Is FTP working Yet? Also, is there a stock-specific EULA in place yet?

I'm holding off uploading until I am sure  all is in order, and could do with some reassurance before involving myself further.

Image Sleuth / Print on Demand usage
« on: November 12, 2011, 09:45 »
Hi, I came across this site with lots of stock images and wondered if the usage is OK? One of my images is there and has only been sold through Shutterstock, Dreamstime, Bigstock, Canstock, and i don't believe any of those sites allow POD usage.

Perhaps someone who able to translate the website can put my mind at rest that the usage is OK?

Where is the 'payment for contributors' info?

Do you pay in 's or $'s? Do you make payment by paypal? What is the minimum payout level?

Thanks

Your site looks interesting but I'm going round in circles with the contributor agreement. I'm used to very lengthy legal docs from the other sites I contribute to, and yours is very short and sweet, but where does is says that the stock images are royalty free and that I retain all rights to my images and that contributing is non-exclusive?

Thanks

PLEASE IGNORE: I found the bit I needed now and all looks fine  ;)

Maybe you could site mail the person who got ripped off, letting them know?

I tried but couldn't tract artist down on Shutterstock due to _ in username.

Off to work no so can't do anything until this evening, but tonight I will see if I can track the original artist as a contributor on a different site, and try and contact them that way.

looks like they are in a lot of the agencies, several variations of the rip off on each site. You should definitely let all the image libraries know.

They aren't my images - I just noticed the similarity because this person did a 'take' on one of my bestsellers. It was annoying but was not a reportable offence, as there was enough variation. However, the example above appeared to be a direct copy, (simply flipped and with a few additions).

Here are the portfolio links:

I'm out of there. They are a pain to upload to and have no respect for their contributors. You can't opt out from their 'partner sites' and, if I understand another thread correctly, they are allowing POD without the correct licence purchase. Oh, and if you were unlucky and registered to the US site from Europe, you can't change your payment currency and take a hit by being paid to convert the $$$ to euros so you earn less than your fellow countrymen who just happened to register though a different webpage. What else are they up to that we don't even know about?

If contributors bail then so will buyers. I figure lost revenue at FT will be made up for by increased sales elsewhere and, if I'm wrong, at least I can sleep at night.

I just started uploading yesterday, and my images were reviewed really quickly - about and hour I think. I was prepared to sit back and forget about them for a while but was pleasantly surprised. How long before they actually show in my portfolio?

I have been reading this forum for a long time but haven't contributed before now. However, I have been following this thread with interest, as I guess everyone of us worries about the possibility of this happening to us....

You don't have to worry about this happening to you if you don't use 3rd party filters, fonts, or anything else made by someone other that you in your images. I think that should be the lesson learned here. Make your own textures, frames, backgrounds, effects, filters, etc.

If you rely on someone else's filters, effects, brushes, etc. to make your images, it will just result in rejections, closed accounts (like in this case), or accepted images that look like lots of other images and won't sell well anyway.

Don't bother. Just make your own stuff and you don't have to worry about any of this.

My concerns are not because I am using anything I shouldn't be, but more a concern that if someone decided to be spiteful and stir up trouble for a competitor, it can be difficult to defend a position with Stock sites who don't really want to enter into too much dialogue over the matter. What happened to 'innocent until proven guilty'? I know there are many thieves and copycats in this industry but I also don't think that everyone who is accused is necessarily guilty.

I appreciate that we are only getting one view in this particular case but if what the OP has said is correct and is the full story, it seams very harsh that a Stock site can remove a whole portfolio and affect someone's livelihood without taking all the evidence into account. The OP has effectively been fired by his employer and, on the face of it, without the case being fully proven. In any other industry, if you were innocent, you would have the right to pursue the matter via some sort of Tribunal or Employment court.

I am confused though. The OP refers us to Shutterstock's email which includes:

Shutterstock Images LLC ("Shutterstock") has discovered that an image you are attempting to submit to your portfolio has elements that are copies of another person's work and, therefore, belong to that individual or entity:

67635457 -- "film frame" (see attached thumbnail)
Original image here -- http://www.123rf.com/photo_2196537_retro-filmstrip.html

He is not saying that he is the creator of the work on 123RF, he links to his image at the bottom of his original post here:

and this is mine photo, without shutterstock watermark, because my photo was never approved
http://copyrightdesign.webs.com/apps/blog/show/7074417-my-photo

If you look carefully at both the images you will see that they are slightly different.

The creator of the work on 123RF has a very large and active portfolio on Shutterstock, and my guess is that the OP uploaded his image and a reviewer spotted how uncannily similar it was to an existing image in another port.

I have now idea how this particular filter works, but does it just create an image that could look the same time and time again?
