Shutterstock.com / Re: New rules for editorials (again)
« on: September 04, 2013, 06:14 »
Hi guys,

To clarify...

As has been our policy, credentials are required for events taking place on private property or events which require a paid ticket or entry fee. In our assessment, these types of events commonly restrict attendees from shooting and licensing content taken of the event without the event holder's permission.

Based on our policy, a free festival or parade in a public area would not require credentials as the event is open to the public and does not take place on private property.

The reason we are now requesting event badges and/or correspondence with an authorized representative of the event is that these are the most common types of credentials we receive, and we believe them to be a trustworthy indicator of permission to shoot an event. Our goal is that by having contributors submit these specific credentials to us, the process of reviewing these images will go faster.

However, we also recognize that different events may provide credentials other than a badge or correspondence with an authorized representative. As we state in our policy, we will evaluate credentials on a case-by-case basis when you email us.

If you have any further questions regarding whether content you wish to submit requires credentials, please contact [email protected] for more information.

Thanks,

Scott

Having issues with this now. I shot an event that was a bike race on a public road that I took images of from the sidewalk. After having a chat with one of the reps at shutterstock I'm being told that it's a no go. Even though the event is on public property and open to the public I still need permission from the event holder to be able to photograph and use those images being that I am using them for monetary gain. So far the only reason I have been given as to why is being it's a sporting event credentials are required. If it was a parade I'm told it's fine, if it was a festival I would be fine.

Is this normal and do we need to get permission to use images in an editorial license if they are shot on public?
Would this fall under this?

Images submitted for editorial use that have been taken of the following require proof of credentials before they will accepted:

● Concerts
● Festivals
● Trade shows
● Theatrical performances (including those taken at school performances/theater)
● Conventions
● Openings
● Ticketed events

What applies to Instagram applies to FB with their new 'contract'.

All your digits is belong to us...........(and NSA, GCHQ etc, etc).  :)
That is the FB old TOS.

There are new ones soon taking place and probably has something to do with the SS agreement they have for offering our images on FB.

Shoot in sRGB and edit in sRGB.

If you are a professional Photographer I think you should not.
sRGB is specific to the Web
Professional photographers shoot for the print too.
(maybe you missed the link http://www.luminous-landscape.com/tutorials/prophoto-rgb.shtml)
True but if you are just shooting stock  shoot sRGB and then when shooting non stock change back to RGB that is why there is a setting in camera for just that.

Shutterstock doesn't take public domain scans anymore, anyway. Got to create your own material instead of scanning someone else's.

it seems to me that if they are really in the public domain then it should be fine, it provides a service.  How easy is it to find high resolution images of some of that old artwork?  I think shutterstock messed up by being too lax on what they let in.  They let people submit things from well into the 1900s (even 1920s if I'm not mistaken) whereas istock only lets things in from pre 1890s.  Shuuterstock probably got in trouble for some of that material.

I am surprised how many maps get onto the sites though, most are not public domain or old.  I guess that will be stopped at some point in the future.
Here is a quote that is from Scott that is in a thread on this site already somewhere.

In case anyone missed it.

Quote
Hello All,

Sorry for the delay.

Regarding questions that came up about our policy with respect to public domain images:

Public domain images are typically those images for which the copyright has expired. Generally, it is safe to say that any image (published or unpublished) created before 1892 or by a U.S. artist who died prior to 1942 is in the public domain in the United States. It is not however easy to determine if an image fits those criteria and is in fact in the public domain. As copyright laws vary from country to country, determining the copyright status of images created outside of the United States is more complex.

Unfortunately, researching and verifying the copyright status of public domain images is not practical as part of the review process. On occasion, our policies have attempted to be more forgiving, but we can no longer accept public domain images. For the foreseeable future we will be adhering to our existing guidelines, which prominently state "submissions must be wholly owned by the submitter. Found or public domain images or footage cannot be submitted under any circumstances."

http://submit.shutterstock.com/guidelines.mhtml

Thanks for your understanding and we sincerely apologize for any confusion.

There are no plans to remove public domain images that are currently in the collection, but we reserve the right to do so as we perform routine reviews and quality assurance.

In addition, thank you for the feedback regarding our other review policies and communications. As always, our goal is to have and maintain the best submission experience and your feedback is helpful.

Best Regards,

You never remove an image that could one day get you an EL or an SOD when you wake up look and go WOW look what sold and for what!

Total wast to try and build a port yet delete stuff from it that if you are paying any attention to some that are having quite a few old files sell!

So where would those sales be if the old files were deleted?

Cant get a sale on something you no longer have available!

