It seems that the UK agency had placed my images with an agency based in South Africa who had then placed them with Getty Images.

I think that you should give NAME of that UK agency so we know confidentiality to where not to upload?

I dont know but I'd guess Alamy not my blog. You can block sellers by country and control distribution which makes the complaint sombody that can't read license terms when uploading.

Funny about the timing and the release of the information right at the holidays. I imagine it was all just a coincidence  ;D

Best,
Jonathan

New Year and 90 day notice I'd be suspicious to Jon.  ::) Or not

Subscription getty unlimited use  2.1   Getty Images grants to Licensee a non-exclusive, non-transferable, non-sublicensable, worldwide right to Reproduce the Licensed Material identified in the Invoice an unlimited number of times during the term of Creative Express subscription as identified in the Invoice ("Term") in any and all media for all purposes other than those uses prohibited under Section 3 of this Agreement.

http://www.gettyimages.com/Corporate/LicenseAgreements.aspx

Got an update for you....

Still nothing from Getty, so i contacted the purchaser of the image, who stated that they had settle with a chap at Jupiter Images in Sept 09 (no-one told me) and more shockingly, they were told that their standard licence covered the distribution of my image on their product for resale - contrary to Jupiter's T&C - Extended Licences (EL):

'E3: Physical items for resale - Limited run

By obtaining this license you may use the Image on items for resale such as t-shirts, postcards, mouse pads, coffee mugs, calendars or similar, even if they contain the Image in a dominant way. You may print up to 10,000 items of each category. If you exceed that amount, you must purchase this license again. All other restrictions from the Prohibited uses section of the Standard license terms still apply.'

The purchaser wrote to me originally stating that Jupiter had advised them that the purchase only required a normal licence, so i reckon this is some sort of cover up, hence no-one saying anything to me (other than the purchaser).

Any thoughts?

I think you are right 5% make something less make good money and its getting harder with more competition from the really good people on the top.

my smallish port of around 400 images covers the average for another 9 contributors.

some of the biggest portfolios range up to 20,000 photos. = 450ish contributors.

I'd imagine its less than 80-20 rule and more like 90-95%

100,000 images per week accepted. that's one every 6 seconds !

iStockPhoto.com / Re: Potential Licence Breach - istock no help...
« on: November 23, 2009, 05:45 »
Another thought. Even if you see a company using the image, it is not necessarily the buyer - and since it's advertisement, it's likely another company purchased for their client's use.

Indeed, I used an image I bought from DT for a client's print ad.  My company name was no where on the ad, so if DT or anyone else looked for the client's name, they wouldn't find it in their records.  They'd have to contact the client who would then give them my company's  name.

yeah I guess this is their arguement. But still, bad attitude, have never received such arrogance from any other sites. And makes u worry about the potential problems if an image falls into some dodgy use etc, as would appear they would be quick to say they can't help.

All stock agencies have an inherent duty of care to their contributors to ensure that the images they sell on our behalf are licenced correctly.

You got the dollar and read the contract before you uploaded, now you want more money. I can see them sitting in meetings talking about how they need to care about contributors. That's funny. You don't know if the photo was downloaded from istock or from one of the others for sure do you.

Newbie Discussion / Re: Need advice on photo editing
« on: November 23, 2009, 05:38 »
Is this a troll. Has PS and doesn't know how to use it. Needs to make a gif into a big jpg which will make it a big bad jpg. Can't find the edit tab and see resize. This must be a joke.

1562
Its an extension of microstock applied to another area. You people are funny. What photographer would sell his work for 50 cents a download or make $1 a month from a photo when he can sell it for $200. It would take 10 years to make the same as one sale. Microstock will never work. That's what you are saying about this new idea, writers will not go for the crowd sourcing $20 an article volume business which is precisly what microstock does for you.

Payment varies by assignment and is based on number of video clips within the assignment. Videos are grouped together to allow for ease of shooting and average $200 to $300 per assignment. It's not a threat its a parallel development using the same ideas. The site doesn't mention photos its more modern then still pictures.

