hehe, never mind, it'd be way of a bad sign if i weren't teased anymore. :) do you speak italian?
Not really but in weak moments I like the kitsch drama of the Verdi operas. (sorry for the off-topic).

1202
I thought you wanted to use something with your own web hosting.
La donna mobile.  ;)
hahaha, vero, molto mobile......
Sometimes I like to tease. You catched the ball well.  :P

1203
So actually only about 40 photographers will profit from the offer.?
No, everybody. But the preferential treatment is for 39 photographers and, you. ;-)
I'm just worried about their transfer of copyright clause. You don't need to transfer copyright, you just need to license the images to them for sale, against a commission. All rights stay with you as author, included the droit (not "droite") de suite.

Compare the copyright clauses with those of Dreamstime:
Quote
By uploading his/her Image, the Photographer is warranting that he/she owns all proprietary rights, including copyright, in and to the Image. ...
The Photographer hereby grants Dreamstime a non-exclusive license to post the Image on its web site and to deliver it to its audience, affiliates or other representatives, through different media channels, and further grants Dreamstime and its representatives the right to sublicense the Image to their customers in accordance with the terms of the Dreamstime Royalty-Free License Agreement. ...
The Parties agree that all rights, including title and copyright, in and to the uploaded Images, shall be retained by the Photographer, unless otherwise mentioned by the license agreement.

1204
It`s the same like in every other agency. You don`t gives your copyright away, you just gives us photos for selling. We are not interested to hose photographers, zoonar is a fair agency.
In that case you should adapt the English terms on site. Scripta Manent, Verba Volant. I will register anyways, since the original English phrasing apparently is a mistake.

1205
I went ahead and registered and was reading the Photographer Agreement and the following bothers me.......are you giving away your copyright or is it the translation from German.......and what is " droite de suite"

Droit de suite only belongs to the copyright owner, and it means that additional income will go to him, not to the/any agency. Read the Millet case here.
In fact, as stated in their clauses as you quoted them, you will transfer your copyright to them, so of course they are entitled to the droit de suite. In fact, you will commit copyright infringement when you let your images on other sites.
They should clear that out, since they probably copy/pasted the English text from some auction site.

I hate to say it but the fewer microstock photographers there are, the better my sales will be.  It's actually kind of idiotic to post things that make people want to do this job more.
Glad you finally converted to the Locke-doctrine.  :P

1207
I'll let sjlocke chime in on good exposure techniques on iStock. <insert winky face here>
The honorable gentlemen Locke has always been very frank on why he doesn't like to educate competitors.

In respect for the OP who seems to be a top photographer, judging by his work, and with top models - I should complement the Shutterstock strategy by hammering on diversity in every upload batch. As new images are exposed prominently for a short period, you shouldn't upload a row of similars in one batch, but add some different content. This way the halo effect of your new images will be maximized over your whole portfolio.

I'm still waiting for the iStock strategy though. Does anobody knows what are the working hours of the rough feathered guy?  ::)

Sales at 123Rf picking up for me. Does someone else noticed it?
Not at all, it's much worse than March. But since my numbers in general are so low, they fall in the statistical noise zone. Statistically spoken, anybody with less than 1K$ monthly revenue from stock and a port under 3K photos or 1K illustrations should not comment on trends. No comment.

1210
Excellent analysis, Sharply, and well written.  Blue heart for that one.   :)
Yes his info was excellent in educating our competition. Very correct but missing a second essential point for Shutterstock. Very conveniently, he left the strategy out for iStock. So he obviously doesn't like to educate his own competition, only the one of independents.  :P

iStockPhoto.com / Re: More istock server problems
« on: April 13, 2010, 09:12 »
I had sales every day on IS, even when the server was out for a couple of hours. That means IS gives priority to the buyers end, not to the contributors end. I would be worried if it was the other way round. You can get virtually 100% uptime for a site if you mirror/synchronize all on geographically different data centers, for a hefty cost. Is that worth it? (it will show in the commissions).

