Well, I kinda think that what we need on the legal side, licensing terms for the Symbiostock network that force people to use certain disclaimers and pre-defined licenses and the pre-defined licenses themselves, could be done by pro bono people.
I'm curious -- are there any other lawyers around? I am not an IP lawyer and my admission status is a bit wobbly right now, but I would generally be willing to help.
As I have only loosely followed Symbiostock so far (didn't have the time to make a site), excuse my possibly stupid question: is there some sort of legal entity (i.e. a corporation) behind it? Otherwise that would likely have to be created, too.

It always seemed to me like they are actually, actively trying. Hard. Although to be fair, there might be a good reason for this: It makes it a little harder to search Thinkstock for a particular image you found on iStock.

Yes, most people use the free alternative of a spreadsheet. Track your daily overall sales, write it down each day and make a graph. it is a nice way to see progress, the $/picture/day average and changes that portfolio size make to income.
Is there a spreadsheet template to download somewhere?

If you don't want rejection on Fotolia you must make "Special Fotolia Photos"
After I have understood this I have very few rejections (and few sales too )
So, what is a "Specia Fotolia Photo"? A "Special Fotolia Photo" is any shoot of a single object (not protected by copyright) that you can find around you, and then put on a white background, under a big soft box.
None of these images will be rejected None of these images will be sold
The aim of Fotolia is not to sell your images, the aim of Fotolia is to be Fotolia.

I am a lawyer, educated in both common law (US) and civil law (continental Europe) jurisdictions, but not a trial lawyer, and matters relating to evidence are very different internationally. So take what I say with a huge lump of salt. BUT:
Civil Law
From my experience, the burden of proof and the parties credibility will decide cases like this. You as a claimant have the burdon of proof initially, but you bring all the evidence you can -- screencaps, correspondence (your take-down letter and possible replies), witnesses that saw the image on the site (give us a link, we all become witnesses then) -- and you make your case. At that point, the burden shifts to the other party to state that it didn't happen the way you say it did. Since you were telling the truth, that would mean lying in court (=prison time). Many people will not outright lie to a judge, and even if they do, they will not be particularly convincing. So if you got your stuff together and did your homework, you have a fair chance of winning. Most likely, the case will settle at some point.
Common Law (US)
You make your case to the judge and back it up with what evidence you have (see above). This, since you are telling the truth, will likely be convincing enough for the judge to order pre-trial discovery. This will force the other side to hand you over their records, including possible backups of the site that contain evidence of what you say. If they claim there are no such records or tamper with them (i.e. lie to the judge), that is contempt of court (=prison time) and if their attorneys are complicit in it, they are likely to lose their license. So if you got your stuff together and did your homework, you have a fair chance of winning. Most likely, the case will settle before discovery if it is ordered (because discovery is expensive and annoying).

Has anybody recently tried to leave (or left) Depositphotos? I am thinking about it and have two questions:
1) Do they just "deactivate" the account and the files (as they do with individual files -- no delete option)?
2) Do they pay out the remaining balance even if it is below payout threshold? If so, do they charge some bogus fee for it?

For me (small port, basically photos only, many travel and editorial shots) Pond5 is doing better than Photodune (which for some reason hasn't sold any of my photos in a month now), Canstock (basically dead) and Bigstock ($.25 subs only lately, will likely drop at the end of the year).
I also tend to price my images a bit higher than the norm there (mostly $29.99), so RPD is very nice (between $5 and $15).

I tried the app yesterday.
It is very crashy at this point, which especially sucks considering how much of a pain it is to keyword an image. Apart from that it seems pretty well thought-out and while being similar to the existing "sell your smartphone images" apps that I know (Foap and 123RF), I think from a user experience point of view it is the best.
I also think that Fotolia has a much higher chance of actually selling the images, as opposed to Foap (zero chance IMHO) and 123RF. Combine that with how notoriously hard it can be to get good image with slight technical imperfections accepted into Fotolia, this may be an interesting way around their anal reviewers.
I must also say that I like their concept of having a different "collection" for mobile uploads. From my few attempts they really do enforce the "look" that they are going for, refusing technically perfect images that don't suit and accepting more spontaneous-looking albeit imperfect work. This is far better than what 123RF is doing (just putting smartphone images into the main collection and branding them with a "this photo was taken on a smartphone" label).
All in all more interesting than I would have initially thought.