I wonder how long it will take for those advertisers to start using that service and how long it'll take for contributors to start seeing activity with this.

I haven't uploaded anything to there or anywhere since the last part of July since sale were/and still are stagnate for me.  If it does take off I might be half tempted to upload again.
only way to know looks like you will see an increase in the number of SOD's since that is where they are to show up.

The thief is still denying he did anything wrong and still has the image on his instagram account: http://instagram.com/bogdhan

Even when caught red-handed, these jokers still think they can fool anyone.
Yeah and you have to be a member of instagram to say anything but he will take it down like all the rest.

Perhaps the OP (original photographer) should get hold of a copyright attorney?

There are image factories that upload in excess of 10,000 per week!

Who cares just upload and let it go.

Too many people worry to much about stuff that they have no control over.

Here you think this factory is only uploading 20 a week? Think again!

You can still shoot them but the selling part is where the law takes over.

Permissible Subjects
Despite misconceptions to the contrary, the following subjects can
almost always be photographed lawfully from public places:

that's the part that is tricky, cos I suspect the definition of public space (like train stations, museums and parklands) is a bit grey.
You can shoot anything you want that is private property as long as you are not on that private property and you are on public property.

You can shoot a train station from private property but not while you are on it.

Anyone who has been around railroad tracks knows that railroad property wherever it is is private property always has been and always will be.

Museums are a bit tricky but you are often always able to take pictures just not allowed to sell them.

Parklands most parks that you go to will let you take all the pics you want but with the govt cutbacks they may start enforcing the photography rules they have requiring the obtaining of a permit?

391
i'm not sure why you think airports are public spaces? they most certainly are not! the land may be govt owned but the whole thing is usually leased out to private corporations.

    Superfund sites
    criminal activities
    law enforcement officers

ROFL, try THAT in the United States these days! HA HA HA, I wouldn't try it for a billion bucks.
No problem shooting the Law Enforcement Officers.

It is a violation of your civil rights for them to harass or threaten you in any way in the States.

I have had my run in with Big Bob the Cop who thought his chit didn't stink and thought he was god almighty ruler of all mankind, but a few calls and speaking to the State trooper in charge of the district I was in and he was looking like a fool and a sad puppy dog with his tail between his legs when I met up with the District Trooper in charge of him on location.

Correct.

Contributors,

As many of you know, Shutterstock has been accepting, though not requiring, property releases for the past few years. Rather than continue our policy of rejecting images when we feel that a property release is required, we are making our form of property release available for download, first in this forum and then generally on the site. There is no need to provide property releases with your editorial image & footage submissions. For more information on our editorial policy, please see the forum post regarding editorial submissions.

The laws regarding the necessity of property releases are in flux and do vary from jurisdiction to jurisdiction. If the subject of your image contains any of the following, please provide a properly completed and signed property release when your content is submitted.

* Modern Architecture
* Building interiors
* Unique and/or custom designed luxury boats, vehicles, airplanes, etc.
* Recognizable animals: race horses, unique pets, certain zoo animals, etc.
* Photos/video of building exteriors taken from private property
* Photographs of artwork
* Public places with photography policies: most stadiums, museums, amusement parks, etc.
* Famous landmarks & historic locations:
Will vary from site to site - please familiarize yourself with location's photography policy
(See our posting of current image restrictions for more information.)

The foregoing list is not all inclusive and should be used for general guidance only. As a photographer, it is your responsibility to do the research and determine if a release is necessary. Each specific instance must be considered individually. As a reminder, you are bound by the Terms of Service when you signed up as a contributor for Shutterstock. Please refer to the TOS for additional information.

General Stock Discussion / Re: GPS In Cameras - Question
« on: August 07, 2013, 07:46 »
Hy!

I use the gps4cam App on my iPhone and I am very happy with it.
All you have to do is to start the App when you start your trip. At the end you take a photo of your iPhones screen (showing a code). On your PC you run gps4cam on your folder with the pictures in. All ist does is to add the GPS data. Everything else stays unchanged. Sounds perhaps complicated but is very easy to use.
Works great and is very accurate (and really cheap, compared to a GPS module for your camera).

Cheers
This is also available for Droid phones as well for a one time fee of $2.99 which is way cheaper then a full blown GPS that needs to be frequently updated which the phone GPS does automatically so you always have the right info.

Not bad.

Works for all cameras.

All in all my thermometer was lucky if it broke the 90F mark this year when normally that would have happened dozens of time if not breaking 100F easily.

The rain wont stop.

And in August we wake up to a 60F cool morning that is more like late Sept or Oct!

Normally abnormal.

I live where our saying is: If you dont like the weather wait 5 minutes.
