General Stock Discussion / Re: Ansel Adams photos found
« on: July 28, 2010, 13:00 »
Wait just a moment!, there seems to be some problems for Mr. Norsigian:

From the telegraph.co.uk:

But the photographers family rejected the claim and insisted that the photographs were fakes.

http://www.telegraph.co.uk/culture/art/art-news/7913901/Ansel-Adams-discovery-sparks-row-as-family-say-negatives-are-fakes.html

If you are interested in viewing some of the new (old) prints then here is the address:

http://www.ricknorsigian.com/

It seems the prints are already for sale for $1,500 for a Digital Print!

I should have been more clear. He can sell (or lease) the owned plates to anyone...ESPECIALLY someone who does have rights to reproduce the images for commercial use. That would be worth more, right?

Right, that would work . . . . . .  if that was his only option.

I do look forward seeing some more work from the master.

If Norsigian spent 10 years on this project so far I'll bet he's got good legal advice on his rights to sell prints. Maybe the glass plates aren't considered a protected work until printed. Just guessing.

In any case he owns the plates and can sell them or donate them to anyone.

Of course Mr. Norsigian is allowed to own the glass negatives but the question has to do with the rights to use those plates for commercial means.  As a painter, when I sell a canvas to a client that client owns the painting but not the rights to use that work for commercial means.  For example, the law in California is typical:

Under California Civil Code 982, when a person buys a work of fine art, the reproduction rights remain with the artist or the artist's heirs, legatees, (persons taking under a will) or personal representative until it passes into the public domain.

Or like RacePhoto reminded us about the 1923 cutoff, maybe those rights have passed into the public domain,
and as louoates stated . . . . the buyer has had time to get good legal advice.

From CNN

Experts: Ansel Adams photos found at garage sale worth $200 million

"Those boxes contained 65 glass negatives created by famed nature photographer Ansel Adams in the early period of his career."

http://edition.cnn.com/2010/SHOWBIZ/07/27/ansel.adams.discovery/#fbid=lT_Vb9RjQW-

I know, I know . . . you young whipper snappers are going to say what is a negitive?

But seriously.  What is interesting is the statement in the article:

Norsigian, who has spent the last decade trying to prove the worth of his discovery, is now ready to cash in -- by selling original prints of the photographs to museums and collectors.

Who owns the copyrights to the negatives found?  At the back of the Ansel Adams Calendars it has Copyright by the Trustees of the Ansel Adams Publishing Rights Trust.  I would think the copyright to those negatives still belong to the Adams family or Trust.

Well Done . . . . . .  don't stop now!

I kind of like "Single Fee" but it should be "Single Size Royalty" . . .  the word "Royalty" is the point and the customer is buying an image according to the size.  Guess it is too late to add it to the choices.

I was actually arguing that "Royalty" should be removed from the new term to avoid the conflicting meaning of "Pay per use". BTW the customers do not "buy an image" they obtain the rights to use an image. Thanks anyways  - we need more votes.

OOPS . . . . . . . really?

WarrenPrice (Mr.)

You and I probably have approximately the same number of files so comparison might be more helpful.  I am down ~ 30% across the 15 sites I contribute (compared to the last 3 months) . . . .  so yes, it is going to be a hard month. I say save your powder for the fall.

Just finished submitting 5 minutes ago and all went well.  Make sure the Description has 7 words and in the Cat. you either enter new words or click the little blue "do you like this choice or whatever?" under the words to accept the given words.

You should see a little green check mark if everything is correct for each area.

General Stock Discussion / Re: Thinkstock is alive?
« on: July 19, 2010, 15:50 »
still havent sold a single image from the former StockXpert  stable and my IS stuff is still not there...    guess I suck. 8)=tom

Me Too, one sale from the StockXpert collection for 25 cents since Feb. Best part is it was shot that was refused by every other agency except StockXpert! Ancient Neolithic Dwelling.

Which makes me ask... how much can ThinkStock be hurting the market if they aren't selling much of anything?  ???

There's a place down the street selling cheap subs same prices as SS and others, (not cheaper than Deposit Photos by the way) but they have no business and no customers, plus their product is mostly old re-cycled leftovers.  ;D

Lets pretend for a moment, that StockXpert/ThinkStock doesn't exist. As far as all reports from everyone here, the sales there are minimal if any at all.

Then where are the customers going? ThinkStock is getting blamed, called out, people write nasty-grams, but the place can't logically be the cause, if ThinkStock sales suck?

ThinkStock isn't hurting the market, but it is pushing it to the inevitable 3 tiered system of Maco, Exclusive, and 25 cent-ers.

By the way, where in . did you find that shot . . . . . it looks a little like my place :)

Computer Hardware / Re: Oh, my PC...
« on: July 18, 2010, 07:02 »
I don't know if the problem is humidity in fact. For some reason - maybe humidity - video cards have always been a fragile element in my PCs. In the previous one, I had to replace it every year! This now looks ok, although a small area in it showed corrosion - a kid of greenish-whitish substance on some welded contacts. It's like something had dripped on it, but there is nothing there that could have dripped. Marine corrosion is dark and more dispersed, and is seen in the casing (PC technicians always get surprised when they see my PCs!)

More likely to be over heating Maria !!  GPUs get very hot !!

Maybe u need to consider better cooling !?  An extra case fan perhaps ??  Try a piece of software that monitors the GPU temperature.

Madelaide

Here is the free monitoring software that I use, nice and easy.... monitors CPU, Motherboard, Power and Hard disk Temperatures plus other diagnostics:

Thanks for the update and thoughts . . . . .  but for me still gray smoke.
Don't worry. I stopped uploading. The rejects were too, err... random (to be friendly). My gut feeling is they won't make it with this attitude. I will try again later this year when they got some proper reviewers. And if not, good luck.

My application was rejected, and you know what, I agree with them 100%.  At least for now the site is mostly smiling people, with a lot of white, a very clean style . . . . . .  classical studio type photography which a lot of members here are very good, so good luck and go for it.

Also a good tip for beginners can be found at Planet Photoshop.  They have a "Planet Tip of the Day" that arrives at your email address once a day if you sign up . . . . . . . . . .

For example:

Planet Tip of the Day - Light depth with layer blending

Genuine Fractals is considered the best at upsizing but if the truth be known it is only marginally better than Photoshop (using the 10% rule, which is upsizing 10% then upsizing 10% again, etc, etc) The fact is, you just can't ask a program to add pixels and keep the quality beyond increases of ~ 50% max.

Veer / Re: Introducing the new Veer
« on: July 13, 2010, 08:14 »
I also don't get the Keywording at Veer, example: image "Pigeons in the Snow" accepted with 38 keywords . . . .  on the site there are only 21 words, one of which  is the word "accord".  I have no idea where that came from or what it means in relationship to the image. Something esoteric maybe . . . . . . . .

any body payment for June 2010?

No!

I didn't get anything from May also, my files are there from early May...
But I asked support, here is the answer:

Dear Sinisa,

Thank you very much for your email.

You files were only recently migrated over to thinkstockphotos. You should see earnings from the Hemera sales soon. All royalties are added once a month, around the 15th of each month, for the previous month.

Please let us know if you require further assistance.

Regards,

Darek

Thanks for passing that along, I can now stop checking every hour and feeling rejected.