New Sites - General / Re: New SWISS Stock
« on: October 22, 2009, 15:19 »
No, seriously 2/5 of you react like i am the owner of this stock and trying to prove something here about it...
I know about it as much as u do. If for the most of you so it is critical that the domain is registered in Moldova, then i really don't know what to think?! ) Dreamtime is Romanian and American company, so what? most of you working with this stock, so am i, and i don't care where is registered their domain name.  :-\

We do, MOLDOVA REPUBLIC OF CHISINAU is not Swiss and the entire spam that you found a new site before it is a site and live there is mighty suspicious. Next time cover your tracks better.

I hate that tax thing and the "sendin' 10 images and if rejected you can't sell in a month" policy
appart from the price of sales are too low

Translation. I just got refused and have to wait a month I'll start trolling for SS complaints while I wait.

Dreamstime.com / Re: What do you hate about Dreamstime?
« on: October 02, 2009, 13:52 »
Just my quick list:
1.  6 months of holding images
2.  increased amount of subscription sales
3.  falling RPI
4.  new pricing policy
5.  disabling images not deleting them
6.  slowest disabling process for images, having to put a reason for each one
7.  getting images rejected for having a model release
8.  locking keywords on basically every image
9.  giving away free images

I don't like
10. Changing policies for old contributors. No possibility to option-in/out or close account when TOS change.
11. Exclusive images - you can check in but cannot check out
12. Assignment images blocked for one year
13. They pay only 25$ for assignment image and in the same time recommend 250$ for others
14. "Selective" forum, what they don't like disappears
15. Very slow earnings compared to IS and SS
16. About 40%!!!  commission drop.
17. No information send to contributors about important changes, like new prices policy
18. Lack of information about Partners program
19. Sometimes strange earnings like 0,24. DT team never explain that
20. Usually announces made are not clear, not precise for me. Like politicians speech.
21. Subscriptions not limited in size.
22. "sale is a sale" reasoning

$100 minimum payout, low sales and subs, add up to they keep all the money for new photogs and never pay them because they never reach payout.

« on: June 02, 2009, 11:53 »
Does anybody know the difference between a tax and withholding taxes. The first one you pay the second you get back when you file. All this complaining quitting name calling about witholding taxes until you file and get the balance back when you pay your USA taxes if you pay anything. What does the word withold mean?

1567
Interesting.  I just searched around and it doesn't look like there is anything very realistic looking.  The one that says "for motion picture use only" on it would not be very useful.  Don't want to have to clone that out.

Looks to me like the best solution is still to use real money, unless you are planning to destroy it, which of course nobody would want to do with actual cash.

Fine if you keep a desk drawer full of real money around to use as props and hope you don't lose any during the shoot.

There are no big 6, that's what's confusing.

SS
DT
IS
FT

That's the top 4.  Beyond that, you're stretching.

BigStock
123
StockXpert
CanStockPhoto

That's the next level - stuff you can occasionally get money from.

CS, FP, YM, MP, ZM, SV, etc. are all the "good luck" places.  That's just how it generally shakes out.  Everyone's port is different but that's the basics.

Right, except StockXpert. It belongs to Top 5.

In fact the truth is: (in no particular order)

IS
SS

then;
DT
StockXpert
FT

then;
123rf
BigStock
maybe CanStockPhoto

then the rest...

There are no big 6. Theres a big 2 IS SS, big 4 if you add FT & DT, and big 7 with StockXpert 123 BigStock. I dont find CanStockPhoto as one of the big 8 but if it was fored in that would be it.

part 2 of the question which ones are worth the time? either the big 2 or the big 4 after that it might be a waste of time until you have 1000 photos. you can always upload those later to the last 4 and you didn't lose much. Sobody good would have only the big 2 and not waste time on any of the rest. FT & DT are getting hard to work with.

With the stock licensing image revenue streams in freefall, commercial sales have remained profitable for photographers, especially Getty.

Shutterstock.com / Re: would I do well on SS?
« on: April 17, 2009, 20:45 »
I'm still exclusive on iStock. I wonder if a couple of SS veterans would mind having a look at my iStock portfolio and letting me know if I would do well on SS with my portfolio and the type of work I shoot?

I know this is a hard question, especially since helping someone new is technically helping the competition. I'm hoping someone won't mind having a look. it is just good information to have should the decision be in the foreground again.

Didn't you decide 2 weeks ago after a month of advise that you would stick with istock when a istock administrater told you to do that.
