I'm not taking sides but..... if I were to cu tan image out of a magazine and pin it up in my home on a pinboard, am I infringing copyright?  effectively this is just people collecting and sharing beautiful imagery on a pinboard that is digital, they aren't using images to sell anything, or trying to steal images.  We aren't losing any money, because the pinners aren't in the market to buy images. If the site is shut down then that'll be it, we won't suddenly find these people buying our images.

I concede that it's a great place to steal images, but then google image search also is pretty handy for that.  There are a lot of watermarked images on the site too, which is actually a form of advertising for your image and the stock site it's been "borrowed" from.

I admit I struggle to see the point of it {pinterest}. Although I have for years collected images in a visual diary, which I have both stuck on my wall and as a folder in Bridge, so I can see its use as a great source of inspiration. i used it briefly last year but I don't often go back to it. Like twitter, I just don't get it. Some ppl have too much time on their hands!

^^ditto. when this whole thing was first hinted at I assumed he was opening an agency to compete with the Big guys. What will you all think if he offers the same paltry comms though?

in short: yes, you need insurance.
If you are operating as a business you may have some limited liability so those poor blighters with the split pants will "only" have access to your business and equipment. not your house and other important stuff. You could be super clever and put the equipment and your spouses name and then hire it off him/her, so you own nothing as a business. *sigh* the things we do to protect ourselves from bogans who probably have more cashflow than we do!!

if you aren't operating as a business but as yourself....... yikes!

unless you're shooting my gorgeous 15wk old rhodesian ridgeback puppy.......... frankly, nothing works!! little bugger just eludes the focus zone altogether. if i'm shooting my favourite thing: non-moving non-talking stuff: manual focus. otherwise i'm in "auto" but the move-it-where I want type of "auto".

welcome! I probably don't have the right to say "welcome" as I'm a relative newb to this site also. But even in this newbie forum a lot of the old dogs are lurking. There are some truly amazing, successful stock photogs here, and some very jaded ppl here. If you're not so green in stock you might fare ok.... I think the rest of the newbs hide. I myself am new to stock but am in my 4th decade (and I've birthed 3 children & tolerated one husband for 12 years) so I don't take **** from anyone.  enjoy :)

I'm pretty sure someone who signed in Scotland to agree to abide by English laws (as the 'nearest jurisdiction' could have some fun down the line, if the relevant laws should happen to be different in the two countries.

Like the superinjunction case: "We cannot be bound by a foreign jurisdiction".


T.......... standard Getty release, which is identical to the Istock one except for the Istock name.  It specifically says "I agree that this release is worldwide and perpetual, and will be governed by the laws (excluding the law of conflicts) of the country/state from the following list that is nearest to the address of the Model (or parent*) given opposite: New York, Alberta, England, Australia and New Zealand."



what a random bunch of places! a City (and a state), a province, a country (but not a passport-issuing type country), and two real countries that are super awesome but kinda small fry. It just makes the whole Release form out to be a bit of a joke.

I'm using Yuri's generic one and so far it's been fine (had one rejection from iStock, despite others in the same batch getting through. *sigh*)

My only real gripe about DT's submission process is those worthless, archaic categories.   Why oh why oh why can't they get rid of that system, which accomplishes nothing, and stop forcing me to grind through it on every single photo?

It's a perfect example about how some of the big sites are now so mired in their own complexity that they can't move forward.  Getting rid of the categories would no doubt require a suprising amount of expensive work by software developers. 

exactly - this is my biggest complaint with all agencies - categories are useless, and misleading - most images fit multiple categories, and still wont be what auyer is looking for.  and since any given category has thousands of images no buyer is going to waste time looking at 'landscapes'

aaargh, categories!! I've just uploaded a small batch of fashion images and there is NO category for fashion/beauty!!! I guess it's such an unimportant category ........ "retail" also has no category. I ended up sticking them in Business- still life. Hilarious.

I must say, the more I look at this new site, the more impressed I am. For a new site, the attention to detail and the level of finish is remarkable.

Thank you! You will not believe all the small things I have been optimizing before launch. Re-keyworded about 30000+ images, re-titled about the same. Organized 1300 shoots, 700 models...Auto-suggestions based on beta-testers, manually input keyword suggestions for about 3000 top searches, color corrected about 10000 files. Re-developed old shoots so they would look better.
Our current ticket tracker system reads 3500 in issue number, which means that to get the site to where it is now we have fixed or added 3500 bugs or features.
For the critical comments: Remember that this is a version 1.0 - it still introduces two new inventions that no other site has: Time-exclusivity and custom retouching. And both features work, at launch!
Imagine what version 2.0 will look like, with SEO, referral and social media integration. 100000+ images! 
Keep in mind the bigger picture. That's what I always do. :)

have you seen his website? his pricing is 2x the regular exclusive file or a photo+ at iStock
nope, hadn't bother to search yet, is it the peopleimages.com site?
there's only 70,000 which is an impressive portfolio for him, but I did a search based on one of my best sellers...didn't find anything similar. I'm sure we all could do that. I can't see him withdrawing from the big agencies yet.

in general the world is on an economic downturn, so for some to still be posting BME just last month is pretty great! I've got friends who've lost their jobs, businesses failed, gone bankrupt......even here in Australia where we felt fairly smug for a while that we were immune to the problems of the northern hemisphere........ the fall out continues to bring low retail results and businesses are struggling ("soft" is the term my magazine editor uses as she justifies why she can't me properly for the work I do for them). I am surprised that some still are expecting growth rather than being grateful just to be holding their position.

lol, same here. We naively presumed our older dogs would train the new puppy into instant good behaviour.... nope! and he doesn't sit still long enough to photograph, what good is he?!

Being a fresh newbie too perhaps I can help?

I haven't seen your port so it's hard to say.... but I wouldn't be holding your breath until you're on iStock and Shutterstock. DT is still #4 for me and so very slow. Once I got through the SS exam process I made a sale within 2 days, much to my delight. iStock is slow but steady, and though they only sell half the amount of SS the profit is higher. Everyone has different experiences with the rest of the agencies.

Yes, it's Good Friday, Passover started last night at Midnight, so that covers much of the major religions.

Now it's time to say "sales have tanked big time"  ;D

If only we could abolish religion we could make the designers buy our work at a nice, steady pace all year round.

It might hit the sales of Christmas and Easter images but I'm sure the retailers would find new reasons for things to need promoting.

I was thinking about that...  Not sure what % of the overall stock market is US customers versus the rest of the world. anyone know? There are many countries that haven't shut down for the long weekend.

Last time I looked, Cape town was in South Africa, not Australia.
Aborigines is a term that refers to indigenous people, no matter what clump of ground they live on.
true, but not many do use that term as our lot seem to have adopted it (ok, we forced it on them). you wouldn't use it a search term for any other country... would you?
