Adobe Stock / Re: Fotolia Joins Adobe
« on: January 29, 2015, 16:33 »
I am not into conspiracy theories but do we know if dpc was part of the adobe acquisition? I mentioned this before but DPC could have been done with foresight into a sale of FT. Sell FT and keep a competing agency called Dollar Photo Club. Wasnt it supposedly a completely different agency separate and distinct from FT? If this is true it shows the FT " i wanna have my cake and eat it too" attitude. This would explain why they opted in all of our content without our permission and under pressure that dpc was a separate entity they were legally forced to give an opt out. This stinks.

my thoughts exactly ... which prompted me to say it 's an iceberg or the light at the end of the tunnel is an oncoming train 8)

I would also place my bet on  the theory that DPC concept is the main force on which future of the site will be based on. They are a conglomerate and I wouldn't place nothing on the theory that benefit of contributors is on list of any significant importance.

The language of the release seems to be sufficient, that is not in question. The plaintiff is trying to get around it by saying I fraudulently induced her to sign it, which I did not

Ok, thats her right.

On which base will she try to prove that, because she has to clearly prove that and  that's the main question of the case.

Your whiteness importance will go into second plan because she will probably claim that you 2 work together and represent same side.

Secondly, whats her agent point of view, if photographer gets him on his side or even on neutral that only should win the case.

If I was the photographer I would seriously research and consider pulling accusation of breaking a legal contract and request coverage of all expenses that came as a result of that.

Then there is a possibility of requesting refund of all  losses because photographer reputation has been ruined with that case and newspapers articles representing one side only.

Maybe she will quit and settle on nothing when she know shell have to pay big time if she looses this one and there are strong chances she will.

I think she ditched her agent months before the lawsuit and nothing about her agent was ever brought up in court. She is claiming I never paid her as well, I have paypal receipts and facebook messages proving this. She probably does not want to bring up her old agent because she would end up having to admit I actually did pay her, and she was informed the images would be used for stock photography, which she is claiming she was never told.

If its not to late I would call the man asap

Is there no way to get a pro bono lawyer?

+1

Anyone should win that case defending alone just with facts from the text. If he looses best lawyer in the world wont help him because the case is fixed which I doubt in this case.

The guy should only think how he should pump his defending expenses and get the refund after the case from the person who sued him

All the lawyers I talked to said a refund even if I win the case is extremely unlikely, it just is not something that happens that much in civil cases, even in ridiculous ones like mine. The legal definition of frivolous and the common sense one are two different things, and judges are extremely reluctant to rule any case frivolous in even some pretty extreme cases. I also asked about if I did lose, could I file bankruptcy since I have n chance of ever paying $500,000, I guess even in that situation, because case is alleging a fraud element, I can't even file for bankruptcy, this is scary as hell.

I am confident I will be able to win the case, but only if I get enough money to get through it. Going through the process of discovery and depositions will cost a gigantic amount of money because of the huge amount of hours it takes. When you are paying many hundreds of dollars an hour, this adds up really fast even for something that is simple, it is pretty frightening.

I openly dislike lawyers, I had 5 court cases in my life, 2 with lawyers witch I lost and 3 by representing my legal person of which I won 2 and settled in last on but that was my plan.

Anyways

If they had not ignored my side of the story, here is what they would have reported. She was an experienced lingerie and implied nude model, appearing on a magazine cover in such apparel.  I told her agent before the shoot it would be used for stock photography.  During the shoot I also told the model that the images would be for sale for stock photography and explained how stock photography works.  I explained to her that these agencies prohibit pornographic use in their terms of service..  Another person who often helped me from time to time was present during the shoot and witnessed everything.

If he had all that in written on that piece of paper that she signed he would be unbreakable in the case, but I think even like this way he cannot loose, but it highly depends on that model release and its content.

Obviously that contract or model release that people call it should be considered more seriously and photographers should not use first template of same that find on google but some legally unbreakable one which every average notary should be able to write if not the photographer alone with minimal research and fully protect them self.

General Stock Discussion / Re: Searching for a site

What Sean said.  ktools photostore, photoshelter, etc... choose a service.

I thought you were talking about finding a wonder magical dream site with amazing commission levels, who also had amazing sales.  Such a place is difficult to find.  You can find agencies with generous commissions, but usually this is just a tactic to get content.  Later on its jacked back down to piddly peanuts.  All I meant was, that if you find a place to host your work with amazing commissions, there's probably a really good chance your images will just sit and rot... if you're driving the traffic yourself, then just self-host your own photo site.

