art School.

Bob Dylan gets a pass with me because of the many hours of enjoyment that his music has given me. I didn't say "people's pictures", i said "my photos". It's not logic, it's just my point of view on this particular artist. The reunion tour with the Band in 74 was one of the high points of my life. I sat in the front row center, and I'll never forget it. I would be hard pressed to name another artist that I would have that point of view about- maybe Jerry Garcia if he was still around.

THIS is your justification to infringe on someone's (in this case, hypothetically, your) copyright?

You paid for the tickets in the first place right?

He didn't invite you over to his place or knows you by name?

I'm lost.

No, i was on a press pass for the Washington Post. It was a great time, he's a great artist and he can have any image of mine any time.  It's just a photo. I've got lots of those. Sorry if this bothers you, but to me it's just not a big deal.

No need to apologize - I wonder if Dylan felt the same way if you used any of his songs/lyrics claiming it was yours. Just saying.

Yeah, we all have our heroes (me too).

I think I would prefer to be consulted.  Do you think your attitude would change if it was Kei$ha or Gene Simmons or Garth Brooks?

I think it would be flattering to be copied by (insert your own hero here).  i.e. a reproduction for personal use, or a practice canvas to improve craft -  but to put on public display (and presumably for sale) without acknowledgement - OUCH!

@ click_click-  I'm no Bob Dylan, as a musician or an artist

@ Pixart-  Just Bob Dylan. Those others you named aren't even in the same universe ( IMHO, please don't flame me, all you Kei$ha fans  ;D )

LOL, I'm guessing there aren't many Kei$ha fans on MSG.