I just picked up a 7D canon, Should I have waited for the 70D or am I not missing too much?
I'd take a 7D over a 70D any day. They are a completely different class of camera, and the good old 7D still beats out pretty much anything else in the APS-C market.

Frankly, I don't believe anyone is getting 100 DLs on SS and 2 on DT with the same portfolio. Probably 20 with at least twice the RPD which still puts them miles behind SS. However DLs per image probably in the same ballpark as FT, 123 and (even IS after recent innovations) and these last three have SS RPD without the volumes, not to mention they have bent contributors over again and again in recent times.
Reason to be negative compared to SS but dropping them and submitting to those other three makes no sense.

The simple fact is that most people will not take the extra steps to investigate how to ignore topics and take the action to do so.
That means people who might have real insights to offer will come to this forum, see dozens of Symbiostock threads that mean nothing to them, and leave.
I have seen the thread about people complaining about Symbiostock overtaking the forum, and the replies of the Sy-embracers saying we just have to hide it if we don't like it, and I myself didn't take the time to follow those steps. Call me lazy, but the fact is, most people will not jump through those hoops, and they will end up thinking there's little discussion of value here.
Them's the facts. It's not about snobbery. To the average visitor, this forum is now nothing but instructions on setting up a Symbiostock site and how to try to make it actually sell.
Leaf, there needs to be a better answer than making people hide topics if you want this forum to continue to thrive. Maybe Symbiostock will be a dead issue a year from now and this won't be a problem, but at that point, you may have already lost us for good.
This. I am very interested in Symbiostock and will eventually make a site of my own. But it has become a problem here, and having the thoretical option to ignore it is no solution.

i agree he should have dealt on this privately, now he will get his 25000$ but i'm afraid he will be blacklisted by many fashion customers in the future.
refusing 15000 for some large format prints in a store selling clothes ? i dont get it.
he must be really thinking his street stuff are masterpieces ... tsk tsk tsk ! they could have made it with cheap Thinkstock photos or even using public domain stuff pilfered on the web.
Maybe you don't know HONY -- but it's kind of a big deal. Personal taste aside (I think his work is remarkable, culturally if not always technically), his is one of the most popular Tumbler blogs.

sony rx1 is supposed to be excellent.
I havent submitted any shots from it yet, but as far as I concerned the shots coming out of the sony rx100 at low iso / good light are good enough for stock. Fits in my pocket - Amazing little camera.
But then almost anything is good enough for stock in good light. An image of mine that sells reasonably well on most sites was taken with my iPhone 4S... I'd like to throw the Fujifilm x10 in the ring -- or its soon to be released successor. I don't personally own it, but some friends do, and it's great. I have also seen it on reporters who get sent somewhere by their paper without a dedicated photographer, so the big players appear to think it's good for editorial.

I bought a like-new used version last month. I knew what I was getting, as I had used it on a friend's camera before. It's great, you won't regret it, and the price is unbeatable IMHO.

I wasn't - and was pleasantly surprised. Sold my first two images last month, one through their European (Spanish) main agency, one through the American office. Each brought in about 15 Euros, and one of them was a "Low Budget Royalty Free" image. That is not bad for micro!

I haven't upgraded yet. I decided I'd wait for whatever Canon replaces the 7D with and decide then. Also, the OM-D seems rather fascinating...
Don't get me wrong, I still think the a77 is great. However, even my 550D gets beter ratings for high-ISO performance in most reviews, and that kinda put me off.

DDP has much sales for mobile usings. But they also have many good high price sales...
Sorry Michael-- I am a complete amateur when it comes to agency licensing, but what is a mobile use? And why should that make a RM file set on standard pricing end up costing less than 1 Euro? That is insane, I might as well stop selling things as RM then and sell them on Photodune (just my random example for stupidly low prices) instead.
