Sorry, I read too fast and thought she wanted a logo, which is normally not allowed with stock licences.
If her 'graphic designer' licensed the image, why can't s/he make the simple changes? No problem, no issue.

It was shady mostly because when I asked her who owned the image it was "I do" ... and didn't point out that she'd purchased it until later ... I don't think that I'd want someone tracing one of my images ... especially since she now probably has a bw vector and had what appears to be a medium size .jpeg ... Just seemed a bit fishy to me ...

377
Maybe you picked the wrong infringement?
The usual 250000 usages, and the less usual logo use, are allowed by VectorStock, but looks like she wouldn't be allowed to transfer the image to someone else to modify:
VectorStock grants you a personal Single-seat, non-exclusive, non-transferable, license to use and reproduce vectors in the following ways:
Advertising, marketing and design, promotional graphics, broadcast TV, film or TVC, film commercials, flyers, brochures and catalogues - digital or hard copy. Website design. Promotional postcards, greeting cards and calendars. Books and book covers, product packaging, editorial in magazines and newspapers, general editorial and newsletters. Ebooks, screen savers and digital banner advertising. Posters and billboards. Sign writing, logo and branding design. Web and on-line digital publications. Software, gaming and computer GUI design, i.e. iPhone apps. If you wish to resale a product, which uses or contains our content you must purchase an Expanded License. If your print or production run will exceed 250,000 units you must purchase an Expanded License.

http://www.vectorstock.com/faq (Licensing link)

I bet that happens all the time (someone buying an image and getting someone else to modify it). If they don't post on Fb (etc etc) how could it be policed?

UGH ... I still don't know why she wouldn't go to the original artist and have him do it for her. She said she wasn't going to use it as a logo and 250,000 is a ton for probably anything that she'd be doing I'm sure. Just seems like shady business to me ... Guess I should just be pleased that she paid a few bucks for it in the first place. lol.

Actually Dallas, No this is not my logo. My logo is a word. This is just a pic that is purchased and used under license without limitation and incorporated into merchandise as artwork. Nothing illegal, or unethical about it! Yes, the original artist still maintains all intellectual rights of the image but once he sells a pic the purchaser has right to use that pic in any way outlined in the TOS. Yes, I was only giving an example of a standard TOS...which is pretty much the same across the board. But regardless, I have the legal right to use this picture as a purchaser of the stock photo. That is why artists sell their photos in the first place! Good night and thanks for hijacking my post!

It's funny because I was just thinking about this topic last night.

So, last week I did softball posters for the local chamber, they're doing a charity. The proceeds go to support the shop with a cop program. I cut them a deal and charged $70 for the poster and a single color graphic for shirts (for some reason, softball tournaments do really well here ... I found out today that they ended up with 8 teams, at $250 bucks a peice my measly $70 seems pretty miniscule)

In November the city hosts a "homeshow" (basically showing off people's decorated homes) and collected like $15 per ticket or something, the proceeds go to support that same program, as well as some other charitable bs. I spent like twice as much time designing the signs for the stupid "homeshow" and charged them nothing. The logic ...

That said, I do frequently use free image sources as well for my blog, designs and whatever but, when needed haven't been afraid to pay for imagery (especially when that means handing the bill down the line). I would think that most businesses/non-profits would understand that this is our business and while sometimes you can get/give a deal ... it shouldn't be expected.

Assuming we aren't grabbing our pitchforks yet. Rimglow nailed it I think, at work if we can't find an image to fit, we take one, make one, mesh two images together or just scream in frustration that the advertisement is stupid and ragequit for a while.

Having worked with ad agencies for 25 years, I see how they use microstock. Initially, they buy cheap versions to use in comps to present their projects. Then they would contract me to shoot something very similar. As cost cuts became more important, they would just start using hi-res microstock images and eliminate the photoshoot. Many times I would end up using microstock photos for my project because I couldn't find the subject matter to shoot myself. (especially food or plants that were out of season, or not available in the US)
I shoot isolations, in full focus, that can easily be stripped into projects. I try to imagine how an art director would use my isolated image in their project. That's how I made a good living for years, taking various images, and assembling them in Photoshop, to match an art director's comp.

Hey Shelma, update - Leo has told me that it's not doable with the current SS, but acknowledges that it's a a good idea and should be included in the next version. In reply to that, I asked this question:

"OK thanks Leo - question then; is there a way to customize the message at the checkout stage somehow to make it very clear to people, in very large obvious type that they will definitely see, that they can use a credit card WITHOUT a paypal account, and that it's VERY secure?"
Is there a field in the SS dashboard or elsewhere that I can edit myself to display this, right at the point of purchase?"

I'll post here what the reply is -  KK

I'm glad that he got back to you. SSL certificates are something you purchase from your hosting company and are I BELIEVE required when accepting credit card payments through your site (well, I'm sure you could without but it'd be a terrible idea) ... for instance when you go to check out at any site (even putting in your info for paypal) the protocol switches from http to https if it wasn't already https. The security certificate just encrypts data sent to your web server so that it can't be snooped on by others.

