I have bought 4 or 5 gopro cameras and they are very very difficult to work with, and I think it was mostly a waste of time. they also get lost easily if you film in fast moving water.

although I was able to get sellable shots by mounting them on my car, however I get better shots just mounting a tripod to the car, so it is still irrelevant.

if I had to do it over again, I would never have bought a gorpro style camera.

you said: " Just grabbing a photo to use as filler or to illustrate the commentary is infringement."

no it isn't. (not in the US). in the US you can use any photo worldwide for editorial purposes, for educational purposes, for commentary, etc. you will come into problems if you use the photo in advertising without securing rights.

153
if you have a driver's license, or other government issued identity card, your face will be used to identify who you are. it would be unacceptable to present a photo of your clothing, such as your pant leg, to identify yourself on a government issued ID card. the clothing for most people is not part of their identity.

I thought this was a discussion forum?

155
I don't understand why.

if you have a 25mp photo, it is going to have a certain lifespan before people will no longer buy it due to poor resolution. a photo with 50mp should last longer in the market. although I do make a lot of money with 9mp photos.

in regards to the sensor, I notice an improvement from 1" to APS-C. surely a camera that is full frame or medium format must have an improved dynamic range that produces higher quality photos, which should mean less rejections on stock sites. in addition, I think Alamy is rejecting APS-C photos now.

I have tried contacting stock agencies to determine if they believe a better sensor is worth being and they never give me any information.

no, it is not an infringement to use a photo for editorial purposes. if you write an article and use a photo that the article has commentary on, then you can use any photo in the world, and you do not have to pay for it. it falls under "Fair Use" in copyright law. and you can get the photo on google images, and you can download the photo from a stock agency, even if it is watermarked, and you can get the photo from someone else's web page.

https://en.wikipedia.org/wiki/Fair_use
fair use
noun
(in US copyright law) the doctrine that brief excerpts of copyright material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder.

Adobe Stock / Re: Poor $ week on fotolia
« on: May 24, 2018, 15:48 »
I put extra effort in the past year to upload photos and videos to Adobe, and I saw a huge increase in sales and am very happy with the results.

this is interesting:

https://www.nolo.com/legal-encyclopedia/copyright-architectural-photos.html
Except for buildings that cannot be viewed from a public space, the copyright owner of a post-1990 building (the architect, developer, or building owner) cannot prevent the making, distributing, or public display of pictures, paintings, photographs, or other pictorial representations of the building. See 17 U.S. Code 120, which covers the scope of exclusive rights in architectural works.
Therefore, photographers need to be concerned only when entering private property without permission to take a photo of a post-1990 building. Such photos may result in a claim of copyright infringement.

159
please be aware that anytime you post-process a video you will degrade the quality of the video, as compared to the original, unless you are trimming and recording to the native codec, and have software that supports storing the original frame.

the best option is to keep post-processing to a minimum.

Adobe Stock / Re: adobe footage sales
« on: May 24, 2018, 15:35 »
90% or more of my sales are form video.

adobe has been growing strongly for me and I am very happy with footage sales there. they often credit me $78 or so for a single sale, or $28.

you said: "I am relatively new to the world of stocks. I have one question. How do you handle releases for public buildings or details of facades of some old buildings, city monuments, random anchored small boats in port etc? "

the answers to your questions are here: https://www.copyright.gov/circs/circ41.pdf for the US.

in general: all buildings built before 1990 do not have copyright protection. boats never have copyright protection. details that are utilitarian (such as windows and doorways) cannot be copyrighted.

copyrights protect works of art (literature, music, etc). a building is not a work of art.

most countries will have similar laws however i have seen exceptions in some countries.

VideoBlocks / Re: 4K sales
« on: May 24, 2018, 15:25 »
I have had perhaps 15 to 20  4k sales on video blocks. in many cases, they were sold in groups, such as 2 or 3 similar videos in 4k res.

Shutterstock.com / Re: Shutterstock referral?
« on: May 24, 2018, 15:19 »
I  earn money from both types of referals. Some from a portion of a sale of another person's photos, which is about 2 cents per sale, and I get referals that vary from a few dollars to perhaps 10 dollars for 'subscription'.  I have no earnings from the 'footage' type of referal.

General Stock Discussion / about how to sharpen a photo
« on: May 22, 2018, 08:58 »
I do portrait photos with an APS-C around 200mm. I usually focus on the person's eyes.

however, I am not happy with how sharp many of the photos are. how do I improve  the sharpness? I understand that I might be able to improve the sharpness by buying a prime lens.

is it possible to improve the sharpness by switching to a 80mm lens? (the stock lens that comes with the D3400)

will I get better overall sharpness if I am close to the subject or far from the subject?

are there any other functions on the camera (other than the focus) that make the image sharper overall?

166
I just had the idea next time I will take the same photo with a variety of metering and exposure settings and maybe I will figure out how to fix it. thanks anyway

Owner of the Copyright in a Work Made for Hire
"If a work is made for hire, the employer or other person for whom the work was prepared [for] is the initial owner of the copyright" (not the photgrapher)

168
you said: "Wrong the client does not get the copyright unless the producer/photographer signs it over irrespective of how much is paid"

wrong. in the USA, according to the US copyright office, under the circumstances of a work for hire, the copyright of the work is transfered upon creation and the photographer would not be a copyright holder at any time even though he took the photos.

I have a photo that looks weird because of the lighting. I am not an expert photographer. can you please tell me, using a Nikon D3400 style camera, what function I could have used to correct the lighting / exposure with this image:
https://www.shutterstock.com/image-photo/female-dance-student-posing-1031184745

here is a sample of a similar photo with a similar pose, similar clothing, which does not have the lighting blown out, even thought it was also filmed in bright sunlight (and with a 1" sensor):
https://www.shutterstock.com/image-photo/student-teen-girls-school-559301686

I know how to fix it in software. I need to know how to fix it while I am taking the photo. please tell me which function or method you would use to correct the first photo.

thankyou

Shutterstock.com / Re: File transfer error when uploading
« on: May 22, 2018, 06:40 »
I have had a few of these recently also, and not before.

171
I have filmed around 20,000 stock videos.

I record each video such that I do not need to do any editing. I avoid having to edit 99% of my work, and upload the camera native file. when I first started, I spent too much time editing mostly due to mistakes that could be corrected while recording.

it takes practice to get everything right during the recording process. but it saves tons of time.

Off Topic / Re: Best time of the year to buy new camera?
« on: May 22, 2018, 06:36 »
around april of every year is around when most new cameras hit the market, after the consumer electronic show. so if you want a new model, wait until april.

173
there are many web sites that have free forms or cheap forms for photographer and client. search the net and you will find them. they used to always be free but now it is more difficult to get free ones.

if she pays you in full, she owns the copyright, remember that. it would be a work-for-hire.

174
you said: "They don't prevent you from engaging in commerce."

if someone rejects your photo to be listed for sale, then you have been prevented from engaging in commerce with that photo and agency.

175
you said: "the clothing itself would need to be released"

no it wouldn't.