Haha, sorry I have built and ruined  the dream in few minutes... :)

But what is 70% of nothing?   Even 25% commissions with tons of sales trumps 75% with zero sales, all day every day.  Work smarter, not harder.

What do you mean nothing ?

I would use it for sending my buyers there, Im not counting on their traffic at all, Im counting only on sales I bring there directly.

Host them yourself then.

Too much of a problem with accounting here, that's why I gave up of my symbiostock site

The best thing I have for now is that FAA licensing site with 70% or so, but I don't think the content I would sell would mix nice with my artsy stuff for prints there.
I think, but don't know, you'd need to try it out, that you could upload files to FAA, set RF or RM pricing, remove image pricing and presumably (???) it would show up only on pixels.com  where the stock files sell. If that works (and I don't see why it wouldn't, but I've never tried) you can set your own price, which is good if you are pushing buyers there. I'm not sure how many 'random' stock sales they're making - I only read of one here on msg.

I see what you mean about why should the agencies get such a big percentage if you're sending your own buyers there, but also consider that a small percentage of a larger amount is still better for you in fact, if not in principle.

Thanks ShadySue

About FAA thing...yes it works I already tried  it BUT...

All images will show in main FAA sit and artist website also, so if you want to sell design elements, textures and stuff like that together with printing portfolio that's already a problem because when someone visits your images site will see a huge mix of everything...

Plus their preview sucks big time, people can grab almost mid sized non watermarked stuff just like that

I agree on second opinion also, but higher % of larger amount is even better, so when I allready may choose where to send somebody who contacts me for a image licence I want to make sure I send him at place which benefits me most.

Thats why I asked here :D

Well, MP and GL are surely out, first because subs/pricing and second one because its closed end even if its open 40 images limit turn me off especially if I have few thousands images to upload.

Pond5 is ok and was in my favorites but I'm thinking is there anyone similar offering more than 50%

The thing is that sometimes i have opportunity to promote my work and thats the purpose of this site search

If I own the image and bring the customer, well than 50% is not a fair share.

The best thing I have for now is that FAA licensing site with 70% or so, but I don't think the content I would sell would mix nice with my artsy stuff for prints there.

If I recall good there was another site offering 70 or even 80% but I don't remember which.

General Stock Discussion / Searching for a site
« on: January 07, 2015, 17:27 »
I was browsing trough forums but lost a lot of time today so maybe I better ask...so

A site that would be something like this:

-Not huge previews , decently watermarked

-Decent Upload Process

-Possibility to create few galleries

-Custom Price Setting  and no subs

-Approval: Not some "we have enough of those" or "select only best in series"  rejections

I was searching trough forums and Macrografiks was closest to what I had in mind but unfortunately as they have come to the end as I can see.

Highest payout rate is main priority and the site traffic is not so important

Any comments are more than welcomed and thanks in advance :D

Print on Demand Forum / Re: thoughts about a few POD sites
« on: December 24, 2014, 13:10 »
You'll find a lot of threads here on POD, some recent, but here's a bullet point summary of my own opinions.

FAA - PRO: lets you set markup, reads IPTC and has keyword search, handles any aspect ratio, large market share. CON: search is heavily weighted by past sales and curated 'collections', new works have little chance.  I make a few sales, of niche subjects not covered by the big sellers.

Redbubble - doesn't read IPTC, fixed aspect ratios, I never sell anything there.

Zazzle - a complete and utter waste of time.

Society6 - I know nothing about them.

(OT - why are all these sites currently going crazy about 'throw pillows'?)

I just started reading about most of those sites and my main conclusion is that successful artists use them primary as printing service and delivering products while they do their promotion themself.

Of course few "unexpected" sales are fine but primary your sales will depend of your involving in promotion of your work and yourself as an artist.

According to some interviews with some artists who have some really quality fine art on POD sites, they claim that limited series prints do help, do raise the print price and also people get interested into buying original witch is artists ( at least for painters) main goal.

Anyways im also interested, some people have huge portfolio with famous artist galleries selling prints of Picasso, Monet, Chagall etc...

Is that allowed, is that considered public domain or on what basis can they do that?

@ Hobostocker

Germany is fine. Unemployment is going down and much lower than in many other countries, people are highly educated and a lot of our energy comes from home grown eco friendly wind/water/solar. It creates jobs in Germany, drives new technologies that can be sold abroad and makes us independent from crazy countries. Also our economy is 70% middle class businesses with a huge variety of services and technology,so we dont depend as much on a few superlarge cooperations.

