I'm really tired to see this kind of thief.
Microstock is a hard world and we found always thiefs who just open an account and published our works.

In first hand, it's just insane that microstock don't check a portfolio before accept it, or create an algorythm for check duplicate images in their database. With a simple "google search image" is very easier to know the real copyright author name.

In the other hand, i hope they will do more than a simple ban. They had lawer and they could take action more important than a ban.

When we found a thief and we succeed in this case, two more thiefs appears ...

could you add "creativemarket" to the title of this thread? If they monitor here they might not spot this otherwise. Also could help with getting the word out about their attitude to copyright infringement.

done !! :)

as creativemarket do nothing, i decide to create an account on it for comment each images of Claus40
with this sentence : stolen image, original image by "...." (i put original name copyright) for alert buyer that they don't buy an original image but a stolen.

What is the reaction of creativemarket ? : They removed immediatly my comments and delete my account  ;D
Did they protect thief ? probably  :)

I report this thief  to alamy and 123rf too :
- Alamy delete his account so good news :)
-123rf have begin the process and collect some proove, so i think, his portfolio will be delete in few day :)

Just creative market have a really strange reaction about copyright infringment !!!!
Strange way to protect artists !!

Hello everyone,

I found a new person : Claus40 or Ilya Lucanskiy (same user) who published stolen images on differents microstocks.
He or she stole images from various artists and published it on microstocks.

I already contacted 123rf and alamy for their process to the delete of his/her portfolio
But i need your help for the microstock "creativemarket"
For me it's just insane but they don't want to remove portfolio until the original author make a complaint to them even i sent to them a lot of prooves.

So if you know some originals authors from this stolen portfolio: https://creativemarket.com/Claus40 can you contact them and tell them to making a complaint directly to support@creativemarket.com  for keep out this thief.

Here some proove (and we can do that with all his/her images)

Original by Miiisha: http://depositphotos.com/2284112/stock-photo-wine-grapes-and-sunset-vineyard.html
Stolen by Claus40: https://creativemarket.com/Claus40/461817-vineyard.jpg

Original by Sandralise: http://depositphotos.com/3320051/stock-photo-assorted-spices-on-two-layer.html

I also recommand you to report freestockhere image urls to google dmca form here : https://www.google.com/webmasters/tools/dmca-notice

For example if your image is here : http://www.freestockhere.com/downloads/gold-and-black-badge-on-white-background-shield-perfect-choice/

Report these two urls :
http://www.freestockhere.com/downloads/gold-and-black-badge-on-white-background-shield-perfect-choice/
http://www.freestockhere.com/wp-content/uploads/edd/gold-and-black-badge-on-white-background-shield-perfect-choice-ft-98787647.jpg

(to have the second link, click right on image and select "copy image adress")

The aim is to delete freestockhere link url from google
As i said in a previous post, when i entered a original name of a photo in google search, freestockhere is in the first page so it's very important to delete them from google.

Even a buyer with good attention, using google image or google search for buying an image may be fall on this crapy website instead of fotolia or shutterstock

other bad thing: I enter on google search , the name of one fotolia image, and freestockhere is in the third position after shutterstock
it's just insane and freaky !!!

i have a response to fotolia this morning and they sent this matter to their legal section

So don't hesitate to alert other microstock on this crappy website for take them down

I made inquiries into this matter and i have some news:

I contacted Fotolia, and apparently they use their API system, so it's the reason why we see fotolia trademark on images
So they probably use Shutterstock, Depositfile ... api too

Use API is their trick to look legal but like Jo Ann Snover said : it's "Total frauds"
They use API for the look but not for the buying.
They use the file locker "Nitroflare" (file locker is an illegal file hosts, made by pirate) for making money on our stuff.
The people who have  premium account can download stuff for free and the other must be buying account for download
So all the money is directly inside their pocket

I hope that all concern microstocks will do something because it's a new step on the theft of our work
And for example here a quote of the api contract of fotolia (so they can do something) :

Quote
6. Indemnification

6.1 You will indemnify us and our subsidiaries, affiliates, officers, agents, employees, partners, and licensors from any claim, demand, loss, or damages, including reasonable attorneys fees, arising out of or related to your Works or other content that you provide to us, your use of the Services or Website, or your violation of these terms.