P5 accepts almost everything I submit, stills and videos. Yes I do have rejections there but not enough to close my account. I consider P5 one of the "good guys" of stock, a fair trade agency. My sales are low there but I am hoping they pick up steam.  Have you tried contacting them to have a discussion about the rejections?

I do understand your frustration. I just had 45 of 50 rejected on Photodune and am about up to my limit of the high rejections before I call it quits.  I did have some email exchanges and they ended up accepting most of some previous images, but it's just too much hassle to keep emailing PD to argue rejections when their sales are pitiful anyway.

I think like ... half of my illustrations were rejected ... But, I too like P5 and what they're trying to do ... Understandably they're trying to push video more now which is fine really ... It should bring more customers ...

Any possible way they can bring in some traffic is absolutely grand imo. I've definitely been more optimistic about P5 than most other sites.

Adobe Stock / Re: Fotolia Joins Adobe
« on: February 06, 2015, 13:52 »
I agree with Striving. Adobe and Fotolia will treat contributors any way they want, to make as much money as possible. It would be naive to expect anything else.

I'm not a very big fan of Adobe. Illustrator is pretty much the same program today as in 1987. And many bugs have been around for a decade or two. And personally I now have to pay about four times (!!) as much a month for their software as I used to because of the CC system. Only people/companies who used to buy the really expensive CS packs will save money on CC.

How come exactly? Photoshop and Lightroom combined are 9.99$/month.

Photoshop CS6 extended by itself was 999$. So you can subscribe for 100 months (8.3 years) and pay the same, all the time getting fresh updates. 8 years ago the most recent version of PS was CS3.

It's similar with Illustrator. Also 9.99$/month, and CS6 was 599$ (60 months - 5 years).

Maybe you use some different combination, but for most creative professionals, CC is cheaper.

The problem for me is that I also need ID, Flash, and while I don't need DW and could use notepad++ or something, it's a tool that I use... at $40 for those 4 I might as well have the suite just in case I decide I want or need to do something different that day. Maybe I'm in the wrong profession but, $600 a year is a little tough for a small designer in a small town ... Though, I would take the plunge (and want to) if I even knew that I'd make $50 that month. lol. Hopefully spring will start bringing some exciting projects.

Ps for $10 seems like the photographers have it made ;)

Symbiostock / Re: Problems with purchases
« on: February 05, 2015, 19:20 »
I am doing well. I'm taking it much slower now.

For quite some time I've been creating a new version of Symbiostock. It interacts with woocommerce to work in bulk and sell downloadable images.  But I'm in no rush. As you know woocommerce can handle any gateway and is created by a team of people and collectively has thousands and thousands of hours into it. Besides that the new version's networking and image processing functions are more streamlined.

I can sympathize with the frustration of trying to get something to work for a desired outcome. I use Blender 3d, and in it's early days it was quite cryptic to learn, but I used it because paying $3000 for autodesk software wasn't an option.

I think Symbiostock is the same way - it was created with the idea of getting some independence from micros but not everyone can be a web designer and an artist. There is a point where we have to say "lets be reasonable!".

Cathy has had some good results with her solution which apparently is easier. If you assess your personal situation that hosting is still worth it for you, then there are many options with different strengths. If you stick with Symbiostock I've just fixed the forum up so people can sign up easier. It turns out one of the spam tracker sites it interacts with no longer provides service, which is what was blocking signups.

Anyway, whichever way you go Symbiostock is still useful in its own way.

Symbiostock definitely serves its purpose ... before symbiostock I don't think many people wanted to try to self host (still many don't) but, Wordpress is free and mostly easy. It's interesting that you picked woocommerce because I was looking at it a few weeks ago and thought that it might be my direction if I decide to keep going. One thing that I am worried about though is paying for an SSL certificate and then not making that back ... (though having it could result in significantly more sales, many small to medium businesses use credit cards for everything) I might even just leave my site the way it is, obviously it's not hurting me one single bit and if next year is the same as this year, it will continue to not hurt one bit.

I'll jump back on the forum (hopefully I can remember my info). Definitely enjoyed the people there and the energy we shared for a bit.

I suppose I'll just answer here.

When everything is set up properly symbiostock works. That being said, on a server there are many elements which interplay, and then of course there is paypal itself you must ensure is set up properly.

I do try to consolidate help requests on the forum provided. Could you please confirm that signup on symbiostock.org goes well? Both of you? TY

Leo

Symbiostock works pretty well and you really are doing amazing work ... My main peeve is just trying to justify renewing (and that stupid Safari download) Also, another customer had problems downloading but, when she contacted me I just sent her the file at high res and thanked her for letting me know. I'm trying to not concern myself with stock much this year.

How have you been Leo? I think we last talked I was asking you about paypal and such? Maybe October?

Adobe make good solid software they're at the top of their game for a reason.