1212
Separate issue, but I don't see anything in the model release which would allow you to describe someone as e.g. Turkish rather than Greek, English rather than Scottish, American rather than Canadian, whatever.
The photographer and the agency have the right to assign a "different ethnicity" if it suits them, as is stated in the iStock/Getty release I use now for all sites.
Quote
I acknowledge and agree that I have consented to publication of my ethnicity(ies) as indicated below, but understand that other ethnicities may be associated with me by the Photographer / Filmmaker and / or Assigns for descriptive purposes.
I wonder what rights a model would have over a photographer who assigned them wrongly. I know, it would be different in different countries, probably a lot stricter in the UK than the US, for example.
Knowing the history of Turkey (that originally was Greek, as Asia Minor) and their different invasion waves, ending up in a thorough mixing of their original genes (many Turkish look just like Europeans), it is a bit ridiculous to play the "ethnicity" argument.
There has been a similar case in Belgium 5 years ago, where a Walloon model was used on a political poster of a Flemish party. A lower court then ruled that releases don't count, and that a model has to give permission for every use of a photo. Which is lunatic of course.
In general, and this only goes for countries with Napoleontic law, a model can only claim damages when (1) the photographer/agency knowingly did something wrong, and (2) those damages are real and financial, so that the model can prove them with exact amounts and why. The burden of proof in that case lies with the model.
In the case of the OP, the model won't have any financial damages being depicted as a Turk, or he might be convicted himself for racial stereotyping and hyper-nationalism.
There can be moral damages but courts usually give fines of 1 euro for moral damages in those cases.

In countries with Anglosaxon law (the UK and the US), things might work differently. Especially the US with its ridiculous lawsuits and too many lawyers, the Greek probably could get what he wants, given he makes some lawyers rich first.

Or unlucky - they undoubtedly had a very good reason for turning it back off!
Global warming. No doubt.  :P

I've been looking into this for a while and the only true stock-specific software I found is Lightbox http://www.lightboxphoto.com/.

Yes, Lightboxphoto is an established commercial gallery/sales package you can install (or rather, they'll do it for you) on your own domain/hoster. You buy the package and there is no rental of bandwidth/storage elsewhere. If you are serious about selling directly, Lightboxphoto is imho the way to go. Considering the price (700$) for the pro version, it is good value for the hassles, glitches and security issues that a free/open source package would entail for a non-programmer. They are already several years on the market and now and then I'm tempted...

For 1099$, the enterprise version is a multi-photographer site, almost as good as a stock agency, but without the marketing of course. There has been much talk here lately about a photographer driven-agency. Well, Lightboxphoto is a simple solution for this. The cost can be split over participants.

1215
For any other opinions thanx in advance...
Since this is your second post (first to unlock the possibility to open a new thread) and you are advertising a paying product ("It is a completely packaged low cost solution") (almost 200 euro for 5,000 images isn't low cost), my opinion is that this is spam.

Fotomind admits that they broke the contract.
"Fotomind will never share your personal information with any third party"
"Since we have partnered with iSyndica for this, we have shared our contributor usernames in order to prepare the transition."
Fotomind shared personal information the email addresses and usernames.
That was exactly my conclusion too, after I read the newspeak post.

1217
Without a doubt!  That is why I was steaming.
I got the spam from Syndica too on my email only used for sites. I marked them as "spam" to Yahoo, and my personal rule is never to buy from or even look at spammers. They have an unsubscribe link but I want to be paid for the 2 minutes it takes me steaming and unsubscribe, so I just mark them as "spam". If enough people do it, it comes in the spam database of Yahoo and it automatically goes in the spam folder for everybody. Not sure of course if it's from FM, but that email was spam-free till 2 weeks ago.

Brilliant! The best post this year.   ;D ;D ;D
If I'll ever make it to Runcorn, I'll buy you a lukewarm big Ale.  :P

hmmmm i actually do have coppermine for my private photo gallery. i have no problem with php and mysql and webdesign and so on. i have never tried the shopping cart option of coppermine - does it make sense?
Yes but most cart plugins are not maintained well and have issues. About half of the time of maintaining CMSses now goes to addressing vulnerabilities. Even my Joomla (well maintained) was hacked by a MySQL injection. If money is involved, I wouldn't trust any free plugins. An option is to link your photos to a secure site like Clustershot or Mostphotos. Or sell off a secure site like Smugmug and the like.

You have to be kidding! The 24-70L is the best general purpose zoom lens that Canon make.
I read all the reviews before deciding and they gave the 24-70 a slight advantage in borderline conditions (full open etc..) and also sharpness. I was just commenting about convenience (weight) since an all round lens like that you will take around. For studio it doesn't matter that much since I assume everybody shoots by monopod by now. The 70 limitation is annoying for cropped portraits though. I plan to buy a Macro 100mm later this year so that should solve the problem.