6.2 We have the right to control the defense of any claim, action or matter subject to indemnification by you with counsel of our own choosing. You will fully cooperate with us in the defense of any such claim, action or matter.

EDIT :

Here a new proove that illegal website was made by pirate

Bizarre site - they have watermarked previews for download. Anyone can get those from the sites themselves...

http://www.freestockhere.com/downloads/summer-3d-dimensional-texts-standing-in-beach-sand-with-sky-and-sun-rays-background-with-flying-colorful-balloons-umbrella-starfish-sunglasses-and-beach-ball-illustration/

and if you click on dowload button on your right you get this image in high quality and without watermark

Hello,
I just discover a new illegal website that contain around 34 000 images from microstock and available for free
So if you reconize your image or other, don't hesitate to send dmca

http://www.freestockhere.com/

General Stock Discussion / Re: NO SALES OF FOTOLIA
« on: July 05, 2016, 08:09 »
yes,, i'm agree with the most previews comments
And it's not original, a lot of flag or country already exist, so your potential sell are very low
If we remove flag, country and word in color image, your portfolio is empty ....
Be more creative  ;)

Adobe Stock / Multiple buying of the same image
« on: July 02, 2016, 07:33 »
Hi all,
I have a question,
Sometimes, buyer bought to me several time the same image (in the same moment), and i would like to know if someone know for which case, a buyer need to buy several time the same image ?
It's not the first time, that happened to me and apparently it's not an error

Thank you

Here a new illegal seller : http://www.digitoo.com.br/loja/layout/
So digitoo is definitly an illegal place , where thief can sell our work  :-\

21
Hi,

I have news : after my dmca and my email to digitoo, the content with my image was remove immediately but the portfolio of thiagoleme is always online and on sell so i'm very suspicious and i think that digitoo contribute to this.

So i encourage you to write to Thiago Leme here : http://www.digitoo.com.br/loja/thiagoleme/  and tell him what do you think about what he is doing :)
And don't hesite to prevent original author if you reconize image

Here an example of what i see
(Even his profil photo is stolen from a member of german music band )

22
Hello,

I just see an author "thiagoleme" from the website "digitoo.com.br" who sell microstock images stolen to a lot of artist like me
He download them from warez site and sell it !!
So be careful, i saw a lot of stolen image on digitoo

So i advice you to check this website and directly send email to their host if you found your content

You can directly sent dmca letter to their host like this:

To: abuse@unifiedlayer.com
Subject: 162.144.88.140 digitoo.com.br
Message: Your dmca letter ...

I already did this for my images and i contacted digitoo for this
Here the link where i found my images: http://www.digitoo.com.br/loja/thiagoleme/

Hi,

Yes, upresentation or smiletemplates are illegals
I already investigated the subject :
They haven't license (they need commercial license for each image)
They don't have partner with any microstock, they just took pictures from warezsite.
There are websites making by the same user from warezsite

The text makes it sound as if they have contract designers doing the work.

Yes, but it's a pretext for say they are not directly responsable, but they made money with our work illegaly
I already put down my pictures on it with DMCA.

The best way to fight these websites is to regroup all contributors stolen and hire one lawer to close these website and ask damage.

Why are they not directly responsible?

They are but if they have complaint , they said "i'm sorry, it's not our fault, it's the designer who submited the template
But if we hire a lawer, they will have difficult to protect themselves behind one sentence.

Hello,

It's just an idea but we can create our own microstock self-managed.
We can fix our own price and commission and it's perhaps a way to leave the other microstock
One microstock create by contributors

What do you think ?
