I just had a RF sale on Alamy with a discount of 96%.

Going throught the list I found another one that slipped my attention with a 98% discount.

I don't see the point of even charging that client for images. This is ridiculous. It wasn't a Novelty Use sale it was a regular RF sale!

I've read that photographers add a link to their business web site but is it also allowed or ok to add a link to the image description that refers to the image at a stock agency?

Is flickr not happy about that since they work together with Getty?

It started with problems when trying to transfer images from FTP to the contributor area but now I can't even log on anymore.

I'm using both Firefox and Internet Explorer - nothing works.

Since I was dealing with a copyright infringement in Germany, I was reading the German license terms and it really hurts trying to read that.

I'm German and never "checked" the German version of DT but they rather should remove a lot of their copy because it's simply wrong and partially not understandable. I thought at least the legal terms would have been professionally translated by a certified translator.

Can anyone check the other foreign languages and give feedback here so at some point we can send in one request explaining that this isn't good for either them or us. I bet the buyers (at least those who actually read the terms) must be more than confused.

Since I've been working on a couple cases of copyright infringement these days I was looking further into the matter and it did quite upset me.

To make a long story short:

- Copyright attorneys (or IP lawyers) will probably only work on contingency if the case is easy to overview, your files are registered with the US copyright Office and the infringing party is loaded with money. Which means very large companies and not Joe Doe's plumbing service from the next block that nicked a couple of your images for his web site. As the lawyers want to make sure they get paid, they only want to deal with liquid companies.

- Don't ever cry anymore about Zazzle, Cafepress, Art.com or other POD sites where other users sell your products. Face the fact that a DMCA claim is the only and best way to bring it to a stop. Don't expect to get any money out of it. Those cases are too small. Sadly, the infringing parties might get away with hundreds of $$$ in royalties (as they did on the stock agencies as well - until they get caught).

- Various sources confirmed that a somewhat average rate would be between the upper 4 digit to 5 digit amounts for hiring an IP attorney. Don't ask me if that includes litigation but I'm still nauseous because of that. Lisa, you had an instance before with some TV show that infringed your right and you took a lawyer. I think it was settled quite easily. Maybe you can share some more info.


Now, as much as some of this isn't new to many, what bugs me most is the fact that many, many small infringements, that we can't pursue due to the high legal costs add up to a lot of money.

Just the accrued royalties for infringements that I found with my images added up to about half a year's income so far. So it is a significant amount for me, while it maybe a laughing matter to other photographers or lawyers.

Nonetheless, money recovered or not, our copyright has been infringed which is another whole issue on top of that.

So the essence of the whole research is that basically no one, has to fear any serious consequences if they sell stolen images on a small scale at various agencies or POD sites.

I'm trying to find young and aspiring IP attorneys who are interested in working together with photographers to find a way to simplify the process of recovering damages by reaching settlements. If anyone knows someone who could help let me know or contact them to get the ball rolling.

Here is the situation:

Some numbnut ripped one of my images and made composites out of it by adding random, isolated objects to my background image.

He then used to upload them to the agencies and actually sold some of them. He has been banned for a while now but I still come across a bunch of sites that have my/his images online.

How can I make a proper DMCA claim as the image was illegally created in the first place but whoever bought that picture or ripped it doesn't know that?

One of my images together with another image was used to create a logo.

Each image uses 50% of the entire logo.

My image is a raster illustration and another image (an isolation) was slapped on top of it.

Is this copyright infringement or a new artwork that someone else can claim copyright for?

They claim that any image on their site can be used commercially without limitations (well, no kinky stuff etc.)

Images obviously have the DT logo on them. Didn't know that a third party can license DT thumbnails for "free".
Is that right or am I over reacting?

Some people signed up with them but never heard back how it's going.

Either they are making a killing and try to keep everyone else out of there or it is in fact dead.

Their submission terms are in English now:

The only way to cash out is via bank transfer.

The mentioned file doesn't even show up in my downloaded list...

I wonder if I contacted IS they would actually look into this matter and then deduct the money this file supposedly generated...?
It's a footage clip so it would have to be a bunch of credits.

I know this won't deter everyone from uploading other peoples' images but Zazzle added a check box when you create a product that says:

This may prevent the one or the other copyright infringement. I'm totally for it.

No idea how long this has been up there, I just saw it now.

There's a film shoot happening close by all day and I took some photos of the set including one of the main characters of the TV show.

Many residents living in the neighborhood were watching the filming also taking pics with their cell phones and compact cameras.

I've been asked to stop shooting by two PAs as "You've taken enough pictures" and "if these will end up online, you WILL be sued".

Maybe some of you shoot things like that more often and know "the ropes" of the what you can and can not do. I was standing on public grounds (on sidewalk - police officer next to me not mentioning anything)

Supposedly I can't put the images online before the episode airs because of the wardrobe of the main character.

I'm asking because I can't find any editorial shots of that character as editorial not at Getty, Corbis, Alamy...

Are the file size limits (12MB) and resolution (up to 8000 pixels) still in effect?

If so I have to start resizing a significant amount of images just for PM which would be a big pain, obviously.

Can anyone confirm this?

Since this flickr discussion came up again I was peaking over there again to see what the competition is up to these days.

I came across many fantastic shots, offered in decent sizes up to 1200px without watermarks.

I feel like a paranoid idiot uploading unwatermarked stuff - even at 500px width.

The craziest part was that none of those awesome images was picked up by Tineye. Not one. What's up with that?
How come that flickr images are immune to theft? Tiney should pick up at least some sites with those images on there.

Did anyone else make that experience? By now I'm so discouraged to even upload watermarked stuff that I might as well forget about it...

Did anyone already contact P5 to figure out why the API they are using only spits out a fraction of their portfolio?

As long as I cannot upload directly to them I wish they had at least my entire port from their partners.

I might not have gotten all the info that may have been discussed here on the forum so maybe somebody can point me into the right direction.

I don't recall whatever happened to the mentioned Paypal 200 yearly transactions limit or exceeding $20,000 of yearly incoming transactions. This whole issue came up at a time when the 1099 thing was going bonkers and supposedly has been settled now and won't happen.

But does this "not happen" apply to the 200 Paypal transactions as well, respectively the $20,000+ worth of transactions?

As a US resident do I have to watch out for those limits now?

Your help is appreciated.

The fact that companies, lawyers and other individuals have ripped one of my best sellers is nothing new to me.

Yesterday I found one of my images on another semi-pro web site in full resolution (indexed by Google images - unfortunately) so I contacted the owner who replied today that he has no idea what this fuzz is about since he got the image from his web hosting company.

I asked for further details where exactly the image is located but apparently it is part of the web host's image library for their customers.

I wonder why they would provide full resolution images.

If it does turn out that my image is being used by the web host how do you think should I proceed as I don't even know where they might have gotten the image from (which agency etc.).

I registered copyright on that image also.

I just moved 500MB to iStock (one clip) only to let me know that my clip which is 30 seconds and 00 frames is too long.

Am I supposed to upload 29 seconds and 29 frames or what?

I don't do editorial (couple shots here and there) but since DT and IS started offering it, I see tons and tons the iPhones, iPads, Coca Cola and other world brands isolated over white.

Is it such a huge money maker or is it a big fluke?

Is it a big secret as those contributors make millions off of those shots?

And what about the legal aspect when the actual brand is main concept of the shot? Wasn't editorial kind of "just don't remove logos" kind of thing or having no model releases.

Any comments?

I've been noticing this now for a couple of days that the featured editorial images (preferably the ones of VIPs) don't show when I click on it.

The image page opens with the message: "Unfortunately this image is no longer online."

What's up with that?