Yes, they bought their main competitor and made it sink (Macromedia Freehand)

Don't forget Flash, Director, Dreamweaver, Fireworks, ColdFusion ... Adobe didn't make it sink ... They acquired the company ... The two similar programs (illustrator and freehand) were combined into one as were Flash and Director. I wouldn't guess that acquiring Freehand was nearly as influential in their decision as was acquiring Flash and Director, a technology that continues to be used at every corner of the interwebs, as well as in other multimedia products.

Pond5 / Re: Pond5: What should we improve?
« on: February 02, 2015, 05:53 »
I can't even believe that this thread got revived ...

Mostly right now I feel like Pond 5 needs customers ... I visit daily and have a couple sales there but, I feel like they've ramped up on trying to sell footage (for very little as people have noted)

Also, as others have said, that upload process is a bitch ... Honestly, the only reason I keep many of the middle-lower tier sites is that if I'm already uploading I might as well upload everywhere since my internet will be tied up for a minute ... but, when the process becomes a good 2-3 minute questionnaire for every image? It's quite a bit less worth it. ....

and it's none of your * business what software I use Pond 5, the notion seems fun but, fuck off ...

395
-Open Notepad (or other plain text editor)
-Drag the .eps file into it.
-If it is an eps 8 file, you will see a line like this in the top few lines of the file (probably the second line):
%%Creator: Adobe Illustrator(R) 8.0
-If it is an eps 10 file you will see a line something like this (maybe the third line):
%%Creator: Adobe Illustrator(R) 13.0

You can also check for the following (should also be at top), which is independent of the AI version used to make the EPS:

EPS8:
%!PS-Adobe-3.0 EPSF-3.0

EPS10:
%!PS-Adobe-3.1 EPSF-3.0

Theoretically, you could also search the EPS for specific PostScript commands to determine which, if any, EPS10-only features are being used - i.e. could the EPS10 be converted to EPS8/SVG/etc. without losing anything - but I haven't dug too deeply into that.

That would probably let rasterized effects and images pass though :/ I launched a message to someone last night to see if there were a way to automate the process ... If there is I'll definitely share it.

SS + FT  8)

All the rest  :(

Actually, the FT/Adobe deal might be my only excitement about microstock this year. Adobe has always held a decent standard in my point of view ... even with their monopolization of multiple industries it seems like they've remained their stance to be relatively transparent and fair. As I'm mostly a designer I can see the benefit of an integrated library just ready to "drag and drop" or close to it. Immediate purchase and cc integration will be pretty important to its success ... as well as the fact that (If my employer subscribed to Fotolia instead of their current subscription) would shave a few hours off my weekly workflow easily. I'm optimisticish, that it will work in favor of contributors as well ...

I still don't plan on doing much on microstock, I love the forums and most of the people here ... but, I've made just as much in 6 months writing as I have in 2 years of trying to be an illustrator ... Keeping my Symbio site is still a decision I keep tossing around since the deadlines coming up ... I just don't know if I can waste another year of my life on yet another dying ambition (when I'll always find new ones for their place ... like finish this beer. I should finish this beer ;) ) ...

397
Interesting question. I don't know how the agencies do it, but here is one way.

-Open Notepad (or other plain text editor)
-Drag the .eps file into it.
-If it is an eps 8 file, you will see a line like this in the top few lines of the file (probably the second line):
%%Creator: Adobe Illustrator(R) 8.0
-If it is an eps 10 file you will see a line something like this (maybe the third line):
%%Creator: Adobe Illustrator(R) 13.0

AI files are more complicated.
Maybe other people know of better ways to do this.

Thank you very very much.

That's the only way that I know how to do it ...

I've actually wondered for quite a while if there were a way to set eps10 and the other requirements for submitting to Microstock. Maybe I'll bug someone, I've got a couple friends that might be able to help ...

Newbie Discussion / Re: Hi im new round here.
« on: January 24, 2015, 16:50 »
Use filezilla for FTP.
Use IPTC.
Do not upload all files at one day. For example dreamstime will reject all your isolated files maybe with the reason to combine them (happened to me). So you maybe will waste a lot of time.

Think twice before uploading. SS is very easy to upload. Bigstock is a shame.
Stockfresh has a daily uploadlimit. Do you need this agency? Is it worth to upload daily? You have to check that for yourself. Some agencys are very easy. At a few you just need to upload your images and not more.
Some guys use software to upload to multiple agencys. Maybe this is a solution.
Good Luck.

Agreed.

Using ftp for the sites that allow it and filling in your IPTC data before hand is a huge time saver. Usually I just start the upload on every site, go shower or eat or whatever ... come back and finish and submit them.

399
I got something similar about a supposed European payment with a link that appeared to be for a Word document-  se607yj.doc - but didn't seem to load (there was a download failed message). I hope it hasn't done anything.
What is the "major fraud" they're trying to pull?

It's probably not major fraud ... just phishing attempts (which could end in fraud, or technically could be fraud since they're pretending to be someone they're not ... anyhow) ...

It's pretty much the same thing as the old woman in Syberia or some crap who needs to move a sum of $5,000,000 to somewhere in the states or blah blah blah.
