They can take my royalty percentages, but they can't take my emoticons!

Haven't you seen the movie Major League? They will take EVERYTHING to get you to quit.  Pretty soon we will have to pay a subscription fee to use emoticons.

Don't give me any ideas.

I would far rather they named and shamed the IT team.
The failed site has nothing to do with that woman, and she should never have been hounded: an 'easy target' I guess.

Now there is a name and nationality to the face. Adriana from Columbia. A permanent resident applying for citizenship who was looking for free family photos.

Ah yes, Columbia - which explains why they were contacting Andres for leads... in addition to her resembling a number of his models.

General Stock Discussion / Re: Microstock Expo 2013 Agency List
« on: November 13, 2013, 09:57 »
Hi Leaf  :)

Thanks for the list... I couldn't get that information from the expo people... they told me I had to attend if I wanted to know!  :P   ::)

Cricket

I can't say if that is a complete list however... I am just posting what is public info.  There may be other agencies that attend that didn't want to be on the contact list and aren't speaking.

They consider themselves Midstock nowadays.  ::)

Interesting list, at least half of which I've never heard of.

Yeah, it looks like quite a few of those are German companies.. understandably

just got the official word from Lee.  Nobody from iStock is coming :(

They closed their office in Berlin so perhaps it was more effort than they wanted to exert.  too bad.  They are a sponsor however - nice to see that.

what about istock?

Good question.  Do you know who is coming from there?  There isn't anyone on the speaker list and the contact list that was shared doesn't have anyone on it either?!

Newbie Discussion / Re: Tracking sales on stock sites
« on: November 13, 2013, 00:52 »
Nice list, i guess i'll plan on purchasing them once my first sales money starts rolling in :))

Are there no free alternatives to any of these?

Sent from my GT-I9300 using Tapatalk 2

Yes, most people use the free alternative of a spreadsheet.  Track your daily overall sales, write it down each day and make a graph.  it is a nice way to see progress, the $/picture/day average and changes that portfolio size make to income.

I used microstock analytics, found it overall better and cheaper than stock performer

I use this too.  It takes forever to update the stats but I like that the results are offline (quicker to play with the data) and I also like that it combines sales from all the sites for a total for image or shoot X .. which was a deal breaker for me and stockperformer.  Stockperformer has very nice graphs and data though... if they could just combine agency data for each image/shoot that would be great.

I am a lawyer, educated in both common law (US) and civil law (continental Europe) jurisdictions, but not a trial lawyer, and matters relating to evidence are very different internationally. So take what I say with a huge lump of salt. BUT:

Civil Law

From my experience, the burden of proof and the parties credibility will decide cases like this. You as a claimant have the burdon of proof initially, but you bring all the evidence you can -- screencaps, correspondence (your take-down letter and possible replies), witnesses that saw the image on the site (give us a link, we all become witnesses then) -- and you make your case. At that point, the burden shifts to the other party to state that it didn't happen the way you say it did. Since you were telling the truth, that would mean lying in court (=prison time). Many people will not outright lie to a judge, and even if they do, they will not be particularly convincing. So if you got your stuff together and did your homework, you have a fair chance of winning. Most likely, the case will settle at some point.

Common Law (US)

You make your case to the judge and back it up with what evidence you have (see above). This, since you are telling the truth, will likely be convincing enough for the judge to order pre-trial discovery. This will force the other side to hand you over their records, including possible backups of the site that contain evidence of what you say. If they claim there are no such records or tamper with them (i.e. lie to the judge), that is contempt of court (=prison time) and if their attorneys are complicit in it, they are likely to lose their license. So if you got your stuff together and did your homework, you have a fair chance of winning. Most likely, the case will settle before discovery if it is ordered (because discovery is expensive and annoying).

Thanks for the nice summary.

Hello J-F,

Thanks,

If you are planning on coming to the forum more often than you might want to get in touch with the owner of MSG, Tyler (Leaf) and get a badge on your username so that you are verified as Photodeck spokesperson.

He hasn't written to me yet but I thought I'd give him a badge just the same :)
But but but, how do you know he is legit??  ;)

Just kidding.

.. yes I see the 'just kidding' but for those who are still wondering.  I can see his email address.  It's from photodeck and it has to be confirmed to add it.

Thanks for the interview.  I didn't know you liked to Cook Sean.  We'll have to chat next time we get together.

... and what town are you in Kjetil??  I'm in NOrway as well.

692
Kjekol,
I just sumbled on this post and I was wondering what your experience has been so far after leaving exclusivity. Have you matched your income by uploading to many agencies?

Also, how are you finding Octopus? I am looking for an submitting site and I was curious to get your opinion.

tx!

I tried Octopus again the other day and it looks like they had stopped supporting it.  Try microstock submitter instead!

Like last year. I'm quite certain they plan to release videos that you can pay to see of all the sessions and events after the weekend is over.

there is also a new entry ANDRESR on istock exclusives

exclusive http://www.istockphoto.com/andresrimaging
no exclusive  http://www.istockphoto.com/andresr

I don't know the answer, I guess I can ask Andres next week at the expo. but take note on the LTD of the new account.  One account looks to be a personal account and the other account is a separate entity, the LTD entity.

You have a few more assumptions in there.  One is that people are equally likely to post whether they are up or down.  I think that is false if people are doing well they don't want to post because it can lead to copying.

Interesting you use that argument.  People always say the yearly poll or other earnings threads are inaccurate because only the successful want to report their earnings.  The people aren't having a good time and experiencing poor earnings aren't going to care to report anything.

698
How am I supposed to have the answer then? I just dont know, do I? I only had a meet with 2 ladies from shutterstock and you expect me to answer stuff I no nothing about.

I just agreed with Cobalt that they are lovely people.

Thats all I am going to say, I am not letting you drag me into your battle against SS.

I don't think there are too many people who can answer that question... besides perhaps a Shutterstock programmer who has spent a few hours bug stomping

How did you afford it? I had to work my way through college and needed a paying job the minute I graduated. There's no way I could take an unpaid internship, which by the way is pretty common in the ad industry (and disgusting, IMO, as summer interns are treated like gofers).

I lived on friends' sofas (I paid them back later) and then for free in a building which was scheduled for demolition. I did every bit of assisting for cash which was offered and also worked at the weekends. The agency paid my travel pass and quite often someone there would feed me. I lived from day to day on very little money without ever really planning ahead - which is exactly how it should be when you are in your early 20s.

Speaking about the free internships.. I didn't ever do it but I wish I had.  When starting out - out of high school I thought that University was very important (and it probably is important.. at least a bit).  I did a degree in photography and ended up with very little that I could actually apply to running a studio or making a living any other way as a photographer.   At the time I also visited a photo studio that offered to take me on as an unpaid assistant but I didn't take it because I felt it was a rip-off.

In retrospect, if I wanted the best education to be a professional working photographer I should have worked for free for 4 years for the photographer and save the uni tuition and I would have been a lot further ahead than 4 years of university.  I learned lots at the uni as well but not much directly related to working as a photographer.

Thanks for the write up Ron.  Sounds like you guys had a great meet-up with Shutterstock.  Nice to see they are reaching out like that.