Plus people are really good at insulating homes, buying cars that use little gas or foregoing their cars completely, because we actually have a fully working public transport infrastructure. I sold my car in 2009, havent needed one since.

We hate taking loans and are careful with credit cards and people plan their financial lives very carefully.

So I know we love to complain and it might all look depressing from the outside, but this is overall a very safe and friendly place to live.

How do you stand with evictions numbers  and what % of people actually own their own homes ? Lets compare that with stats from 15 years ago ?

To save some time take this image  go to menu/edit/flip horizontal and you will and up with some nice artistic symmetry  ;)

Try refreshing your cache next time, and see what happens. Did you see the bug report for the French and Spanish versions, files not showing, but in the English version they are all there? (it was page ten and after, but who knows)

Same here. Looks like they split batches and queue show up

How very strange Lizard the OP says the new files are showing first on the artists - popular - page. I know mine do too. What search are your new images "already buried"? Or do you mean in a search of the keywords, with all other files of everyone else?

Or did you mean other new images are dropping you down so fast, that if you had anything on the first page, it was bumped before people could see them?

SS uses FIFO (first in first out) for reviews. That means, no one gets ahead and no one gets pushed to the back. If you are pages down before the servers sync. It means that many newer images got accepted for the same search, after yours.

Must be a popular search term if that many are flooding in at the same time as yours?

Also in search there are many new images already there so when my images finally show up they are already buried.

Yes under keywords search sorted by new...

Normally that majority of images that were not showing in my gallery didn't show in searches also...

Even more interesting part is that those from that batch that did show in gallery also came out in the keyword search, but they were not showing under some keywords and combination of few that I included in tags while on sme other keywords or combination of few they showed up normally.

I checked about 20 pages or so and not a trace from them while on page 11 were already images with newer serial number than mine.

Really I wasnt paying attention for long time but last large 2 batches were acting strange.

My question is - where are my newest images? Few days ago I uploaded around 80 files and see only 17 of them in "new". Where's the rest of accepted batch? Searched next 10 pages and didn't find...

Same thing happening here at least last 2 weeks( when I noticed first time) , only 1/3 accepted of the last batch have showed up in my gallery and in searches.

Also in search there are many new images already there so when my images finally show up they are already buried.

Luckilly from last 20 or so sales only 1 came from the left side of the globe so it shouldnt struck me so hard if judging from that  :D

If I understood this project correctly  with kind respect to all, In my opinion people on MS group could easily build a "hyper-portfolio" together, I sure don't doubt it would be a quality one and save themselves above 60% of the cut right in the start.

That mostly goes if one is targeting with this one the same market he is present with his work now.

Newbie Discussion / Re: Need Help With Bulk Renaming Files
« on: November 18, 2014, 17:20 »
Hi All,  :D

Is there a good file renaming program out there that is free and easy to use?

I am just wondering because here is a problem I am encountering:

I can rename files with Windows but it names everything as photo (1), photo (2), photo (3) etc...

However.. when I want to rename these files... I tried using a program called "Bulk Rename Utility" and it sorts the files as photo (1), photo (10), photo (11), photo (2) photo (20) photo (21)... which throws everything out of order. I want the photos to be in numerical sequence as these are time lapse images.

Can anyone help?

I would really appreciate any advice you have.

Thanks,

Cricket

My friend wrote me a script for exact same reason, it works and it saved me a lot of time.

It basically works in the way that u put your images in a same folder where the script is, run the script and it will put sequence numbers in front of the original name
of your file. You just type number od digits and first number. It does it randomly so when i have few batches to rename it mixes images randomly.

If you are interested just PM me I can mail it to you but if you want it to work you will have to install python 2.7.8 from here first

Its the best free solution I have found.

Sorry but you are quoting the highest legal agreement of them all, the one all others agreements including LAWS have to follow, and no reason is good enough legally to confront declaration of human rights especially not terms of a company.

http://en.wikipedia.org/wiki/Universal_Declaration_of_Human_Rights

 ;)

How is the Universal Declaration relevant? OP still has the right to work, just not with iStock, unfortunately for him.
Besides, this has to do with a partnership, not employment.

Are you for real?  Certain company dumps a person from "partnership" and the only reason is his nationality or place where he lives?

What does it have to do with human rights you ask?

Well it reminded me of a case where certain ethnic group couldn't use a public bus, well, actually they could only they had to stick at the back.

I bet at that time you would say...unfortunately for them...but they can still ride at the back.

Besides,it has to do with human spirit inside a person not with a law book  ;)
